Senor MacKenna, who was in court in company with his private secretary, Mr. Bunter, paid great.attcntion to the proceedings, which, though of a preliminary character, were very interesting. ‘Through his counsel, Mr. KE. W. Stoughton, he waived his privilege as a seeretary of the Chilean legation, which he otherwise claims, though not prezented as such at the time of his arrest, and pat himself upon trial, pleading not guilty to the arraignment. Un- der these circumstances I had no opportunity to com- municate with the Department of State, or with the President, and I therefore took such measures as 1 deemed due to the occasion and due to the dignity of the government which I was ited to represent in an humble way, Under my directions measures were at one» instituted in all these matters for the preservation of the neutral laws of ‘the country, and in justice to the government, to the President and to the Secretary of State, Iam very happy to eay that when the whole mat- ter came to their knowledge, at the very earliest moment thereafter I received for a response that my action was commended by the Presidoat and the Department of State, and the BF epenenesme at Washington was deter- mined, under all circumstances . whatsoever, to execute pine and firmly and in good faith the law, and insist on the observance of the neutrality laws of the country. Cireumstances last week came to the know- ledge of the District Attorney that made it proper that Senor MacKenna should be presented to the Grand Jury of the county. His case was accordingly presented, and the indictment which is presented and now under con- sideration was found, On the evening of the 6th inst. I believe Mr, MacKenna was arrested by a bench war- rant issued from this court on that indictment. Early on the morning of the 7th I learned from the Marshal that he had asserted a privilege as the Secretary of the Chilean Legation. Bucken,—This case excited considerable interest, ar it involved the right of title to eu autograph letter of the illustrious George Washington, written to the Mayor and Common Council of New York in the year 1785. Thiet letter was gent in response to a series of complimentary resolutions and an address transmitted at that time to the: “Father of his Country”? by the municipal authorities, The war for the nation’s independence had just been con- cluded, and all eyes were turned upon Washington in grateful enthusiasm as the great leader who had so suc- cessfully conducted the campaign. Recognizing this fact, our city authorities thus complimented h grateful remembrance of his brilliant services. ‘The facts iny the case which led to yestertay’s suit appear to be as fallows:—In December, 1784, at a meet- ing of the Common Vouncil, held at the Almshouse, in this city, the address and resolutions wers adopted, and soon after forwarded to General Washington, enclosed in agold box. Ata subsequent meeting of the same body, held the 2d of May, 1786, at which Mr, James Duane (then Mayor) presided, the letter in response was read and ordered to be placed on file, Last year this letter ‘was put up for sale in the axction room of Messrs. Bangs, Merwin & Co, and knocked down to Mr. De Witt C.
