MUSICIANS. he Brooklyn Park Theatre Case—Rels- eenherzs vs. Conway—™ Conway en the Witn Stand—The Jury Cannot New Trial Ordered, &c. ‘The trial of the cuit in which Henry D. Beissevherz, Tate leader of the Brooklyn Park theatre, is plaintif, ead Mrs. Surah Conway, the manageress of that institu” tHoa, is the defendant, was continued yesterday accord- fmg to adjournment, before Justice Buckley, in the room ef the Court of Sessions, The attendance of spectators em this occasion was not so numerous as on the two previous occasions when this trial was on. There were a few actors present, among whom wag the veteran Bavidge. There were a large number of musicians, embers of the New York Musical Protective Union, ‘who apparently feel a deep intereat inthis case, as it as an indirect bearing upon their several interests. Mr. P. B. Conway was in court; but his wife, the de- Sendant in this case, was in an apartment adjoin- fmg the court room, and remained there until ealled to the witness stand. Some delay was ovca- @ioned in getting the jury together—three of them absenting themselves over an hour beyond the time which the case was previously adjourned. Messi 8. Spencer, Luke F. Cozans and A. V. Hofer ‘as counsel for the plaintiff, and Messrs. S. D. nd James Troy (the District Attorney and his ‘essistant) for Mrs, Conway, the defendant. On the pre ‘vious day the case was adjourned before Mr. Beissenher7, the plaintiff, had concluded bis cross-examination. Ue rofore recalled to finish bis testimony. Mr. Beissenherz's cross-examination continuied—The erobestra Jeft on Tuesday night, the Ist of November; 1 called on Mrs. Conway on that day in reference to their leaving; I wes taformed she had received a letter fromthe New York Musical Protective Society; I knew the letter had been received by the letter being shown me by Mr. or Mrs. Gonway, either one or the other. Mr. Alfred Sedgwiek. the present leader of the Park theatre orchestra, testified that Mra Conway began to gotiate With him @ Weel or ten days before the Ist of November. Another musician (Mr. Weeks) alao testified to the fact of Mr. Beissenbere’s playing out of time on the occasion referred to, ‘ The counsel on both sides then summed ap in. anise lengthy speeches, when the case was given to th q fa mgd and returned ra half. r ire o'clock P, M, when the foreman stated they could not agree upon verdict, whereupon they were diecharged. They stood four for the defendant and two for the plaintiff, A new trial of the case is ordered to take place on the 16th inst., at ten o'clock A. Mf. Court of General Ses: Before Judge Russel. A VICIOUS NEGRO BOY SENT TO THE STATE PRISON. At the opening of the court yesterday, the City Judge called the negro boy Brown to the bar for sentence, He pleaded guilty on Thursday to a felonious assault and also to burglary. The Judge said he was such a dangerous ebaracter that the lives of the inmates of the House of Refuge would not be safe if he sent him there, so that he would be compelled to send him to a place where a strict wateh would be placed upon his movements, Be was, therefore, sentenced to imprisonment in the State Prison for tive years, CONVICTED OF PETTY LARCENY. ‘Wm. Houry was tried on a charge of etoaling an over- coat from Morris Davia, No, 3 Sullivan street, on the #th of December. As there was some doabt about the value of the property, the jury convicted him of petty larceny. He was sent to the Penitentiary for six mouths, and or- dered to pay @ Une of one hundred dollars, CHARGED WITH STKALING A WATCH AND MONEY. Eugene Nonun was tried and convicted of grand lar- ceny in stealing from Owen Flynn, 319 West Twenty-fth street, on the 2%th of November, a silver wateh and about thirty dollars in money. The complainant gave an interesting statement of the way in which the larceny was perpotrav!, It appears that the prisoner and another man visited hit premises, when Nonan, who was acquainted with Sir. Flynn, said that his friend was con- nected with a society which prohibited him from drink- ing and requested him to shut the front door, which he did, While in there the party bad several drinks, ¥ taking soda water, After he took the third bottle a strange sensation came over him and he soon becawe nnconsciong, not, however, before he saw the prisoner and he confederate take bis watch and maney.
