At the opening of the court yesterday John Ward, who ‘was tried and convicted of the horaicide of policeman Walker, before Recorder Hoffman, was arraigned for sen- ‘tence. REMARKS OF MR. SPENCER. Mr. Charles 8. Spencer, the counsel for the prisoner, gated that he had on that morning received important Snfermation, which he would put into the shape of aili- davits, A young man by the name of Daniel Crifly, who said that he was present at the time of the ocourtence; that Donohue, Wilson, Conner, a man named Clang Reiley, and a woman nained McEwen, were there; that. when the officers came to the door Conner rushed eat first, and that he was the man Walker attempted to seize; that the instant before Conner rushed out the door ‘was violently slammed open suddenly agafust the other ; that this fellow Clang Reilley in quick succes- sion followed Conner, aud that Ward was the third man; that hearing the report of the shot at the instant, on the first rush he (Reiliey) escaped through the back way, and bas t quiet about the matter until now. He felt it uty to call and lot him (Mr. 8.) know ee facts, and that this man, Clang Reiley, from that moment till the present has disap- . If these facts were put in the shape Of affidavits, and if the court had the power (as the chy Judgo had’ decided it possesses), it would be a good ground to base a motion for a new trial. He was not Without hope that Mrs, McEwen might be induced to make a statement of the facts, which she undoubtedly knows, and that the police, if put upon tho trail of this ‘man Reilley, may succeed in arresting him, and that the real murderer of officer Walker may eventually be Drought to justice. He (the counsel) was also informed that with the exception of a few weeks the prisoner had worked a: the wire drawing business steadily for some three years. THE RECORDER'S ADDRESS 10 TUR PRISONER. The Recorder sa'd—I shall dispose of the case as if the aM@davit were made now before me. I consider it as made, and you may fle it whenever you choose, The statements which the counsel for the prisoner make, as based upon information derived from this missing wit- ness, are entirely at variance with all the testimony on the frial. They are made by a man who, according to his own admission, has withheld what he says is the truth until a peri ‘od so late that it could be of no use to 'y. If he was entitled to any credit at all at any time he has forfcited his right to be believed the fect of withholding the information so long. All the witnesses agree that only two men went into that place on tha: occasion; and if there be any truth in the state- ment of this man, to whom you refer, you will have to ry the Governor upon that I kaif 4 It bg too late for it to have any effect he Recorder then addressed Jobu Ward as ioe: Wane, you were indicted for the murder of Thomas Walker, ene of the policemen of this city, a man who g@tood well in the department, and who was ‘universally respected by all who knew him. There is no other way in which a police @rce can ever be made effective than to let every man ze it realize that the courts will stand by him his efforts to discharge his duty. It bas been > Pittiets rule, believe it has been of my associate (Judge Russel) in this court, to in all cases with great severity any "man makes an assault uy an officer of the law.
