THE PRIVILEGE OF THR WRIT OF HABEAS CORPUS TO BR SPEEDILY RESTORED. ‘There is good reason to believe that tho . Presigent will . 10 few days tesue @ proclamation restoring the privi- lege of the writ of habeas corpus, As a consequence ‘there will be mo military commissions or courts to try offences in districts where the cases can bo disposed of ~by the civil tribunals. THE PRESIDENT’S MESSAGE AND DEPARTMENTAL REPORTS. Contrary to the usual custom the printing of the Presi. dent's Message has not been confided to the government printing office this year; but the document, which is Tepresented to be quite lengthy, has been placed in the hands of the Treasury printers, who have already fur- ished proof slips of the major portion of it. The Presi- dent continues to furnish copy. The Departmental reports are nearly all concluded and » in the hands of the printors. Those of Secretaries Den- nison and Welles havo been returned to them from the office. Secretaries McCulloch and Stanton expect theirs on Friday. As a speedy organization of Congress seems to be a foregone conclusion the public may felicitate itself apen ‘the carly possession of the documents. THE CLERKSHIP OF THE HOUSE. It ig whdetstood that an effort will be made by the Now York delegation at the organization of Congress to divide the olerical honors and emoluments with Penn- sylvania, which has so fong exjoyed a monopoly of them. A struggle to depose Mr. McPherson from the clerkship of the House will undoubtedly be made. Several candidates for the clerkship are being talked over by members already here, and it would seem from their earnestness that Mr. McPherson has more to do than simply walk over the course. The name of Richard A. Sherman, of Oneida county, Yeas and Nays Clerk of the House, is mentioned in this connection, A QUIET WERK IN WASHINGTON. Raroly bas there beon a quieter week in Washington, preceding the opening of Congress, than this has been 80 far. But few Congressmen have made their appear- ‘ance, and the usual amount of loud talk and speculation im the hotel lobbies is wanting. None of the New York delegation have yet arrived. VISITORS TO THE WHITE NOUSE. A large number of visiters crowded the ante-chambers ef the White House to-day, among whom were many ‘prominent Senators and Congressmen. Generals Han- sock, Fullerton and Rousseau, Sonators Doolittle and Trumbull, aud Congrossmen Thaddeus wens and others were admitted to seo the President. \ Mrs. Colonel ‘Lee, of Philadelphia, whose husband is in prison, con- ‘vioted of fraudulent enlistments, was present, hoping to ‘obtain his pardon. © SATISFACTORY CONDITION OF AFFAINS IN LOU- ISIANA. , General Joseph 8. Fullerton returned to-day from New ‘Orleans to this city after an absonce of a little over six weeks, during’ which time he has been temporarily ‘acting as commissioner of freedmen for the State of Louisiana. His observations and experience while serv- ‘ing im this latter capacity have convinced General Fullor- ‘ton that no ablo-bodiod negroes in the above State need ‘guffer want if they will avail themso!ves of the demand for labor, which is represented to be largely im excess of the supply and the wages greater than any Western farmer could afford to pay the same hands, Tho planters in ali sections of tho State are anxious to produce heavy crops, gud are picking up all the iaborers available and willing, not only in Louisiana, but through agencies for that purpose in , Texas and Mississippi. All classes of citizens are suid to be anxious for an infusion of Northern capital, and the prejudice reported to oxist against the enjagement of Northern men in agricultural or mercantile pursuits in the State is grossly exaggerated, But a amall proportion of the planters are ablo to command much ready moncy, aud these are obliged to contract with the negroes for labor by allowing a certain number of shares in the crop produced. Such planters as have funds are those who deposited considerable sums in England at'the outbreak of the rebellion, and this class are offering Nberal wages to all the hands that offer themselves for employment. In the main, General Fullerton regards the aftuire of the ’ citizens and negroes throughout the whole State as emi- wently satsfactory and progressing towards complete harmony in all their relations. REPORT TO THE FREEDMEN'S BURFAU FROM TEXAS. ‘The Froedmen’s Bureau is in receipt to-day of a report from its commissioner in Texas, which—thongh a week or so older than the news in yesterday's Hunscp por steamor Wilmington, of anticipated negro disturbances in that quarter—says that the planters are feeling very much encouraged by the excellent prospect before then of heavy crops, and that the negroes are working with perfect harmony and with a noticeable increase of con- tentment and perseverance, ’ THRE NORTH CAROLINA FREEDMEN. ‘Tho surgeon having charge of the sanitary condition of the freedmen in Worth Carolina, under the ausp:ces of the Freedmen’s Bureau, has forwarded to that department & retrospective report of the condition of the blacks in that State during the last three years. In the large colo- nies yellow fever and smallpox have raged with great fa- tality from time to time. The mortality at Fort Ander- son, where is located one of tho largest freedmen colonies in North Carolina, is described as being un- precedented this spring, during the prevalence of the yellow fover epidemic, over two thousand deaths occur. ring in leas than two months. The condition of the freedimen is said to have constantly improved this fall, and the contagious diseases aro effectually checked. JRPY. DAVIS. It is now assorted that Jeff. THE OLD CAPITOL PRISONERS. ‘The highest number of prisoners in the Old Capitol Prison at any time during tho rebellion was one thousand *s aud four; but according to the official returns today there are only eleven confined there at this time, SELP-BTYLED PENSION AND CLAIM AGENTS. For several weeks back the Pension Bureau has received many lettors from parties throughout the country, who write to inquire into the standing of reputed “pension end claim agents.” The business ecard of the agent is gonerally enclosed, showing among his “references” the namos of two or threo gontiemen alleged to be in the Pension Burean, but who have no connection therewith, and are entirely unknown to ite officers. The latter are convinced that there are a large number of individuals in New England and tho Western States palming themselves off upon people entitled to pensions as licensed agents of the Bureau, who are em- ploying Gotitious narexs in support of thoir business eharacter, and who will be found entirely unreliable by any principal who may employ them. It should be borne in mind by the public that all ayents for peusions fare required to hold licenses from the Commissioner of + the Bureau. PERSONAL. Hon. N. H. Randall, of Kentucky, is at the National, Reworson Etheridge 1s stopping at the Metropolitan. WESIONATION OF GENERAL EWING. Brigadier General Charles Ewing, of the United States ‘Woluntoors, lately in command of @ brigade in Sher. man's army, has rosigned his commission in the volun- teor service, and. gone upon duty as Captain and brevet @olonet in the regular army. The Prisoners Before the Grand Jury and Their Removal to the County Jall—The Detectt om the Track of the Supposed Third Murderér—Pelli- cer’s Handwriting on the Wall of His Cell, d&e. The prisoners Jose Gonzales y Fernandez and Francisco Genex y Salvador, alias Pellicer, were arraigned yester- day morning before the Court of Oyer and Terminer, Judge Lott and Justices Hoyt and Vorhees presiding. Both prisoners pleaded ‘‘Not guilty’’ to the indictment for murder, which was handed to the Court by the Grand Jory. Gonzales wished to make a statement through the interproter, but was denied that privilege for the Present. On being asked if they had any counsel they answered in the negative. Gonzales said he had a friend in New York who he thought would procure him coun- sel, but he did not know where he lived at present. The Judge said he would assign them counsel, and also Sprolnt some day during the present term for their trial. ey were then’ taken to the jail, the officers in charge eluding the vast crowd outside the Court House by bi the into acarriage. Gonzales occupies cell 6, and on yesterday afternoon his face had Jost {ts sullen, deflant look, and an e: mn of despair was visible in his evil eye. When shown the peraph of his capture by Captain Waddy, which boen taken on Monday last, he caught It eagorly, and stood zing at it intently for some mo- ments. A half-smother imprecation escaped him at the sight, and ho exclaimed, as he turned away from ‘the door, “Dejd me morirl ‘me morir!” (Let me die! Tot me die!) If he entertains thoughts of suicide there is certainly nothing to hinder him from stepping out of ‘life before his trial, as his bande are free and he has a handkerchief, which, with one of the bars of the cell window, might serve the purpose of Jack Ketch. While in Captain Waddy’s custody there was not the slightest chance of his escape or suicide, as a patrol guarded the coll night and day. In the jail, however, if he pos- sesses the ingenuity of any of those prisoners who have frequently escaped from it, he may set himself at liberty in a very short time. The detectives aro on the track of the supposed third party in the murder, and from reliable information they have obtained a clue to his present asylum. Both of the prisoners insist In the strongest manner that there was a third party (a Frenchman) with them on the night of the murder, This man, a tall, robust young Frenchinan, bis fuce recently shaved of a heavy beard, called at the Bar- golona Hotel on the day after the murder and inquired for Mr. Otero. Tne bookkeeper suspected him and sent for a detective, but before the officer arrived the man was gone. There aro many other important links of evidence to implicate thix third party, but until he is arrested we ferbear publishing them. We are sorry to seo a feeling abroad among certain parties endeavoring to shield the prisofiers accused of this horrible crime from the hands of justice. It is but right and equitable, of course, that they should have a tair trial; but ex pressions of sympathy in their case are entireiy out of place, _On the wall of Pellicer's cell, in the Forty-fourth pro- cinct station house, the following was scratched, in bad Spanish, by tha prisoner:—* Francisco Genez y Salva- dor was born at Forge, in the province of Taragona, aged twenty-three years. Every young man that Jeaves his home to make his fortune and send it to his parents may meet with a villain who will lead him to death. 1 have been on the steamers Havana, Matanzas and the Atlas. I have been mthe Barcelona Hotel four days. I have been also at Franchaud’s, and: found a situation there, On Saturday I haa to go toa steamer which was to sail for Brazil, but I was not in time to make the voyage. Oh! would that I had found the situation sooner. Perhaps I should not have fallen in with such bad company. Oh! how unfortunate Tam, If Thad ngvor seen them no- thing of.this would have happened to me, [am sorry that the people who know me will say, ‘How wicked was Teodoro Martinez!’ From bad company, however, sometimes thete are better results than what people ima- gine, Take the advico which Teodare Martinez writes here. Alleged Conspiracy to Liberate Prisoners from the County Jail. THE PLOT FRUSTRATED AND THE CONSPIRATORS ARRESTED—DISCOVERY OF LETTERS, ETO. A conspiracy having for its aim the liberation of three prisoners from the New York county jail, in Ludlow #treet, was recontly discovered and the conspirators ar- rested. Tho names of the prisonera are Thomas Ed- wards, alias Jones, and Peter McDade. It appears that in Angust last John 8. Kelly, W. H. McCoun and William DeVere, alias “Michigan Bill,’’ wero arrested for pass- ing forged claims on United States paymasters, and sent to the county prison, where they are astillyconfined. Michigan Bill is a welt known desperate character who formerly escaped from his present place of confinoment, and was rearrested in Philadelphia. After returning to his cell Bill mado still anothor attempt to regain his 1ib- erty, but without success, Since Bill's imprisonment it has been the custom of the keepers to search him and his coil to go if he had any implements to ald him in another attempt to free himself, Mr. William I. Gard- ner, in searching Bill's room a day or two since, found balf a dozen letters, in wh'ch were mentioned a list of articles w the griter iptended to furnish to aid him in making ah mpt to eRcape. tools wore to have been sent in on Monday or Tuesday last. On Tuesday the prisoner Edwards ed at tho jail, and aa he acted in rathor a suspicious mannor he was searched, when, to the astonishment of all, a fine stecl saw, & small three cornered file, waxed ends and noodles and turead were found in his possession, all thero things having been called for in a letter written by MecCoun. In Bill's bed, which was searched, was found « broken saw. Edwards was prompt- ly arrested, and appeared much troubled ag to what would be done with him. In his haste to oxplain Edwards said he had been sent indy McDade, and intl- mated that he Pl was then at Kind’s Hotel, nearly opposite the prison. Mr, Gardner accordingly proceeded to the hotel, and finding McDade ‘arrested him. The prisoners were committed for oxamination before Justice Shandiey. The lotters were all written by McCoun, whowe cell was about thirty foot immediately above that cecupted by Michigan Bill. MeCoun lo letters to Bill by menus of a string, and when the missives wero Jet down Bill would thrust his band through the bars und pull them in. LETTER NO. I. * * © This is truly » struggle for liberty, in which should be combined a cannon's mouth courage, strongly tempered with great and sound judgment, prndence and cantion. It is utterly czeless in our cages to hope for anything but escape. Our only chance is a well conducted and matured plan for escape. I have, since this war began, been a prisoner of war four differ- ent ti and have as often made a daring and reckless escape, thing I know, and do agree upon—and that is, that that night watchman must be silenced in a short, sharp end decisive manner, That accomplished, and the reat is certain.
