SUPREME CouRT—orRcuIT, Betore Judge Mullen, Manca 28.—Mary Farid» ws, the Second Avenue Rei road Comprny.—This wag an action brought to recover $5,000 damages for injuries sustained while ridins on One of the Second Avenue Railroad cara The plaintiff, @ married woman, about 40 years old, testified that while getting out of eur No. 46 the vehicle stared suddealy, ‘and throw ber off the stop of the platform to the ground, fojuring herso severely that she was confined to the house for three months afterwards, Th plaintiff also testified that the'bandrail on the body of the car was absent, and Aliributed the aceident to this devect, On the cross-ex- @minetion che stated that she did not look to see whether there was a handrail there or not until after she felt her- welf faillog. ‘Thomas Briggs, a passenger on the car at the time of the accident, Teified thet the handrail was banging by a single screw, and that after Mrs. Texido was injured the conductor wreuched it off and placed it om» i sayi ‘as he did so, that it might lead to another accident if ‘was allowed to remain im that condition. The counsel for the defenoe mo\ed for a nonsuit on th ind that, ‘accordiug to the statement of the nt nuit self, she had not exeriged suiticient caution in stepping from the ar.
