McCready, the medical commissioner, dissented from tho verdict of ‘he jury, however, and certiled to the court ee! be.lef that Winter was a person o. unsourd mind. Among Winter's friends was a lawyer named Dan Birdsall, reetding at No. 224 Thirtieth ftreet, to whom ob the 23d of December, 1863, he executed a trust deed of ali his real estate during his life, avd upon hia death to apply the rents and profits of the estate to the eupport an? education of the Leirs at law—Mortimer and Henry W. Besides thie it is also claimed by Mr. Jobo Livingrton, father of the beirs, that the trustee is an irresponsible and insol- vent person, and wholly incompetent to execute the important tras. confided to his care. An aplication was made yesterday hetore Judge Leonard to rem ve Mr. Birdsall from the office of trustee, by ex-judge Edmonds and Joho Livingston, on the part of the children.
