Tn the caso of Charles Hurgitt, master of the steamship Labaan, in behalf.of himself, owners and craw, vs. the steam propeller Thomas A. Scott, her machinery, tackle, &e., Judge Shipman on Monday rendered the following OPINION, ‘This libel in rem. is filed to recover salvage against the steam propeller Thomas A. Scott, avd alleges that tho steamship Labuan, belonging to Hull, England, sailed from New York on the 25th of March, 1864, bound for Liverpool; that soon after leaving the former port she evcountered a series of beavy gales from the eastward, and after weathering them for fiftcen days, during which time sbe lost her boats, consumed nearly all hor coals avd had her poop house stove in, her master, deem- ing it imprudent if mot impossible to ‘continue her voyage across tbe ocean in the condition she. then was, determined to run back to the port of New York; that while she was so retgrning, aud at about) twelve o’clock M. on the 14th of April, when apuut cight miles to the eastward of lg light, those on board heard signal guns 01 distress, aud at about two o'clock made a vessel, and away for and found her to be the propeller Thomas A, Scott, bound from New Orleans to Now York: that a8 soon as the Labuan came within hailing distance of the Scott the master of tbe ial ter requested to bo takem in tow, that the Seott was then completely disabled by the loss of her rudaer and propel- ler, and ber provisions all consumed; that the Labuan thereupon took her in tow aod proceeded with her on the way to New York, towiog ber from three o’clock in the afternoon of April 14 tll about mine o'clock tne following morning, and toa point off the Woodlands, about four ratios below Sandy Hook, where a small steamtug came ide of the Labuan with orders {rom the master of the!
