That the Soott did not, after she was taken in tow by the tug, pass abead of the Labuan, and that the a reaghed the Battery at New York at about half-past one o'clock on the same day. the libel also alleges that the ‘Thomas A. Scott is of the value of two bundred thousand doliars, and prays for uo allowance of salvage to the Mbeliants to the amount o! twenty thousand doliats, The Attorney of the United States for the Southern district of New York has appeared on behalf of the government, filed a ciaim and interposed a plea to the jurisdiction of this Court. This plea alleges that the Thomas A. Scott is ‘a large stexmor belonging wholly to and in tho exclusive possession of the United States at tho time of her seiza: by the Marshal under the process im this sui that sbe is of the value of more than two bua dred thousand dollars, and that she was par- chased by the War Department through the bureau of the Quartermaster General, aod was paid for out of the appropriations for the support of the army of the United States. fhe plea further alleges thet, though sbe is not io commission the navy, yet thatehe be- longs to a large class of vessels owned, armed, supplied d manned by the United States, and under the direction and control of the Secretary of War, and employed by him for various purposes connected with the operations of the army; that some are employed for waritke purposes only, such as keeping rivers clear of enemies’ batteries and co-operating with towns; that otliers aro engaged in the transportation troops, commissary, quarterm«ster and ordnance lies; that they are armed for their own defence and for offensive operations against privateers and vesseis engaged in breaking the blockade of the Southern ports, that the Thomas A. Scott was, at the time she was fallen in with by the tibetlants, bound for. New from New Orleans, where the had been with & load of hot. shell and powder jor the supply of the army of the United States in that quarter; that she was armed with two thirty two pound brass guns aod one thirty pound Parrott gun; that she was in charge of civilians employed solely by the United States, and that her business since she has been ts E z 8 ? id forces in attecks on ‘ortified of SSRELTSEE ce Ha i £ ‘ i i Camp equipage and such liko materials of -} ine government, as might be shipped with other ores a meroly 3 5 2 & 3 z 5. 3 cage of the United States va. Whother this acquiescence bas ex- tonded to military stores in time of war, and designed for use iM active military operations, the Court has 00 means Of determining. Even ia the midst of his new subjecte Maximilian will find it difficult to make friends, not because the rooting Out of Old evils and abuses—many of them, identified with the character of the people, will be a tong, painful and even dangerous matter—but from the different and con. flicting elements of which the population of the couctry is made up. Here will be the great difficulty. The Mexi- cans of Furopean biood never harmonized with the abo- riginal oatives, who are five-sixths of the population. except when they wanted them to fight their battles for them. These peous, these five millions of freemen, the bulk of the Mexican natin, are a conquered race, and bave always been treated as such by the whites. Naturally indoient, they are ignorant. thriftiess and indifferent; while contact with their white couquerors and rulers bas not improved them: for, like all op. pressed people, they havelearned to be as cunning as they are faithless, I do not think the two races cau ever be mado to assimilate, either under a republican or im- perist form of goverument; for they are not sufficientty enlightened for the former, while under the latter there ‘atill fess cbance of that equality which is the periec- ion of social institutions. Let us sce, however, what the young Emperor will do; aud the experiment is really worth trying.
