Jan. 25.—The case of Emil Von Schoeuing against Solomon Kohnstamm, for the recovery of $2,573, created cdusiderabio interest. The plaintiff, on being put upon ‘the stand, tostified that he was the colonel of tho Fifty second regiment New York Volunteers; that while the regiment was being organized, in 1861, he advanced money to one August Meyer, for the purpose of lodging and feeding the troops; and that the latter, in paymoft of the debt, agsigued his claims against the government in fayor of the plainti®™. Dockstader, it appears, being thirsty, went into the drinking saloon of William Mitchell, in Prince sireet, and asked for a drink of water. The barkeeper handed Dockstador a glass, when the latter refused to drink out of it,on the ground that it was dirty, This irritated Mitcboll, and an altercation ensued in reference to theduties of landlords generally. In the course of the argument Mitchell lost his temper and called Dockstader a thief, and for applying this epithet he was suet for slander.
