Ocr. 26.—Stowvenel vs. Stephens.—The circumstances of this case are somewhat interesting and extraordinary. ‘The defendant is sued.as surety of one Brady on d lease. The case was referred and judgment obtained by the Plaintiffs for the sum of $3,321. ‘The cause now comes up op appeal by the defendant against the judgment. The plaintiff, on the other ‘ide, contended that hearsay evidence in euch a case was legitimate, that a foundation being Iaid by the mysterious disappearance of Stephens, it was the beet and only evidence that could be ob + and admissible by the wuthorities as analagous to cases of pedigree. Wepxrspar, Oct. 28—6 P. M. There is still a sufficiently active demand for money to keep the rate for call loans at seven per cent in the general market. At that figure, how- ever, there is no difficulty among the brokers in supplying themselves, on good collaterals, while the old houses, as usual, have deposits left with them by their castomers at even lower rates. The tendency of the gold market has been rather apward to-day; but at the advance the operations were small, showing that there is not much dispo- sition to operate for the rise. The opening price was 145)4, from which it advanced to 146%, fell back to 146, rose to 14734, and closed at 140%, Exchange participates in the dulness, and the business done has been «mall; but at the close there was a better fecling, and the quotation for bankers’ bills was 161 a 4. The outside demand fer stocks continues to de- ‘velop iteelf more openly, and the course of the market to-day is evidence of the extension of the speculative feeling which exists among the public. The confidence is so great in a higher range of figures, and the temptation so strong to buy be- fore the rise, that there arc few sellers except such as are content with quick realization of pro- fits. Any attempt to bear the market only serves to give evidence of ita strength; for, although Prie, New York Central and Southern old were again thie morning selected as pointa of attack, the | small decline was but temporary, while through- | out the remainder of the list the advance every marked. Harlem has been the most active stock, and its upward movement has been the great fea- ture of the day. There is no particular cause assigned for the rise, and the operators im it get leave to work it among themselves, At the first board this morning Quicksilver advanced 1, Hudson River 114, Harlem 4, Reading % Mi¢hi- gan Central 1%, Pittsburg 14, Toledo %, Rock Island 14, Prairie du Chien 2, Alton and Terre Haute }, do. preferred 1, and Northwestern %. At the one P. M. public board the active demand continued, and‘all the leading fancies were again higher, Harlem, after closing at 109 at the firat boerd, went up to 116. Pittsburg also advanced to 11424, Illinois Central to 127%, Toledo to 120%, Rock Island to 112, and Fort Wayne to 89%. At the second board the demand seemed to have sat- isfled itself for the time, and the extreme figures were not maintained. The market, however, was firm. At the four P.
