Under that idea the most abominable law in the world might be passed, and we would always be-compelled to live under it, for the reason that the legislative body that passed it, or any subsequent body, would not have the vight to repeal it. Whatever right the Harlem Company may have had granted to them in the charter, passed by the Legislature at Albany, the Common Council cannot take it away; but the Legis- lature has full power to repeal it, now that the Common Council have rescinded their action; nad we dare say that one of the first acts of the next Legislature, when it convenes at Albany, will be to repeal that clause of the Harlem Dompany’s charter under which the Common Douncil acted when they gave them the permis- sion to lay a track in Broadway. The only sourse left for tie Harlem Company, if they pave sustained any loss, is to come back upon the city for damages; the idea that they can ob- pain redress from individual members of the Yemmon Council is preposterous. But let them ome in with their claim for damages if they 4vish. From threats made in Wall street it looks ps though the heaviest claim will be the cost in securing the right to lay the track. Fortamss Monaom, June 25, 1863, ‘The United States gunboat Sumter, whose loss has beea briefly aoticed in the telegraphic despatches, was ordered on the special business in which she was engaged at the time of her loss on Sunday moraing, the 14th instant. Sbe was then lying at Yorktown, Va. In an nour after the receipt of his orders by telegraph, Captain Peter Hays was at sea, bent on @ close and scrutinizing watoh along the coast outside of Cape Henry. He bad been therefore but a week and a few days on this special duty when the unfortunate collision happened which resulted ia the de struction of theSumter. The loss of such an old, worth- less vessel would not be in itself a very serious loss to the Navy Department; but the accident which deprives the country at this time—when pirates are infesting our coast—of the services of Captain Hays and his officers must be deeply felt, and may be productive of evil on the quarter of the coast committed to their charge. ‘We have received the following particulars of the ca- tastrophe:— At twenty minutes to one o'clock on Wednesday morn- tng, the 24th inst., the officer on duty reported to Captain Hays alight ahead, which he supposed to bo thatofa steamer, and asked if he should run for her. The captain ordered him to run in the direction indicated , not too close, but merely sufficient to ascertain what the supposed vessel was. This was pent nis ie the officer ordering the whee! to port and having the bell rung for greater speed— the versel previously going close shut off. Buta few minutes elapsed when the cap letermined to leak after the matter himself, and he wos just turning out when be. heard the bell stop, snd the next instant he was thrown from his berth on to the floor. He then ran upon deck and saw the vessel with which bis own bad just collided. By this time the two vessels were somewhat apart, the strauger baving dropped off on bor quarter. The captain at once bailed the stranger, demanding Ler Dame. This waa not answered, but, in retura. the captain from the other veesel ingutred, * What steamer is that’ ‘The United states steamer Sumter,” was the response.
