Judge Shipman. cx. 28.—The United States vs. Albert Horn.—The triay Of @hie case bas engaged this court for several days. The @cfendant is indicted for having, as owner, factor or agent, fitted out or cout away from thie port a eteame! called the “City of Norfolk,” with tho intent to employ and finally, on the 6th of June, 1860, frem that port to St Thomas. There she received on board various arti. Bareeloua, where she filled ber casks with water, and from Baroelona to the Coast of Africa, where she took om board about eight hundred negroos, which sbe carried to Cuba. On ber arrival off that island she was detected by @ Spanish cruiser, but managed to land some of tho slaves. The others were captured with the veesel, whieb was abandoved, and which sines doen used by the Spanish government as @ transport ship. Much proof was given, tending to show that the fi paring and provisioning the vessel bere iudicated the in- teat to use her aa a slaver. It appeared, too, that she ‘was suspected by our authorities; but, after examination, “ee leave port, defence was that Mr. Hern did not intend to em- the steamer in the slave trade. It was claimed that) Ppurchagea her to be sold.either to the Venezuelan gov- eroment 0 carry troops, or to one Gurvello, of the Cauary islands, to be used, under’.the authority of gover in cgnveyiug colonists irom Africa video, Mr. Horn, in the year 1859, bad 2 small steamer, under the command of Captain Norton, carr: Venesuo- Jan pokdiers, and application: had been made to him to ob- tain a larger vessel, of which fact he advised the dofend- apt. It appoared that in Febrnary, 1860, one Frapcisoo Mandiiio came to New York, where he was afterwards jomed by Curvello, Mandille was a seafaring man. He ‘and Curvoito directed the fitting up of the vessel, &c. A copditional saleof her uae made by defendant ‘te Cur- velio for $50,000 on which $34,000 was paid. When «he saited for St. Thomas sbe bad ou beard Curvello, Mandillo, Captain Tilton, one Crawford, as frat mate; Beaufort, ae second mate; a Spanish apd steward, and a crew, of | which ser were Spaniards. The captain received here a pewer of attorney to sell the ship to Venezuela, nuless Curvello completed the purchase ‘atSt, Thomas, When she arrived there Curvelio was ill, and the captain did not call to gee him, Mandillo di- rocted—acting, as he alleged, for Curvollo and himseh— that the title (9 the vessel should be vested in Crawlord, the firat mate, which was done, and Crawford gavo a mortgage the vesse! for $60,0000, a6 collateral security for the payment of the balance which Curvelio had agreed to pay-—say $16,000. Captain Tilton left the ship at St. Thomas, ag Curvelle did not go on the voyage to Arica.
