On the 16th of January last Judge Mo>Allister, of the United States Circuit Court in California, read his decision in reference to the celebrated New Almaden mine case, which has excited so much attention there and hore, Judge Hoffman, of the United States District Court, dell ered his decision next day. The Judges liad expended eat deal of time and laborious work in this case, which been one of the most closely contested in the annals of American jurisprudence. The following is a synopsia of the facte:— The claim consists of threo queetions : — 1. Mine of Santa Clara. 2 Amining eesion of 3,009 yaras in all directions from the mouth of the mine—that is, 6,000 varas square, 3. A colonization grant of two leagues squire. Tho attorney for the United States has argued that they wore forged. are two classes of title papers; the first, thoee re- lating to the denouncoment and mining posseasions mado at San Jose, and, secondly, the two ue grant made in tho city of Mexico. The main wit- nesses, A. M. l’ico, Jose Noriega and Antonio Sunol, are not contradicted or impeache; they haye even been called, and thus endorsed, by tho United States. The wit- nesses and documents are corroborated aad supported in many points by other wtincases, by — judicial records and official correspondence ‘of ‘the time, preserved in the Mexican archives in the oilice the United States Surveyor General of Call fornia, The title papers made ia the city of Mexico , in- eluding the two league grant signed by Castillo Lanzas, as Prime Minister, in May, 1546, are also held to be geauine. ‘The letters which passed between Alexander Forbos and James Alexander Forbes in 1847, 1848 and 1849, aud were produced by the latter to prove (ke forgery of the title, contain no ovidence of such forgery, save one letteor, dated March 28, 1848, and that iotter {s itself hetd by the Court to be aforgery. This Saped ates purports to have been written by A. Forbes to J. A® Forbos, aad coufesses that all the title papers issued previous to ita dato were fraudviont. The letter is without corroboration; it doos not agree with others of the series; it is produced under mavy suspicious circumstance; the original is not shown bat only a copy: J. A. Vorbes protends. that the orizinal was stolen from his room; his charactor is-mder suspi cion because the letters produced by himsolf prove that for a long time he urged his org to forge a title; he was paid a large sum for his testimony; he had pre- viously quarrelied with the claimants of tho mine; he has beon declared to be unworthy of credence even when under oath, by nino or ton of bis nei respectable citizens of Santa Clara: and the only witnees, besides Forbes, to the existence of the original of the letter of March 28, 1848, is Kobert Birnie, who is declared Eerenthy of ctedanee under oath by halt a dozen of his neighbors, prominent citizens of Contra Costa county, where he has made his home. On the other hand, the evidence to show the genuineness of these title papers 18 most abundant and ‘conclustye, in- cluding official documents tn the archives of California, papers on iile in all the departments of government in the city of Mexico, and the testimony of a number of wit- nesses, many of them men of high position, and all of them \nimpeached. in discussing the facts of the case, Judge McAllistor adopted in many instances the ideas used by the attorneys for the claimants in their argu- ment of the case. Judge McAllister Mnally proceeded to cousider the legal torce of the title papers. The wo oague grant, while genuine, is a more order to the Governor of California to put Castillero in possession of two leagues, and as it was never delivered, it lacked legal completeness, and never conveyed a title which the Court should coniirm. While the Alealde had power to grant mining possessions, le had no power to grant | & tract so large as that covered by this mining grant— namely, 3,000 varas square; but the grant may be con sidered good for as much as he had aright to give, and discovery alone gave such an oquity under the Moxican mining laws asthe Courts ought to respect. The utmost amount to which Custillero was entitled, under Moxi can mining law, ia seven pertenencias, ahd his claim will be confirmed to thatexteat. A pervenencia is two hua- dred yaras square, about seven acres, aud seven perle- nencias will include fifty acres. That ts onough to take ia the whole ioine, but is much leas than the two league claim, which covered $,877 acres, and the 3,000 vara rant, which covered several thousand acres, Jude Me.\liister skipped a large portion of his opinion, but the portion which he read occupied bim from cleven A.M, to four’. M. The opinion covers sevoral hundred pages. JUDGE. HOFFMAN ON THE TWO-LEAGUE GRANT. The following ia an oxtract from that part of Judgo Tioffman’s opinion relating to tho two-league grant, which was a =tmple order from tho Mextoan Minister of Faign ond Interior Relations, directing the Governor of California to put Andros Castillero ia possession of two leagues of land, including the New Aimadea mine, Inthe case of Andres Custillero vs. the United Statos, for the island of Suita Croz, (23 Howard, 464,) the claimant relied on a despatch of the Minister of the In- terior, in many respects resembling that of Castilla Lan- vas. In thatdeapnich the Minister informs the Gove: nor that, in consideration of the services and merits of - tillero, the Progident directs him (the Minister) “to re- commend Castiliero very eficaciously to your Lxcullen- cy and the Departmental Junte, in ordor that before pro ceeding to the distribution which should be made con- formably to the laws, and, as is directed in the order of this date, of the lands of the islnds adjacent to that penineula, there be assigned te that individual the one ‘which he may sclect of those nearest to the place where he should reside with the troops under hia orders. It will be noticed that the terms of this despatch aro not in some respects so strong as those of the despatch of Lanzas. Tt is not eaid that the President bas acceded to a petition for any particular island or tract of land. Castillero is merely “‘recommented very officaciousiy to the Governor apd the Departmenta! Junta,’ and this ro- commendation is made in order that there may be ‘‘as- signed’’ to him the tsland he may select, &c., contoem- plating evidently the execution and delivery, by the Go- vernor, of the formal title for the idand #0 selected. In the Lanzas despatch the President's assent to the petition is communicated to the Governor, “in ordor that he may put Castillero in possession of the land,’ an expression which has afforded room for the construction that 20 further title paper was to be issued. In the Santa Cruz Island case the Supreme Court held that “the despatch of the governme: utleate the title.” The language is:—‘They (Governor and the Junta) were ac- cordingly dirceted not to proceed to make adjudications under the previous order until the assignment of the title to this claimant woe perfected: but they were uot Tequired to make the assignment, or cause it to be made, To accomplish that Lars) and to carty into eitvet the command of the President, two things only were neceseary to be done—one was’ to be performed by the claimant, and the other was # ministerial act. It ‘was the claimant who was to make the selection; and if it was @ one, bear the place where he wag sta tioned with his troops, nothing remained but to make the oo as described im the despatch. Emanating, as the despatch did, from the supreme power of tho nation, it operated of itself to ndjndicate the title of the claimant) leaving no discretion to be exercised by the authoritios of the Depertment. Neither the Governor nor the As- sembly, nor both combined, could withhold tho grant, after a proper selection, without disobeying the oxpress command of the suprem> ment. Nothing, there- fore, remained to be doue but to issue tho title papers, and that was ae duty of the Governor, as the executive organ the Department.” This language would scom too clear for misconstruction. It seems to me an express decision that an order of the supreme government, directing the Governor of a department to make a grant, operates to adjndicate the title to the land speciticd. it could not be meant, howover, tbat the order liself war an abolnte grant, for it is evident that the for- mal it was to be male by tho Governor; and besidos it did not refer to any particular island, but to such island as Castifiero might felect; and it was only after the so leetion was made and found to be a proper one, that the title attached to any particular piece of land. If such was the effect of the order of Poswta, I am unablefto perecive why the Castilia-Lanzas dispatch must not bo considered to have had alike operation. The direction in that despatch to the Governor, to put Castilloro in poreession in conformity with tho laws and dispositions on colonization, confided no more dircetion to him than the doty of secing that the island selected was a proper ‘one, condded to tho Governor in_ the case before the Su. preme Court, anc if the isauing of the title ae in that case was ‘a’ mercly ministerial act,’ to be done in re spect to lands, the titile of which lind already beon ad judicated to the claimant, the game view must be taken of the UUle paper which, construing the Langas deepetch least favorably to. the claimants, Goveruor Pico was or- dered to iseue. It is contended that the Preetient of Mexico led no authority to make the order for a grant coutainod in the Lanzaa despatelt. But it is apparent, both from the ection of the supreme government fa this case, as well as in that of the island on the const, that it exercised the powor. The preanmption, therofore, ariecs (that it had the authority it oxoroised. “The pablic acta of — officers, purporting to bo exer cixed in an official capacity, and by public authority, are not to be presumed to be «usurped, but @ legitiinate authority, previously given, or subsequently ratilicd, which ix equivalent.’”.. (United States vs. Arredendo, 6 Vetere, 728.) The Colonization Law of 1824, while it en joined — the Statcs of the confederation the duty of making lawe or regalations for colonizing within thoir respective limits, committed the whole subject of colonization in tho Territories to the Supreme ns ‘ive. But no such pessession was tikon in thia case, mor was the concession recoived in Uslifor- nis, or even known to have been made, until after the subversion of Mexican authority. If, thew, anteccdent considerations of this nature are to be looked to in determining whetier tho former goverpment was under any equitabio obligation to perfect the title of the claimant, itis, perhaps, not eur imagine a case whore tho meritsof the pecitioner, and the considerations rondered by him for # small grant of land tn a remoto department, could bo greater ie immense valuo of the discovery he had mude to the great minivg interests of Mexico need not be dwelt avon. Our own exporience in California cables us at once to ap- preciate how indispensable {3 an amp'o and cheap supply of quicksilver to the developo- ment of mines of the precious metals, But to Moxico tho diecovery was, a8 justly observed by oue of the counse! for tho claimants, “the unsealing of a hidden fountain of weal b, a8 precions to her as tho raing and dows and living streams aro to the nations that live by tillage.” For years it had been tho policy of Mexico to stimulate explorations for, and to encourage the working of quicksilver mines. By'tho laws ot Fob. 20, Oct. 7, 1823, which imposed duties on gold an or, quicksilver waa expressly exemptes from contribution: In 1842 the Junta do Fomeuto was ostablished, and em- powered “to fix the mode in which the working of qnick- silver mines was to bo supplied, rewarded, atimutated and protected.” By tho decree of May 24, 184i, rewards of $2,000 and of $5 per quintat (100 Iba.) were promised to successful miners; and by the decreos of July § and Sept. 26 of the samo year, the Junta was empowered to work, to supply and to protect quicksilver mines, and to cause rescarches for them to bo made throughout the republic. When, therefore, Castillero announced tho discovery of a mine surpassing in richness that of Al- maden, in Spain, upon which Mexico had 49 long boon dependent, and desired a grant of two leagues in a department where land was commonly distr buted gratuitonsly in tracts five times as large, ho had equi- table claima upon the goverament far surpassing “the public and patriotic services” of Alvarato, which the Supreme Court declared to have been an equitable con- sideration, as strong “as if the grant had been purchased with money.” Compared with the service rendered and about to be rendered to the Moxican nation by Castillero, the consideration on which the ordinary colonization grants were founded was insigcificant; for that conside- ration merely consisted ia building a Rouse, cultivatin, few acres of an immense tract, aud suffering wild cattle to roam at will ovor the remainder, Tho fact that he was working the mine showed that Castilloro had already effected a setttoment upon the Iand, and ita further de- yelopement insured nn accession to'the population of the country far greater than ¢ wld have been obtained by any other dreposition of the public land. Tho purpose for which he bought the land apprised the government that it was of a kind usually fit for cultivation—as it was required to furnish wood for his burninge. In thus as- sisting his enterprise the nation had as great an interest as Castillero himeelf, for it was the attainment of an ob- ject to which their attention, their efforts and no tocon- siderable portion of their reventes had long been dovoted, It has appeared to me thet ail these circumstances constitute an equitable consideration of the inchoate title or concession obtained by Castillero; and that they were insufficient to create au equitable obligation on the former government, and therefore on this, to complete and make good tho Inceptive rights he had noquired. The following is the conclusion of Judge Holtman’s opinion:— 7iCOm the whole caso m opinion fe, that the clatmants are entitiod to seven pertenencias, to'be measured in tho manner, of the form, and of the dimensions presentod in the Ordinanzas de Mlneria of 178%. And also, that thoy are entitled to two square leagues of land, to be located ‘on tho land of their mining possession, but in such a way as not to include any land granted in private ownership, by competent authority, previous to May 23, 1846." THE DECRER IN THE CASK. Judges McAllister and Hoffman have sigacd and ontered the following decree in this case — This cause came on to be heard on appeal from the final decision of tho Board of Commissioners, to_ascer- tain and settle private land claims in tho State of Califor nia, under the act of Congress, approved March 8, 1851 upon the transcript of the proceedings and decision of said Board, and the papers and evidence on which the said decision was founded and upon the papers and_evi- dence filed in this court; and it apponring to the Court that the said transeript was daly filed according to law, and counsel for the reapective parties having been heard, and due deliberation had in the promises, it is by the Court hereby ordered, adjuged and decreed, that the said decision be and the samo is reversed and set aside; and it is likewise ordered, adjudged and decroad, that the claim and title of the petitioner, Andres Caetillero, to the mine kuown by the namo of New Almaden, in Santa Clara county, Northern district of tho State of California, is good aul valid claim and title, and that the said Andros Castillero and his aeeigns are 'the owners thereof, and of all the orcs and minerals of whatever description therein, in feo simple; und it is further adjudged and decroed that the said mine is a piece of land embracing a superti- clal area measured on 2 horizontal plane, equivalent to seven pertenencing, each pertenencia being a solid of a rectangular base two hundrod Castilian varas long, of the width established by tho Ordenansas de Mi of 1783, and in depth extending from and including the sur- face down to the contre of the earth, Said perienenciaa to be located in such a manner as tho eald Andres Castillero or his assigns may select, subject to the following condi- tlons:—First, that the enid pertenencias shall be conti- gnons, that 1% to say, In ono body, and, secondly, that within them shall be inciuded the original mouth of the said. mine, known as New Almarien. And it is furthor ordered, aijudged and decreed, ag to all other rights, property and intereats set out and claimed in the petition flied tn this case, that the same are not valid, and are, therefore, rejected. th o APPEAL TOR NEW ALMADEN.
