A regular meeting of the Board of Aldermen was beld ‘Mest evening, President Peck in the chair. A resolution was offered rescinding the resolution ‘adopted in the year 1854 assigning rooms in the new City ‘Hai for the use of the Sapreme Court. It was adopted. ‘THE CITY CHAMBERLAIN. ‘The following communication was received from the Mayor's Orrice, New York, Dec. 31, 1860. ‘Bo THE Fononanie THe Common Councit:— Gexriemen—By virtue of feb Tha vested in the Mayor, tw section 21 of the charter of #867, I have suspended Daniel Devin, who assumes to be City "Chamberlain. The rea- sons which have ys this step are predicated upon ‘Whe extraordinary and unprecedented mode of his ap- oa use sont as | think, grave doubts as to its ity. Whilst temporarily ‘absent from tho city, Alder- man Peck, President ef the Board of Aldermen, who, in of the 17th section of the charter of 1857, be- came the acting Mayor, arrogated the power to remove 2° Platt, Bsq., the City Chamberlain, an unexceptiona public’ officer, who bad faithfull Performed his his @aties, and to nominate Daniel Dev! a in his place. le my opinion the law does not contemplate the exercise of any such right by the President of ot the Board of Alder- men. To admit that the President of fe Board of Alder- men is clothed with every prerogative of the Mayor in ‘tbe absence of the latter, necessarily implies that if the r is absent from his office at all, even for five winutes, an Alderman can take advantage of this absence to derange tbe ee of ban government and sub- vert the policy WI ized. In the present instance the sssumption of authority by ‘Mr. Peck is exceedingly unjustifiable if legs Before leaving the city be waited upon me for instructions with reference to his duties during my absence, and pledged bimeeif not to approve certain measures (the Japanese sppropriation among others), and not to interfere with ‘any of the public offices within the power of the Mayor to remove or appoint. Admitting that the acting Mayor is clothed with the authority claimed under the charter of 3057, there are doubts as to the right of the isla ‘ture to confer such powers upon the President of the Beard of Aldermen. The people elect the Mayor as ebief executive officer, entrusted with the administration ef the laws. It could not have been intended thata member of the legislative department should exercise executive functions. To remove the City Chamberlain, who is an executive officer of the highest rank, was an @mecutive act. The sixteenth section of the charter of er vides that ‘the executive power of the 1 be vested inthe Mayor and the executive de- parame ”’ An Alderman is a legislative officer, and ot legally remove or te ge 4 executive officers. Ami, by section thirty-nine of the charter, it is pro- that every person elected or appeinted to any of- flee under the city government, shall on or before the first day of January next succeeding such election, or ‘within five days after notice of such appointment, take and subscribe an oath or affirmation, faithfully to per- form the duties of his office, which oath or affirmation shall be filed in the Mayor's office. Mr. Devlin has not complied with this requirement of ‘the law, and has not filed any cath of office in the May- er’s office, and hence has not legally and properly quali- fed himself for the office of Cuambe berlain. For these reasons, and for others not necessary at this ‘time to communicate, 1 have suspended Daniel Devlin from tbe office of City Chamberlain which he assumes to FERNANDO WOOD, Mayor. Alderman Core. offered a resolution to the effect that, in the opinion of this Board, the reasons assigned by the Mayor for the suspension of the City Chamberlain =a insufficient, and that the communication be re Gereas ont ti the Mayor had mad appear ‘ENET e le it he did not wish to have Mr. Platt removed; whereas, if be told the truth, he would say that he bad, for months gS. had it in contemplation to remove Mr. Platt, and been working among the members of the Board with ‘that object. Aklerman Prcx said he regretted to have to ssy it, but dhe must say it, that the communication received from the was conceived in falsehood. When his Honor left ‘his city he said that there were two he did not ‘wish to have interfered with—the Street Commissioner- ship and certain resolutions likely to pass the Board of Su- pervisors. In regard to the removal of Mr. Platt he (Mr. ) never contemplated such a thing until he was wait- ed Cae m by number of respectable citizens and by a ma- Board of Alderman, who demanded that Mr. t chou be removed. He denied that he had ever made such a promise to the Mayor as had been stated by ‘that gentieman. Alderman Brapy said the Mayor had made it that he did not intend to approve of the sppropriation for the Japanese reception, whereas he (Alderman Brady) ‘well knew that he had intended to countersign the reso- Jution. As for the removal of Mr. Piatt, that had also been contemplated by the Mayor, but he now wished to ‘throw the onus of both these acts on the acting Mayor. Alderman Boos offered a resolution as a substitute for Alderman Cornell's, but the same in effect. Liessegang, from Ma- tanzas and Norfolk, in thirty-five hours from the latter port, arrived at this port last night, with passengers, cargo and correspondence to Messrs. Mora Bros., Navarro &Co. She left Matanzas on the 22d ult., and expe- rienced heavy northerly gales, obliging her to put into Norfolk for coal. MAREETS, Dec. 22.—Clayed Sugars.—The market ve for this quality, owing to the unfavora- m the United States, the great scarcity of money and the embarrassment in the commercial commu- nity. Holders of the balance of old crop sugars intend shipping them for their own account to Europe. The Christmas holidays will cause all business to be stopped for at least a fortnight. Muscovados—The few small parcels of old crop have been shipped for Europe for janters’ account. Of the new crop some 200 ihds. have come to market; as yet no sales made, there being no duyers. The quota- tions ‘below show more or less the figures holders expect to obtain, but which buyers will not submit to:— Inferior, common and fair refining, 7)¢r. a 83gr.; do. gro- cery goods, 84r. a9 5-Tr. MATANZA8, TELEGRAPHIC, NEw ORLEANS, Dec. 31, 1860. ‘The steamer De Soto, from Havana on tho 27th inst., has arrived. ‘The monetary crisis had reached Havana, where it was severely felt. An issue of two million of dollars in trea- sury notes was about to be consummated for the relief of the commercial community. Eight hundred thousand dollars worth of the new bonds had been already issued, which merchants at Matanzas had agreed to receive. A New Commercial Treaty with Ven: zuela, ‘Wasmrvaton, Dec. 31, 1860. Itis understood that the President will eubmit to the Senate ina few days an important commercial treaty, recently negociated by our Minister to Venezuela. Destructive Conflagration at Milwaukee. GREAT LOSS OF PROPERTY—FIVE PERSONS PROBA- BLY BURNED IN THE FLAMES. Miwavkes, Dec. 31, 1860. On Saturday night a fire broke out in the Lake Michi- gan mills, owned by Nichols, Brett & Co., and the builling and contents, consisting of 500 barrels of flour and 7,000 bushels of wheat, were destroyed. Loss $35,000; in- sured $20,000. ‘The flames communicated to tho warehouse occupied by Collins & Andre, destroying the building, valued at $15,000; insurance not ascertaine At two o'clock on Say” moran another fire broke ont in the building on thecorner of Huron and East Water streets, occupied by the city offices. Loss on the building $50,000; insured. George Deyer & Co.'s saddiery and harness establishment was also consumed. Loss $40,000; insured for $30,000. All the records and valuable documents deposited in the City Clerk's office were destroyed. We are unable to ascertain the loss to the city until the safes which contain $200,000 worth of chatte] mortgages are taken from the ruins. It bas been ascertained that the $200,000 worth of bonds and mortgages were not kept in the sate, and are, consequently, destroyed. Five persons are missing, and it is feared they are buried in the ruins. Exertions are being made to find the bodies, but the heat is so great that not much pro- press is made.
