Application of the Commissioners of Re- cords for a» Mandamus against the Board of Supervisors. SUPREME COURT—SPECIAL TERM, Before Hon. Judge Sutherland, Avoust 16.—The People at the relation of W.C. Wet- more and others vs. the Bow @ of Supervisors.—This was an spplication for a peremptory mandamus to compel the reepou tenis to raise the sum of $30,000 to defray the ex- peuses alleged to have been incurred by the Commission- ere of Record. Mr. Brady, associated with ex-Judge EA. maouds and Mr. Fullerton, for tne relators, read the aill- davis 0: Mr. Nathan, one of the Commissioners, showing generally tha: they haa incurred ex; to the amount ‘of upwards of $72,000, ana that they had dematded that the Supervitors should raise a sum not exceeding $80,000 x ne ibe same, the ication being Tax uct of i300, which requires the Spee to raise such sum, mot exceeding ,000 as may be found due to the contracters with the Commissioners, and that the Sapervisors bad refused to make apy appropriation therefor. Mr. A. R. sr pve dr., on pA part of the respondents, read affidavits show- ig’ that tle matter had been referred to the appropriate ‘eowmiiice of the Supervisors, Who bad not yet reported thereon.
