In the Supreme Court of Pennsylvania, in the case of Hamilton against the city of Pittsbarg, on two bonds issued by the Chartiers Valley Railroad, and guaranteed by the city, a decision was ren- dered, concluding as follows:— ‘That the defendants and their succospors in office be, and they are hereby, commanded forthw¥h to make full and ample provision for the payment of all the interest now due upon the bonds issued by the Mayor, Aldermen and citizens of Pittsburg, in payment of their subscriptions of $150,000 to the capital of the Chartiers Valley Rail- road Company, according to the tenor of said bonds, by tho as ut and coljection of such taxes as may be vecee:afy for the purpose. And it is further ordered that the defendants pay the costs of this suit. In the course of his opinion Judge Strong re marked that while the impolicy of manicipal sub- scription to stock in railroad companies must be admitted, the constitutionality of laws authorizing them has been sustained not only in Pennsylvania, but in sister States, by a weight and‘aniformity of judicial decisions such as very few other constivu- tienal views have been able te bring to their apport.
