it Birne ng Bap i received money for services render- ed by him m ; be offered to show his conduct since he bax beeu on rae police, and bis antecedents, ticularly a traneaction im Boston, which would ‘show him te be entirely unworthy of credit. The Commissioner decmed it unnecessary in this investi- | onl and therefore the case was declared closed, Mr. en stating that be would submit i to the Bourd of Commissioners. In the course fl the examination Mr. Birney stated that he had subpenaed officer Hilliard, of the Mayor's squad, to attend in Pils case, but he had refused to attend, Mr. Biiliard yesterday made affidavit that he was not sub- |, and the statement of Mr, Birney was untrue in every particular, COMPLAINT AGAINST POLICEMEN FOR EX- TORTING MONEY. @omplaint was yesterday lodged against officers Daniel H. Rackett and Nathaniel R. Mills, of the Twenty-sixth precinct (City Hall squad), for extorting money under the following circumstances:— Noble Jennings, a resident of Hydeville, Vermont, de- poses that on the evening of March 8, about half past even o’clock, himself and his friend, Wm. D. Crofoot, of the same place, purchased two tickets to enter athe circus at Niblo’s Garden. Deponent presented a twenty dollar bill ef Glenn Falls Bank, State of New York, and received the ebange for the same, and two tickets; ho and his friend then went into the theatre and took their seats. In about ten minutes after the person of whom deponent Dought the tickets came and requested deponent to give him another bili, cig Ne one that deponent had given him was an altered bill. Deponent gave him back the @bange that he bad received, er) likewise paid him for ‘the tickets; soon after two police officers came and took im out (hie friend following him) into a drinking saloon, and searched bim and his friead, and took all the money they could fud—in all about 3381: the officers eaid it was all ‘couaterfeit, aud not worth four dollars. Deponent wert to take bis money from the table where it was lying; the officers would not let him take It, and re. ee that they would have to take it to the station and it might be detained three or four weeks, or two or three days—they could not tell which; deponent told them he had cometo the city on business, and would goover sacrifice most anything than be detained; the efficers then conferred together for awhile, when Wepo- nent told them he was willing to do what was right, and would like to send for bie friends. The officers gaid that would be of no use, when one of the officers (Abram Racket, of the Twenty sixth precinct) counted out $100 and said, “if you will give us this and gay nothing about i we will let you go.” Deponent sald ne jas willing to sacrifice anything rather than be detained, if it was all right, as he did not know anything abou! the laws here. Rackett then told him to take the rest of the money and put it into bis pocket, and “let us pass rigbt out. and take something to drink and keep all atiil.” When de- ponent got into the street Racket told him to pass right along Lome about his business, and ifne (Ra ) shauld veo him (deponent) up that way to-morrow a next @uy he (Rackett) would take care of him (deponent.) Wm. D. Crofoot, the friend siluded to, corroborates the above, and says that there were no persons present when ‘the money was taken but himself, Mr. Jennings, and the two policemen, The examination before the Police Commissioners is set down for March 8, RICK YARD FOR SALE-SITUATED 2% MILES hove Cold Spring, on the Hudaon river, eoniaining 74 nd, with two ‘aroular pita Ia two houses, Qeobarne one blacksmith shop wud dosie. ail in good ord ; and ean be worked at iritling expease.
