(From the Kansas City Journal of Commerce, Nov. 16.) Mr. S. S. Smith, who went out from this city’ on the first day of October last, for the Pike's Peak gold mines, re. turned op Sunday, being forty-four days making the trip. He left the mines on Cherry creek on the 30th of Octo ber. Mr. Smith is well known to many of our citizens. Nov, 24.—M. Price Moore vs. Alfred 8. Lavingston and Wfe.—The extraordinary character of this famous case attracted a large assemblage in Court to-day to hear the final argument of the counsel. All the parties were in Court, looking comfident of success, and apparently none the worse from their long litigations. It will be remembered that nearly two years ago Livingston had Dr. Moore indicted on a charge of conspiracy to kill him, through the agency of some negroes, a pretty little girl, and Moore's own brother. Mr, Moore was acquitted, after a very interesting trial, which lasted five days, the theory of the defence being that Livingston was trying to get Moore into prison, 80 that he could not prosecute a civil | suit then pending, in which he charged Livingston with | defrauding him out of a large amount of real estate The cause came to trial in March, 1857, before Justice Roosevelt, and resulted in a decree in favor of the plain- uit; the defendant being ordered to execute and deliver to Moore a deed of the property. The appeal is from that decree, and the result, ax stated by the counsel, is to both partics a matter of life and reputation; to Moore for the means of living—Livingston to defend himself and wife trom the charge of fraud and treachery. The printed case makes a book of one hundred and forty nine pages, presenting a most extraordinary history of secret and Confidential transactions of many years standing, which naturally, one would suppcse, would have been forgotten long since by witnesses who ‘strangely enough have sur- vived and remember al! about matters in which they were not interested in the smallest degree. The leading facts are, briefly, that in 1844 Dr. Moore made a deed of his property, a8 he says, in confidence and trust, for his owa benefit. That in 1846 it was re-conveved to bim, and some time afterwards he loaned the deed to Livingston, who never gawe it back to him; and failing to recover itin 1852 Moore brought this it. On the other hand, Linea says{ that the sale in 1844 was bona fide, and that Paid Moore $106 50 for it; that Moore, having spent the money, pretends it was a trust, and, as the pro- perty has greatly improved, is now trying to get it back. Of course, the evidence is full of flat contradictions, and an amount of perjuries that may be hereafter important references to the code reformers. The cause was not tried till five years after its commencement, during which time it — through the hands of many eminent lawyers. ‘ument was concluded. PERSON. AL.
