Some two centuries ago, a nobleman of the name of Count Clementini, estate and title to the Piccolomini family , under the law of fidet-dommisso, left his he elteat son of the Sienna branch of vith the condition that the title and estate — continue to descend to the eldest son in direct fi family ibe © estate and titlo havo remained in the , and the present Count Cl ntini is the senior brother of "the father of the Signorina Piccolomini, now performing at the Academy of Music. The estate is extensive aml the income considerable. ‘The mt Count being without issue, the estate and Utle will descend at his deuth to the father of the prima donna, and after him to her brother, a young lad, now here. ‘Theso circumstauces inay explain the confusion that seems to have arisen between the names of Piccolomini and Clementini. The family consists of Mademoiselle Piccolomini, her | any actor or manager who represents a copyrighted play father and mother, the Count aud Countess Carlo Picco- Jomini a younger sister and an only brother—a young lad of fourtee—all of whom accompany her everywhere in her travels, a she never cousents lo any engagement with- out previousty making a stipulation to this eflect. During tho Isat summer an American gentleman undor- took to sell for Mr, Taylor the sole right to play the piece, and it was offered to Mr. Wallack for the sum of $2,500, and declined. It was subsequently sold to Miss aura Keene for $1,000, and has been aeted at her theatre for the past five weeks to large audicnees, In the mean tme Mrs. Silsbee has sold her copy of “Our American Cousin” to the manager of the Arch street theatre, at Philadelphia, Mr. W. Wheat- ley, where it is shortly to be produced. Miss Keene, claiming a proprietary right, bas entered the play for copyright, and intends to commence a suit for damages against Mr. Wheatley. The law provides that case shall be muleted in a penalty of $100 for the first and $60 for each ‘subsequen® representation. It will be for the Court to decide whether Mr. Taylor, an Englishman who has never been in this country, had any rights here under the law, which is simply an extension of the act of 1818, and intended prima facie for the benefit of resident authors, The piece has not yet been printed, a fact which: makes the matter still more complicated. It will .be ne- cessury for Miss Keene to prove that she bas complied with ail the requirements of the law in the fret place, and supplementarily that the Pnglich author is entitled to tte protection, as apparently he could not couvey rights which he never enjoyed. The bringing of the suit, which an of Mies Ki has already left for Philadelphia to initiate, willereate some excitement in that ayreeable rival resort, and make a sort of Ledger allve for Me Wheatley.
