Sweeney, the Listrict Attorney , was in Europe. Mr. Whiting, who appeared on bebalf of the prosecu- ‘tion, and Mr, Blunt, the District Attornoy, opposed tho jon. On being cross-oxamined i that a gentioman named Bertram, who, he believed, kept @ boarding house in the Fourth savenue, called upon him and stated that he understood h> (Mr, Surin) was on the jury in tue General Sessions. He informed me, said the juror, that this trial was coming on peta ‘said that it was a hard matter for the defendant, and (hat it (meaning the assault) was doae through pas- sion and excitement. I told him that I thonght it was not wight for him to talk to me upon the subject. Recorder—What did he tell you to do when you wereon the jury? Mr. Surin—He told me to act according to my con- Bciouce; the conversation occupied three or four minutes; he only cailed on me once, aud came alone; it was about half-past eight in the morning; Bertram is a Frenchman, and spoke to me in French, but did not cail me aside; he told me, I think, that tho trial would take place to yy ‘but did not tell ine w be here this morning. The District Aivormey requested him to step into his pri- vate office, in order that his statement might be put in the ‘form of an affidavit, the Court having intimated that Mr. Bertram had been guilty of a high offence. A jury was obtained at a quarter to two o'clock, when ‘the District Attorney proceeued to open the case on bebalf of the prosecution, giving a brief account of the occur- ‘rence. It appeared that the defendant attended a patient ‘who bourded at the hotel; whose disease turned out to be Bmallpox, but who was represented to the proprivtur by Dr. Gaiilardet as having fever. Deeming that the profes. sional conduct of the doctor was not exactly right, Mr. Cranston gavo notice to Lim and his family to provide themselves with apartments elsewhere, is request ‘was made on tue day previous to the assault, which was made between five and six o'clock on the following even- ing, while Mr. Cransion wag gitting at the dinner table, ‘Tue defondan struck Mr. Cranstoa twice on the head with ‘a champagne bottle. The United States Legation—Mr. Turpin at His Post, and Kesignation of Mr. Eames—Progress of the Constitution- al Convention—Hopes frum General Paer, &e. Our Minister is at his legation—T mean Mr. Turpin. He appears to be au intelligent man, and cae who will do houor to himself and bis country. His credentials have been furwarded to Valencia, whore the goverumoat actu. ally exists for the present, but it will be romoved back when the Convention concludes its labors, Mr. Eames, ex-Minister, bas sent to tho Proaidont his final despatch, relinquishing the legation to Mr, Turpin.
