Phis is the substance of the provisions of this deed of trust so far as the same appears to me w be materia! to the questions presented upon the present mo- tion; and the provisions of the deed of trust in regard to the ‘Baitic, though somewhat different in form and language ¢ in substance very nearly the same. By these provisions, the rights and the remedies of the United States as against these vessels are precisely deciared and Limited ; and although it may now be seen that more sum mary proceedings tor enforcing the repayment of these advances, by the sale of the ships mortgaged, would be more beneficial to the United States if its claim for the large baiance now dumauded could be sustained, a court ‘of equity cannot reform these contracts and introdhiee pro- ‘visions which were never assented to by the parties or in- tended by them to be embraced in such contracts. The United States claim that there is a balance of $116,500 due for advances made under these deeds of trust, and the do- fendents insist that{there is a larger amoun} due to them for mail eervices in the year ending on the Slst of March, 1857, which they are entitled to set-of!, and which the go- vernment is legally and equitably bound to set-off against the balance now claimed,so far as sueb stot! may be necessary, in order to extinguish their alleged indebted- ness to the government. The government, on the other han, wsists that the Secretary of the Navy has fully paid for the mail rervice rendered. and that nothing is now due therefor. The mai! service tor which compensation is so claimed was agreed to be rendered in and by contrac made with the Secretary of the Navy, by which Collins ‘and bis associates agreed to bull! certain steamers—each to be of at least two thousand tons burden and one thou sand horse power—and with such steamers to carry the ‘mail between New York and Liverpool, accordiny to the terms of euch contract. fhe mail service required to be performed by this contract, and tho compensation therefor Van are nore, im pursuance of subseyjuent ‘acts of Congress, and the five steamers provided for contract, it is conceded, were built by Collins and i and those claiming under them, and were acce; ed by the Nav: y Ha ne sonore as built in compliance with the contract. Unfortunately, however, two of these steamers have been lost at sea. No fault has been im puted to Collins or bis essociates as having caused or oon- tributed to either of these losses; and it was by reason Of the loss of the Arctic, and the unexplained delay in the arrival of the Pacific—justify ing the belief that the lat- ‘ter vesse) bad gone down at sea—that the owners of the remiaining steamers found themselves unable to trans- port the mails to and from Liverpool and New York in spch steamers as we! by the contract, to be yyed im that service. It was under these cir. cumstances that Mr. Collins, on the 17th March, 1856, to the Secretary of the Navy and solicit- ed “ ission to take a steamship to euppiy the place of the Pacific,” and asking a telegraphic des} in reply. A fact #0 important to the recommendation made would, as it strikes me, have been referred to by the Postmaster General if it had been within his oflicial knowledge; and if such tact bad been duly considered by him, it is not pro- bable that such a recommendation would have been made. Buta more important feature of this letter is to be no- teed: apd that is, that the Postmaster General does not state that there has been apy \nreasonable or unnecesary delay in the departure of the mails, or in the pertormance of any trip—that he does not state that he bas imposed or intends to unpose any fine for any sch delay; and that he only advises and recommends that the Secretary of the Navy allow $30,000 tor the two round trips performed by the [ricsson—ceducting $96,000 from the :ontract price of euch trips; and that be bases suct advice and recom. mendation, not ou the ground of unreasonable or unne- cessary celay but on the ground of the inferior service given, the irips having been periormed by an irregular steamer, and not of the clase stipulated for in the original ontract. The fact that he did not assume or attem; to exercise any power conferred by the act of 1845 before alluded to, is suffictently evilenced by these circumstan- coe, and by the fact that the deduction recommended ex. o nd by $5,000 the highest fine which he could have impose Under thst act. When this action of the Postmaster Gene- ral,was madefknown to Mr. Collins, he addressed a letter to the Secretary of the Navy remonstrating against this deduction—tsisting that the substitution of the Ericcson bad been consented to without any intimation that the government world withhold any part of the mail pay— ‘and stating that having acted upon the absolute permission to employ another steamer without any termy or conditions | being impored, they trusted that the “ecretary would re- consider the matter and direct the balance of the last quarter to be remitted.
