NEW YORK HERALD, TUESDAY, MARCH 9, 1858. en ee eee wen eed The Bu. ‘STRUCTION ane DY GOODS, « Wee TO THE EDITOR OF 1B HERALD. oa 7 SPRING FASHIONS. 1868, wana. 1858, New York, March 6, 1858, 1 Rhea in penmanship, at prices to $3; book- com ore reney 2. gahibitour ap of J dave just read in your edition of to-day an article oa Be eet a eetal Cakes hee Oe OR ya rf and 23 wie jaa ae ‘are une in ariel x = handed “‘Covert Designs upon the Public Lands—The | roomeforladics MARTIN 8. PAINE, 62 Bowery, — eo urpaased in variety, beauty Homestesd Bill.”” From the fact that the Heaarp, of all ether journals, bas been foremost in exposing the enor- land ewindles that have been perpetrated within the Inst few years in Congress, aud also been actively en- gaged in exposing the evils of land speculation, I am led to believe that you have not seen Senator Johnson’s bill, which has been reported back to the Senate by the Com- mittee on Public Lands (to whom it was referred), with the unanimous report of gaid committee that it be adopted —— ee hi ‘ou are in error when you say, “It proposes to get go- ‘vernment to grant poor and lustrious persons, out of she public Tans of'ine West, small farma,” &o., &e. ill does not limit its benefits to’ the “poor” or any other class of citizens, but it provides:—Sec. 1. That passage of this act shall, from and after the passage of ‘this act, be entitled to enter one quarter section of vacant ‘and unappropriated public lands,” &c., &c. Now, “any person,” &c., &c., includes rich and poor, ‘and embraces all classes of our citizens who may choose toemigrate to the West. You further say that should Sopra pass the bill, ‘in ninety-nine cases out of a hun- it would turn out that the original applicant bad dis- pored of his grant for itry sum to some land pirate or , and that the pi object of the bill had ‘been efttirely frustrated.” 16 course now pursued under existing pre. emption laws, but would not be if the Homestoaa bi ill should become a law, as an effectual check is provided in section 2, viz, :—* Provided, however, that no certificate sball be given or nt issued therefor until the expira- tion of five years the date of such entry,” &c. ‘You say (An emigrant farmer requires not merely inna ut he needs some little capital to buy stock enable him to cultivate it.”” “Ris suet letter, and in stating this you have advanced one of the best and strongest arguments why ‘the ‘‘Homestea bill” should become a law. There are hundreds of industrious farmers who have capital suffi- went to buy stock, but have not sufficient to buy stock and land both, and thoy are the ies who would avail themselves of the benefits of this ‘Those who ¢‘are, in reality pernoes, ‘ittle above the con- paupers,”’ could not and would nottake up the lands, but they might and would, many of them, go out im the employ of the settlers as farm laborers. Ip order that our inte! eet ciate mak whan vend ‘he Huratp, may thoroughly understand this quostion, it would be nat to publish the bel ea bel | your paper, yy 80 doing accommodate a large number of your readers, including BP, The Jury Fees of the Sheriff. TO THE EDITOR OF THE HERALD. Bis not, we presume, generally known to the suitors in the courts of this city what amount they are obliged to pay for the mere summoning of the juries to the respes- tive courts. For every term a cause is upon the calendar ‘the plaintiff is obliged to pay the Sheriff for summoning ‘the jury—and that, too, whether the case is reached or mot—fifty cents; and cases in this city in mest of the courts are generally upon the ca- Jendar twelve or fifteen terms before being reached. The calendars of the courts of this city for the January term of this year contained 5,433 causes, that is, the Supreme Court 2,612, the Superior Court 1,761 and the Common Pleas 1,060 causes. The Sheriff, as mentioned above, is entitled toa fee of fifty cents in each of these eanses for summoning the juries for the January term, ‘which amounts to $2,716 50. There are in the Supreme ‘Court ten, and in the geod Court and Common Pleas nine terms in Se yee The number of causes on the ‘ealendars does not diminish during the year, but rather Increases, for each term additional new causes are added to the calendars, and it is well know that the courts of ‘thie city are not able to despatsh the vast amount of bu- sinese before them as fast as it accumulates. The Sheriff, therefore, receives for the mere service of summoning the juries to these three courts during one year the enor- mone sum of $25,765 50—an amount sufficient to pay the salaries of the Mayor, the Comptroller, ali the Judges of the Common Pleas, and still leave a large surplus. the eervices for which the Sheriff receives this sum can be, and probably are, performed by one person. This is but one small item of the ‘perquisites of the Sheriff, and it could be reduced or applied to some other odject with out seriously distressing him. In the other counties of ‘thus Staie the calendars are small, and the componsation tw not so disproportionate to the services performed. We can imagine no good reason why suitors should be taxed this enormous sum, nor why the Sheriff of this county should receive for’ merely summoning the jurrors more ‘shan the President of the United States for pres hia duties. We think it must be apparent to all that the law regulating these fees ought 19 be altered so as to work more beneficially for the interests of the communiiy. If it te better that this tax upon litigation should be continued, then let the money be applied to the payment of the Judges, or to some other object that will net the com- munity, reserving to the Sheriff @ reasonable compenss- tion for his services.
