Cosmopolitan Art Association Attached, ‘THE CONCERN IN COURT UPON THE APPLICATION OP THB PUBLISI OF EMERSON’S MAGAZINB AND PUINeM’S MONTELY FOR AT?ACHM&NT—PAINT- NGS IN DANGER. The Cosmopolitan Art Union, which was established in Juve, 1854, under charter granted by the States of Ohio and Pennsylvania, was brought before Judge Sutherland yeeterday. ‘The object and plan of this concern are very simi- Iar to those of the defunct Art Union of this city. Subserip- tone of three dollars are required as a basis of member- ship, for which one of the leading three dollar montbiies ts given. In addition to this there is « distribution of pic- tures, paintings, statuettes, &c., by lot, emong the sub- seribers. Itis stated that during the first year of the associa: tion’s operation, 22,418 persons beeame subscribers; dar- ing the second year, the number increased to 24,088, and ‘the third year, 33,027 subscribers were entered on the books. For the first few months of the first year, subscribers Degan to pour in pretty fast; but the advent of the hard times of course affected their number, and the associa tion bas been compelled to postpone their annua) distribu- tion of pictures until the 25th of March of the present year. And depovent says that during the year i857 the plaintiffs sold and @elivered to the defendants, at their request, a safe, for the price of sixty dollars, and during the same period the plaintifis inserted and published in their megazine an advertisement for the detendanta, at their ro- quest, at the agreed price of one hundred dollars, and no part of either of said sums has been paid, but the whole amount thereof, wgether with the aforesaid sum of one ‘thousand five hundred and thirty two dollars and forty cents, making {he whole sixteen hundred aad ninety two dollars and forty cents, still remains due and owing from the defendants to the plaintiffs And deponent further says that -aid defendants on or about the 26th day of De. eember, 1567, in consideration of the promise made to them by the plaints ffs, that they would print and publish @ much larger pun ber, to wit, 5,000 copies of said maga- zine, than they would otherwise have priated and pub- lished, the defendants promised and agreed to subscribe to and take and receive from the plaintiffs for and during the year 1858, 5,000 copies of said magazine each month during said year,and to pay for the same in ad- vapee, That relying on said promise, be had printed and pablished sa d 6,000 copies for the months of January and February of this year, and have paid and incurred in and bout tbe printing and pablisbiog them large sums of money over and above what they would otherwise have paid or imcurred, and that the said defendants now refuse to subscribe for or receive the said 5,000 copies, or to pay for the rame in advance, ana that deponent and said Seba Smith have thereby sustained loss and damage to the amount of $1,200, That saia defendants are a foreign corporation, incorporated and organized under the laws of the State of Ohio ana the State of Pennsylvania, and that they have property in thio State.
