SUPREME COURT—IN CHAMBERS. ; Before Hon. Judge Sutherland. Jan. 21.—In the matter of the application of George Tay- Lor for the custody of his alleged wife.—This case, which mas occupied the court for portions of the last seven days, ‘was again resumed, The miserable room allotted for the proceedings of this branch of our judicature was densely @rowded, and from ite narrow and contracted form it was almost impossible for counse! or representatives of the press to gain access, even aied by the courtesy of Mr. Bkidmore, the officer, The members ./ the “Mort Club,’ & reciety of “yo 1g gentiemen’’ who have contracted to stand to one another to the death,” seemed to be the Predominant feature in the auditory, and manifested ‘heir approbation or disapprobation of the proceedings ms thongh they were at one of the minor theatres, divested of the incumbrances of coats and mock cloths, armed with pea puts,"and invigorated with an eceasional ‘Hi! bi! bi! Our law reporter made his way Shrongh the masees, and sans ceremonie took a seat a the bench at the left hand side of the Judge, respe tfully remarking to his Honor that the insufficiency of the accommodation for the representatives of the press should be his apology for trespassing upon the precincts ef judicial ground. Judge Sutherland assured us, in the Diandest manner, that we were welcome to any accommo- ation he or the court reom could afford. N, B—That is very meagre, The Judge, in addressing counsel, stated that he was ‘under some misapprebensions 02 the previous evening, ‘and gave his views on the question, after which be decided ‘@m granting an attachment to compel Mrs. Wright to pro- @nuce her daughter before the Court; that is, he would first potify Mrs. Wright of his determination, and if she failed to ‘somply, he would issue the attachment. ‘ichard Busteed—We will produce her now. (Sen- Bation amongst the audience.) Mr. Barbour, counsel for the relator, hoped that the Fours lady would not be brought here ito this crowded urt. Mr. Busteed said that if the young lady is old enough to de married, she is old enough to come into court and look at men straight in the face. (Lavghter.) The Judge said that if the young lady or her mother objected to come into court, he would appoint some ae vate place for the investigation—Mr. Busteed’s house, if Ihe wished. ‘Mr. Busteed was willing, as the counsel of Mrs. Wright and her daughter, that the young lady shoul? come into eourt and be examined. The other side should take the Fesponsibility of bringing her there. He would produce Miss foovip ey prove that she is under no restraint what- ever, and the return of her mother is true in every ular. Mr. Busteed then sent for Miss Haw- y, and after a few minutes said that he und stood that the case took thie shape; that the writ was ferved, a return made and a traverse to the rewrn in, in which traverse it is alleged that the fact different {som the return, and that the respondeat hhas the custody of the party sought. The Court de- fermines, on the oral testimony, that the return is_not suffizientiy full. An application’is then made by Mir. Now we propose to prove by oral testimony—by producing the young lad; bereelf—that the return is true. edged so le 4 Mise Hawley was then produced, entering the Court from the room at the rear of the bench. She was accom modated with a seat on the right of the Judge. She is a Young lady of some attractions, possessing a good ba. mored iooking, round, rosy face, dark eyes, dark brown bair, and ix apparently’: about sixteen years of age. She was self possessed, yot mild and modes’ ja her demoanor. Barbour rose iéjmake some objections to the man- ner in which she was produced, and insisted that the at- tachment should have been issued against the mother for ‘the contempt in not mak: return sufficient in law. Mus Hawley retired to Judge's private room during the discussion of counsel. Mr. Barbour understood that an attachment was to have ‘Deen ietued against Mrs. Wright fur not bringing up her daughter. The Court did not 1 samy any attachment, nor would he have issued one without first giving Mra. Wright notice to bring up the party. She is, er now here, and it is immateria) whether she comes upon the suggestion of ‘the Court or by the consent of her counsel. Mr. Barbour suggested that the Judge should first inter- Fogate the young lady, and instruct her on her duties of a wifi fe Mr. Busteed protested against any euch violation of the rues of justice, and boped that ‘his Honor would not | listen to euch uggestions, but would permit him (Mr. Busteed) to proceed to examine Miss Hawley on the ques- on of ber alleged restraint. ‘The Coart said he would ascertain from her where she wishes to go when she leaves this. Mr. Busteed—shall | examine the witness. The Court—Miss Hawley must be sworn. The young lady was again brought in, and Mr. Busteed aeked that ste be sworn The Judge said he would first examine her himself, Without swearing ber as a witness. Mr. Busteed— Miss Hawley, if the Court refuse to swear you I do not require your aiteadance, and you may go. The Court said that she should remain until he joterro- gated her, You must not go until I tell you The Judge then, in an under tone, which was not heard by oounse!, and only audible at times to those who were close to the bench, interrogated the young lady somewhat to the following effect -— Q. Where did you come from now to Court? A.
