Sarr. 12.—This morning, according to previous arringo ‘ment, a motion was made to quash several indictments pow ponding against parties for au alleged violation of ‘he now excise law, in selling liquor on the Sabbath, D. B Taylor, Eaq., counsel for the Liquor Dealers’ Association, appeare, im connection with Messrs. Phillips and Tomltneon, for the defendants, 4. Oskey Hall, Esq , the District Attorney, was pregent to sustain the fadiotments. ‘Mr. Taylor, counsel for the defendants, in an introiuctory speech, sald that he had thoroughiy examined the statuter Dearing upon the subject under discussion, and ho app"e hended tnat they (counsel for the defendants) would br enabled to prevent their views in such « manner, and in 60 brief and convincing 8 mode, that his Honor would soon come to « conclusion to quash these indictments He ap prebended that if an intelligent community had read tho | excise aw and then read the indictment, they would he | Struck with surprise tha’ such @ bill could have been found by any Grand Jory, It was admitted that this indictment ‘Was predicated upon the Zlét section of the excise law, passed at the Inet session of the Legislsture, anc although the learned Distr'ct Attorney wh» framed it possessed very great apd aoknowledged ability io criminal practice, yet it was m matter of wonder that he could have asked for an _ indictinent of the cha- racter now presented to this Oourt. That was tho fire: ‘act tbat had ever been passed in this State making the sale of intoxicating liquors ® misdemeanor. He {be ‘District Attorney) wounded the sensitive footing of 10,000 reputable citizens who were eng:ged in ti P that old feudal and decrepid body, the G-and Inquest. The Recorder’s views on the aubject urder discussion had ue consciously taken the form of a decision in public mind. The speaker wondered what reagon the District Attorney would offer for brir cing the certiorari before the “vpreme Court next week, concluded by afirmirg es tee indictments were worthless, and shoald be dis Mr. Phillirs followed, rewarkiag that he would confine himself excinctvely to the law of the care Ho presen et the following rolnte in favor of quashing tho indiot.te I, The ‘ndic:ment is framed uncer the 21:t secti f the act to rupprers intemperance and to regulate the sale of intoxicating Nquors (A) The itth section prescribes and directs the mode of procedure for any violation of he provisions 0” the aot, and abrogates, #0 far as these proceetings ars covcerned, the rigbt of the Grand Jary ex mero moter Wo originate ap {m iciment.
