Pending \his the Houge adjourned. Interesting Slave Case in the United States Supreme Court, ‘Wasicron, Dec. 16, 1856. All the Judges were present, as weil as many distin- guished jurists and members of Congrers. The case of Dred. Scott, plaintif, vs. John F. A. Sand- ford, came up for argument on questions of law. The pleintif, s man of color, brought a suit to try bis right to freedom. He claims having been emancipated by his master, having taken him to reside in Tiltnois, which act, it is declared by the constita tion of tbat State, operated toemancipate him, The Oir- outs Court deciced against the moval te ground tha by bis r tarp to Miseourl, is master’s might, ‘dorian whiirt in Jlimols, had revived, aud that toe coostiietion of Jilivois was s pena) law, which the courts of other States were net bound to enforce. The case was argoed ‘St the last seeaion, but the decision was reserved to allow Of arguments on certain potuts of aw. Mr. Movtgomery Bia'r appeared for piaiatiff and Messrs. Reverdy Johnson aac © 8. Geyor for claimant. Mr. ood opened the case by stating that nothing was sald last sion upon one question upon which the Court in invited argument, whet bei pita in abatement of the jaris- diction of Court is weived by pleading the merits of the case. He quoted a decision by Judge Daniel, to the leot that the act of 1769 did not change the rule of eom- mon law requiring a plea in abatement unless tinal judg meut js made upou that pien, and it is waived. Tao Carnot take notice of evidence when try- the law on tho subject. Another question is ppl is a citizea of Missouri. Mr. Blair contended that the plaintiff 1s legally a free man of Missourt, within the eleventh section of tne act of 1789. It had been objected that ho is not entitied to all the immunities of other citizens; but if that is a test of citizenship, three-lourths of the whites of the United States are pot citizens, becausc the census shows that there is not more than one voter in every five inha»i- tants. Therefore, that hypothesis does not hold good. ‘The allegation that plsintitf is not a citizen, because he does not g to @ particular class—such as aro cligivle for the Benn: 4 for instance—falis to the ground like the other, because there aro many citizens of the United rs by birth—who are not be eed for the Ho referred to Judge Gaston, of North Garo. hina, who decided that all persons bora ip the realm are citizens; that siaves are citizens under disabilities; and eigners, removed by uaturaliza'ion. —* various States, whic! ears ‘that there are other citizens, ceesary to deny them certain privileges by postive en- aciment and express law. Mr. Stair thought tais social Jaw not the law for courts of justice, and ponte, up om the ground of former ruil! the couris that the party need not be entiticd w all the privileges of citizen- ship. Judge Gaston states there has veea no law repeal- ing the ger principle of common jaw end that virth makes citizenship ip dced. The act of the Missouri Legis- lature of 1845 expressly recogniz+s {ree negroes 4s citi- zeus, and Ceciarey that none spell come there who are met ceclared by other States as oitizous. ‘The next question was the constitationality of the Mis- souri compromise, Whether it ts #0 or uot ths consti- tution of Hiinois is, and under it plaintiffis emtitied to his treedom unless forfeited by ® return to Missouri. The Declaration of Independence declares liberty to be ove of those rigats which are inalienable; acd are we 10 be told that a pegro by apy act ot bis own, can arrogate this act. He cited many cases bearing on the audjost, ‘and raia that Judge Seoct, of Missouri, was the first man on thin convent to find out that the piaintiif bad alten- ated bis liverty and made bimself a slave again. It was @ setiied polat of law in AMesouri evea before ber venice wii bat it was not law, bat passion and ics which invaded Judge Scott’s mina. It was a vit of common law which the court ts called upoa to decide upon a genoral’princigle, and tt is not bound to consider Judge Boot! pinion more apy cept for its weight and arDing.
