The Semalictn oe of | this decision bas been the ap- pearance of some or six different editions of ‘Miss Warner's book ‘as waka nene of which will pay her one cent. Notwithstanding this, the Messrs. Low have adhered to their contract, and have already paid Miss Warner nearly two thou- sand dollars. Cases like this illustrate some of the evils of the present system, or rather want of system, of reprint- ing, and also the necessity for an international copy- right. Bad as the present system is, it ia made worse by the course adopted by a class of greedy, pirate publishers, who can only be made to show a sense of commercial morality when the stroag arm of the law is upon them. The rights of authors is with them simply moonshine. In this country the work of an English author, published by one of our publishers, is seldom or never re-printed by another. Should it be announced by more than one firm, the one having made the least progress gives way. Were English publishers to adopt this system, it would, in some measure, palliate the evils now exist- ing. Nay, more, it would discover a sense of honor, the want of which at this time reflects bat little bp niet yet American authors and publishers would then be placed on an equal a eee Ry Be ae footing with those of England, and much of this Aivermore & Rudd. ‘This is a clever tale, with rather a Quixotic ob- jeet—to hold the mirrer up to the aocial sins of the ehivaly of South Carolins. We need scarcely say that its 1e¢2ption there is not likely to be very flat tering. It is ; robably by this time classed in the index :xpurgatcrius of the slave St.tes, if we may Padge from the following sneciote related in connection with it. One of thej preliminay @irculsrs of the publishers of the work was Tately sent into South Carolina, and was returned by one of the leading booksel'ing houses there with the follcwing endor: emeat:—‘“Send your circular to your Bleck brethren in Africa, or come down here and get a few lessons in the effects of Brooks's canes.” Now, the jadgment which this sentence implies is hhasdly fair. The book is silent on slavery, isa South @arolina production, and is free from anything like malice. The people of South Carolins must be thin ekinned, indeed, if under such circumstances they shrink from hearing the good vatured truths which are conveyed in this story. Mansyixc roo Lats. The writer has divided his sub- ect into four parte—first, the age of artistic beaaty, aa typified by Pericles; secondly, the age of martial fercve,as typifiei by Augustus; thirdly, the age of sobentific invention, as typified by Leo X.; fourthly, the age of universal amelioration, as typified by ‘Washington. To those who are acquainted with Dr. Magoon’s scholastis and artistic attainments we med not say that the manner in which he has illus hated hs faery yisplays soucd judgment, ex:en sive research and a thorough sequaintance with the principles of art. The ‘only fault we have to find with the book is the brief manner in which the subject has been treated. An interesting case to American authors has just teen decided by an English Chancery Judge @ramwell.) But the decision being on a point of proof, it leaves the merit of the principle contended for yet unsettied. The book on which the case in question was decided was Miss Warner's “ Hills o ‘the Shatemuc.” Messrs. Sampson, Low & Co., the London publishers, contended for the author's righ’ to » copyright in England, upon the groand that it hhad been first published in France, by « Paris arm, which, under the provisious of the “ literary con- vention’ between Great Britain and France, woald entitle it to a five years’ protection. The English house published it under contract with the French ee ae each as securing the author ber interest, &c., the ‘ease would appear a very clear one. But no sooner ‘was the English edition ont than Routledge & Co. reprinted upon it, making affidavit that the work was first published in New York on the 3d day of September, and that the copy they prodnced in eourt Sear an on pam It appearing from this preof that the publication in New York was = to that of Paris, the Messrs. Low were cast. On Friday last the New York publishers, Messrs, Appleton, appeared before Mayor Wood aud made aeees tak tak tall Work wee uot published call the 20th of September, and that natil that day no copy was sold by them or any agent of theirs, consequently the copy produced in England must have been obta'y od during the printing or binding, and by some person | employed thereon. Even should this be shown to | the English cou:t, it is doubtfal whether it will wid | ‘unnecessary injustice obviated. An international copyright law is, however, loudly called for. Ano- ther phase of this necessity has recently developed itself, in the fact that our neighbors in Canada con- tend for the right to re-print all American works, justitying the act upon vasious pleas, one of which is that retaliation is the only way to obtain copy- right for English authors in the United States, and that they (the Canadians), as competitors in the fields of progress with the United Stagpe publishers, eannot afford to throw away such opportunities. This_is very well; but the writer loses sight of the fact that the colony is subject to the provisions of the British copyright law, and as “Dred” is copy- right in England, it follows that it is in Canada. The English publishers urge this, and taking what appears to usa very liberal view of the subject, ex- press themselves willing to permit the continuance of the reprint provided it pays to them for the privi- lege twelve and a half per cent on the lowest whole- sale price, being the amount of duty only, that such books would pay if imported copies of United States reprints of English copyrights. ‘This,” say these gentlemen, ‘we do in the hope of establishing a pre- cedent to be followed by other English publishers, to permit the reprinting of their books in Canada.” They also reply to the point argued, that retaliation on the United States publishers is calied for: “We do not believe that retaliation is the best ceurse im she a of public opinion; and as to our the United States, we have only to do justice ourselves to ‘gain justice;’ and we apprehend that all we concede to American authors be re- ciprocated to ours; in short, we have great faith in gaining an international copyright law.” Obituary.
