George Benjamin Hooker, ane sworn, says:—l live in the house 68 White street; ‘uesday’ or Wednesday, after six o'clock, I was sitting in the third story room of the house 64 White strect; I Was reading a newspaper; my attention while reading was called to loud talking; 1 looked towards Mr. Joyce’s windows in White street; I raw Bartholemew, alias Patrick Burke, sitting ia the third window, there being five windows in White street, ou se- cond floor; he was looking towards the apple woman’s stand at the corner of Whitestreet, with his head rechuing on his hand; I could not see anybody talking to him, but ‘still heard the loud talking inthe room where he was; I looked again, and saw a man striking his fist ou the coun- ter; the mun had nothing on but bis pantaloons—no vest or Coat; his beight was about five feet tive to six, rather stout; | would know the man agaui; I recogaize this man, (meaning Mr. Reiche,) the last witness, as the persoa who was in the room, and who struck the counter; [ could pot be mistaken; this is the man; (meaning Mr. Reiche, the last witness); 1 did not read the newspaper for twenty minutes afterwards, but continued to look towards the room where I saw Patrick and the busheiman; I saw the bushelman (here present) striking the counter with his left hand, the right pointed in « striking position at Patrick's head? Burke (deceased ) all this time said nothing; once he looked at the bushel man, and again assumed his former quiet position; this mun sbook bis bead 1» a menacing way again, laughed and went away; Patrick, in two or three minutes, closed the shutters, ‘and went away; lam 4 paper box maker; I make boxes for Mr. Adams, the perfumer; my wife is forewoman in his establishment; deceased told me Mr. Rewche was the bushei man; [ hear¢ nothing afterwards untill beard of the murder; [never spoke to deceased | outside doors; I always spoke to him while I was doing business with Mr. Joyce; Reiche, while threatening de- ceased, looked very angry; 1 know the man Reiche, be- caure | saw him frequently at Mr. Joyce's store. Samvel Adams, being sworn, says:—I live in No. 68 White stree:; I saw two men on either Tuesday or Wed- nesday of last week in Mr. Joyce’s room, fronting on White street; I think where I saw them was in the fourth window from Broadway; one party was sitting ina chair, looking towards Broadway ; the gesticulation of the other man was angry; the acts of the parties coutinued for a minute or two; | think J could recognize the features of the parties; the man who was standing up had bis fet clenched, and seemingly in a threatening manner towards deceased; the man w was sitting seemed quiet, still look ng towards Broadway; the man who was standing gave camitle, and Leaw no more; In ize this man now belore me as the man Wao was 8 ite the PPOs! man who was sitting in the chair, and whe b had his fist clenched, in a threatening manner; this occurrence was in the neighborhood of 6 0 clock; | heard no noise on the night of the morder. Louis Liebenheimer being crogs-examined, says:—The man who took away the knife from the barroom was a stout. full man, with sandy whiskers; | would know the man again; I pever saw him before; he wasin the bar- room about ten minutes; after the man took the knife Patrick was not in the barroom, whenever Bartholomew Burke came to the barroom he had no key tn his hand; on the night of the murder deceased gota quart of beer ‘and took it up stairs; 1 didp’t see him after.
