Will Governor Reeder Return to Kansas?—The Question Settled in the Negative—Hon, Mr. Packer's Interces- sion—Caucus of the Pennsylvanians—The Kansas Judges and District Attorney to be Removed—Meeting of the Territorial Legislature—Col. Benton Thinks Manypenny's Note Unworthy a Reply, &c. In the Herap of yesterday, you ask for something more definite in relation te Governor Reeder’s return te Kansas, and suggest that ‘‘the Washington correspon. dents are in a fog, and cannot tell anything about the matter.” Not so much ins fog as you might suppese, but only waiting for events to transpire. I never use a blank cartridge if it can be avoided, and I know you ‘would preier facts to spsculations. Hon. Mr. Packer, of Pennsylvania, member of Con- gress trom Reeder’s district, visited Washington last week, with a view to arranging ali the Governor's diffi- culties; but he proved a slow team, if mot an old fogy. In fact, after he saw both sides of the ques tion, his ardor cooled down, end he quietly returned to his home. Steps have been taken to induce Governor R. to resign; but this he respectfully deslines to do, replying that he does not care s d—n for the p sition, but that bis investments in Indian lands ape his pr'sence im the new Territory. In this, how President bas the honor to diifer with him, Seen es Secretaries Dobbin and Guthrie, who are as peti op- posed to his centinuance in office as ‘Yesterday, a quasi caucus of influential Pera tilas was called at the White House, for the purpose of consi- dering the Governor's case. Mr. Streeter, the able Soli- citor of the Treasory, and several others were in attead- documenta in the several and that Judges Johnson and Elmore, ban United Staves District Attorney, Isaac, willall go by board, It is a little remarkable that the correspondence between Governor Reeder snd Commissioner Meny- peppy was never seen, much less road, by the Pre- sident of the United States until within the last day or two. A perusal of this correspomdence fixed him in his determi: ‘The Sealatasure of Kansas meets on the 2d day of Jaly, and the Secretary of the Territory, who is now acting Governor, will send in nual message. A new ap- porntee would barely bave time now to reach the seat of government before the session commences, Some anxiety has been expressed to see Col. Benton’s rejoinder to Col. Mapypenny, butIam informed thet “Oid Bullion’ saya the subject ts too insignificant for his », I wonder if those who have read the correspon- lence agree with bim. fome have the hardibood to sur- mise ‘t the great missionaries is afraid to Sir ae egain.”” ‘The Case of Lyman Oole, the Alleged Bank Forger. COURT OF GENERAL SESSIONS, TRE ALLEGED CONTEMPT CASE. Before Recorder Smith. Jung 18 —The Cole case cama up this morning, pur- suant to adjournment, The names of the jury were called, andall the jurors found to be presente The ac- cused and his counsel, Mr. Busteed, were in attendance, The Recorder, addressing bimeelf to the District At- torney, said he had received a letter from one of the counsel in this case, stating that he could not attend the trial of it today. In view, he continued. of what has already occurred in the cause, and as the prisoner should not be prejudiced by anytoing his counsel may have done, { deem it proper that this cause should stand adjourned till to-morrow morning. ‘the District Attorney—a great deal of the public time bas already been occupied in the trial of this case. ‘The trial of Kiseane occupied eqjht days, and the for- mer trial of Cole occupied six days. Twoor three days of tbe public time have already been consumed, and it will probably take #'x cr eight days more, Mr. Whiting, who is engaged with moe in toe prosecution, has anotber engagement next Monday, and ‘there are several other cases ret cowu for that day, at which it is importent tbat I should be per- sovally present. Hesi’es, the other counsel for the prisoner may be engsygei in some otter cause, and although I should be very bappy to see him om this case—and it is the first time in my life I was ever glad to see himin any case—still he may be other- wise engaged, and more time be consumed. Under these circumetences I would prefer to wi'hdraw a jaror, and let thin cause go off. Tbe Recorder—Can this be done without the consent of the counsel for thé accuses, Send for Archbold’s Plead I will allow the motion to withdraw the jurer. br. Busteed—If the Court please, I object to the with- drawal of the juror. ‘The Recorder—Sit down, sir; there is no motion bs- fore the Court. Mr. Busteed—There is a motion before the Court in respect to the withdrawal of s juror. My associate is not the counsel in this case."I am the counsel for Lyman Cole, and as such I protert against the withdrawal of a juror. We are ready to be trie, and claim to be tried defore this jury. The Recorder—Sit down, sir; I have decided ths motion. Mr. Busteed—Your honor will pleaze note my excep- tion to your ruling. The Recorder—You may make any sxception you have a mind to. Mr. Busteed—I have no other excaption to make now. Before the dirmissal of the jury I wish the Court to note an exception to something that occurred yesterday. I refer t> the Court preventing one of the counsel in this case, (Mr. Faitbanks,) ‘rom being beard ia respect to a motion which he endeavored to make pertinent to this case, affecting the rights of the accused, District Attorney—As public prosecutor, I stand some. what in the relation of counsel for the accused, and while Thold the offi never will try an intictment under these circumstances; and in this case, if Mr. Busteed is to be the corns Mr. Busteed—¥r. Holl, do I understand that you will not try this indictment at all? District Attorney—I have stated what I have stated. The Jury were here discharged by the Recorder, and Mr, Hall then stated that he never would try Lyman Coie 9D that indictment: that there were othar indict- mente ogainst bim on which he Would proeaid. Busteed—It ia not fair, if the Court please, for the District Attorney to speak of ‘other indictments here, hod Recerder—I shell hear no more arguments on the subject. Me. Busteed—Mr. Hall, I am sure you aze too much of agen:leman to make any attack upon me im any lace, where by the tale hy the Court | am prevented fron replying to Do you mean you try the other indictments oe the same forgery’ District Attorney—I mean an indictment akin to this. Mr. Busteed—Don’t you mean an indictment for the forgery on the Chemical Bank? Is there an indictment for any other forgery? District Attorney—I mean that indictment. Mr. Busteed—-We are ready to be tried now upon that indictment. District Attors Attorney—We shall not try it now. will you try it, Me. Hail? District tion Attorney—I cannot tell you to-day. Ar. Busteed— Will wh po try it this term? District Attorney—I cannot tell you to-day. Mr. Busteee—It ‘the Court please, I ask at the Dis- trict Attorney be obliged to assign some day for the trial of Mr. on the other indictment im respect te the same forgery? Iask it, because the defendaat has witnesses who reside a thousand miles from here, who are now in Court, and who have actenced twice before. Tack it in justice to Mr Cole, whois ready to be tried, and who has laidim prieon for some nine months, ‘The Recorder—i shal] make po order in respect to the matter, The District Attorney must arrange his own business. Mr, Busteed-- In fee to the alleged contempt, of which it is claimed Iam guilty, the Court ssid that it ‘would bear that after ths termination of the Cole trial. The Recorder—Are the answers to the interrogatories Mr. Busteed—No, sir. ‘The Recorder—I will hear nothing on the subject till are filed ? ir. Bur teed—The Court fixed Saturday morning next for the hearing of this alleged contempt. I think I shall be out of town on Faturday, and would like to have the case beard on some other Sy, either esrlier or later, as you may fix The Recorder—Very well. Let it be Monday of next week. OUR HAVANA CORRESPONDENCE. ‘Havana, June 4, 1856. Arvest of a Band of Negro Brigands—Feliz Shipped off Sor Cadiz—Departure of Commodore McCauley—Tra- to this barbor on the lst instamt, departing this morn. ing for Norfolk, I cannot suffer the opportunity to pass witheut sending you a brief letter. Thirty notorious scoundrels, negro thieves and mur- derers, have been arrested in the Pinar del Rio district, where they will, it is believed, undergo their trial. ‘The innocent and unfortunate Felix on the evening of Slot ult. received information that he was to embark next morning for Cadiz. A friend of mine was visiting him when he was told this by two friends who came to the Punta Castle to see him, and who had obtained the information from the guardias-civil who had come to escort him. Taken somewhat by surprise by the infor. mation given him, poor Felix instantly requestei my friend to go to the acting United States Consul, Colonel Robertson, and say he (Felix) wished to see him. Colonel Robertson had that afternoon undergone an operation, the tonsils in his throat having become en- larged, and he was consequextly unable to leave his re- sidence; he, however, despatched the Secretary of the United State Consulate, Thomas Savage, Esq., to visit Fehx, who at four o’clock next morning was taken charge of bya comisario and two guardias-civil, and maiched on board the Spanish ship Nueva Apolo, which immediately set sail for Ondiz. Perchance Mr. Marcy, being by this time satisfied that Felix is a citizen of the ‘United States, may instruct our Minister at Madrid, Mr. Augustus Cesar Dodge, to demand that Felix shall not be sent to Ceuta, he not having been tried according to the terms of the treaty. Commodore McCauley went to sea in the San Jacinto on the atternoon'of the lat inst. He called on General Concha the preceding day, but did not obtein a second invitation to dinner. I learn that a new regulation is shortly to be a respecting travelling licemses. Instead of the “a1 travelling: license’? being granted as heretofore, a crete ter of security,’? to be in force for six months only, is to be granted, for exch of which two dollars and one real have to be paid. "the Governor of Matanzas, Col. Ona, died recently. Previous to his being in extremis, the attendant priest, Padre Martinez, wished the dying man to confess, which, however, be refused to do, sesing he bad been for many yeors a Protestant. When he died, the priest refused to bury his body in consecrated ground. The telegraph was employed to inform the Bishop of this circumstance, who, of course, confirmed the decision of the priest. Tho deceased colonel, however, being a general favorite at Matavzas, especially a1 the militia, quite an uproar ‘was occasioned, and threats were used, which being communicated to Gen. Concha, be was pleased to order that the body of the deceased should be buried in the consecrated ground. A friend of mine from Matanzas, however, informed me, the evening before Jast, ‘hat the sons of Col. Ons had become so disgusted at the intolerant spirit that bad been exhibited by the clergy, that they hed the body of their father embalmed, and determined it should not be buried at all in Cubs. ‘The Gaceta of yesterday contains a republication of the law of the 10th June, 1847, for the protection of literary property The ‘cause of this taba gegen as is gene- relly, believed here, is amusing enoagh During the recent visit of General Concha to Matanzas, &e,, the Diario de la Marina, with extraordinary energ; and enterprise, went to the expense of secu td vate telegraphic despatches concerning the do the Captain General and the receptions afforded hi the various points of his journey. Some of these ve! graphic despatches the Prensa is accused of ‘ cribbing” without dus acknowledgment, and we hed quite a pretty Jittle quarrel between two papers for a (ew days. I do not worder at the Diario dela Marina feeling at the Prensa’s sppropriation of its news, which is so scarce and rare a commodity in its columns. “Peter Hicks’s” promised setter appeared in the Diario of yer but although he (pledged ‘his word’? to publish my name, &c., ye as not done 80, simply because be dove not know me, rh ‘a8 I suppose, he bas ditcovered his migtake, and that I am not the person he fancied me te be.
