MOTION TO QUASH THE IN! suenr, TayvIKe, LINN, AND HYLER DENIED. Arnit 10,—At the sitting of the Court this mora‘ decision Judge Cowles proceeded to render his aul motion to goon se the indictment. foand agains’ | Tovlaas — ee cr —This ia a motion mate in b featate, Tigler, Lina, Morrissey anil” _A@alt of the de- mt and remand the parti’ i02 "fora prelim: er amumin catbe gros 9 dhatatter the Coroner's bea els 04" ign icaplicsting them as arrested b; ch a isav 9%. Willem Epole, they were Javmanied, a by the Cor . That they thereu; »* sat were refused by him, an exam- imaton by witnesse”. te ‘bo called either for or against them, the Coroner ‘aciding that, under the statu a ho had no pewer to 10 sére than to take the persoaal statsmmen orexaminatio’, ef the defendants without oath. It will na Sooner wad now to discuss the question wheter the pugcarthes thas to say, Ly upoa an examination of -_. T have arrived at the same conclusion with Mr. stice Morris, when that question arose him, to veeee my pcre hold for the Corroner erred Pt jer ay and peek by indictment, all persons chargetl at too, whi such “ieee are or Fothet bps arrest aud examiaation re pe magistrates of Fg county, Bat itis posi ee where a party is arrested before iniictment, stlate is a hoe ge we priety and undae haste on be part Grand Jury in entercain- img 8 fi 2 and 0 one to iadict until the ery, examination shall have been brought te close, and that while the statate has not iehibited the Grand Jury from acting upon that class of eanen, yet that a quasi right is possessed by the accused te pats such examination fully closed before being pre- sented by the Grand Jury. 1 will not deny that in many cases, if the Grand Jury are apprised of the facts that the party is under arrest and that the commitiiag ma- eens iw proceeding with a full exam'nation into the te and circumstances attending the alleged offence, ticularly in that class of cases, the prosecution @f which ave indlisied ope tie sompitatal sntedive dual and s0 assume a character in some degree personal to the prosecutor, thas it would be yery wise and judi cious in the Grand Jury to defer action until the m: + aol trate bas made return of ali the testimony taken before Po! ‘This will always evable both the Grand Jury and the public prosecutor, by an inspection of the return, to judge of its character and form some opinion as to the probability of guilt or innocence and tbe propriety of further prosecution, Sach a discretion, if it exists on the part of theGraad Jury, would apply to all those cases where the original eom: piaint is made to a jastico of the peace, and to all other ‘cases when a return of the proceedings and examinations had are not made or the witnesses recognized to appear and testify before the Grani Jary ‘Until'the final close of investigation before the committing magistrate. But an examination of the statute will show that in this case the Grand Jury possessed no such dissretion. That they could not, had they been apprised of the fact tat parties were under arrest and before ths Coroner eal amination, defer their own action, but were bound, 4€ the testimony warranted, toindict? By 2 Revised Statutes, 742, article 1st, in regard to Coroner's inquests, it will be seen that upon notice received by the Coroaer that any person has been slain, it is the Coroner's duty forthwith to summon a jury to appear before him ani make inquisition concerning such death. By section 5 it is provided that the jury, after inspection of the body, and after hearing the testimony, shall deliver to the Coroner their inquisition in writing, in which thoy are to certify the cause, manner and circumstanses of the death, ‘aad who were guilty thereof, either as principal or “acces- sory, and in what manner’ Bec. 6. Provides that if the jury find that aay mar- dex, manslaughter or assault has been committed, the Qsroner shali bind over the witnessss to appear and testify at the next criminal court at which an indist. ment for such offence can be found that shall ne held in ape at of the same section further p y charged with acy wach offence be not in custedy, the Uoroner shall have power to issue process for bis pprehension ja the same manuer as a Justice of the Peace.” Thus it will be seen tht, by expross mandate of the statute, the moment tue Coroner's Jury fouad and sub- scribed their verdict, the whole matter, with ali the mt- esses, wae sent to the Grand Jury—seat to them to aet upon at nd with no discretion to delay their proceeding upon the charge whether ths atcuse1 ware or were vot in custody, or whether they were or were pot under examination before the Coroner, as provided ‘m section 7. The case is theretore entirely unlike tuat other ¢lass to which I have heretofore alluded wh® the retarns are not made nor the witnesses bounl over to appear ‘and testify until the preliminary examination is @}ore3; aud ‘t would be, in m: ju ment, jastas much dereliction of duty in the Jury to refuse to act alter the Caroae: inquisition “had been returned, as it weuld to gtvea similar refusel after the revurn of the Prowm\usry exam nation a by the committing magixtrate Ym thit clas of cases am Fight in the view I have taken of the mandatory che ter of the atatate, which oortrolied the action of the Grani Jury in this ca LA i reisef course no ground on which tnis motion can ranted. ‘That the indictment is regular is conceded, BS Court cannot be held to possess a discretion to aid n indictment as prematurely found io a case where the Grand Jucy have none to refuse finding it. ‘The motion to quash must therefore be denied. Counrel for the prirouers then desire! to make a mo- tiom to admit them to bail; but as thers was a murder trial on, the District Attorney named Thursday for the weomen, provided no other criminal case occupied the yurt. THE TRINITY PLACE HOMICIDE. ‘The trial of Terence Hamill, alias Hammond, charged with the murder of his wife, Kuiza, on Ist January, was thea resumed, and after the examination of several wit- nessen, the District Attoraey read the examination of the prisoner at the Coroner’a inquest—pu lished in Tue.- day's Hit, hie closed the ease for the prosecutizn, ir, Chintom opened the case for the en sayiag that it was impossible for him to attemp hat thn deonssed teas her testi #5 Wad Maeds OSES] prisoner; Dut the questions for the jury would be his accoanta- Dility, and whether the crime was murder or min- slavghter. We have not heard much lately about the dividend, and pi 9 it bas been absndoned. Erie Railroad s6ld nearly to the extent of four thousand shares, and was pretty well maintained. Norwleh and Worcester has beea creeping up slowly for some days past, but not much stock has been bought out. Some of them did not come io until prices had aivanced nearly to the present points, but they have become so well satisfied of the produc- tivenegs of the company, that they were not daterred by the rapid rise of the past few weeks, Tho ceal basiness this year is likely to be larger and more profitable than ever before. Western railroad stocks do not improve much, There ia nct much demand in this market for any of them, Railroad bonds have been much neglected mum, There is demand for any of the different classes of Erie bonds.
