He ob- jected to them on « constitutional ground, for the con- @itution provided that in all criminal cases the party ecoused shall be confronted with his witness, Mind the constitution, therefore, in this respect, abrogate i the common law in relation todying declarations. The point bad never been raised before in this State, but it has ‘Deen sanctioned in Georgia, (the counsel quoted a rele- vantcase,) and is entitled to the serious consideration of be al said, that, in the Ist Wheeler (Mass.
