The first great change which we are to wit- * ness in the conduct of trials is the operation o! the important © standiag rule”? requriag coua- sel, when examining witaesses, to be oo their legs, steady and strong, without reservation or exception in case of age, rheumatsm or gout, We bave heretofore remirkel on ths teudenoy of this rule to promote the equality he tween witnesses and lawyers, which, while muintaiving the rights of the former, will im- prove the physique of the latter. The rale was adopted to shorten trialx; and some of our cotemporaries think it will have thas eifecs, especially #8 the examining conusel is not to tyke notes of testimouy uatess by +pecial leave ot the court, and must couteut himself with the bavk ireues which he bus received eitner ayn retainer or a refresber, Es learued ssasociate way, bowever, write dowo what transpires, aud it he be a slow peaman, we think the interve’ between the questions put by the examiner muy be made long enough to afford time for bis taray flugers to revord the witnesses’ state- ments. If a law had been passed attashing a ste ograpber to each of the courts, as one of us officers, and the records kept by bim had heen given official authenticity, i¢ would nave teen quite immoterial whetser the lawyer stood up to hammer away at witnesses or (led in the easy umplitude of one of the most luxurious fauteuils, It ix our belief toat the de iberate gentlemen whom the standing rule was designed parvicu- larly to wffect, caugot be burried by tae new expedient We have sees many efforts to quicken their pace by» co,ent judges or uimble adversaries; but the move they were uged to proceed, the more studborily tbey adbered to their tortoi-e-lik+ locomotion The vew experiment is to be tried upoa them and we will observe its effect with close atten tion. If it operate to shorten trials, all of us must rejoice. Such a result is very desirable. aud the bench and bar can do mach to pro mote it. Let us, with becoming deference mention to the learved judgea how they can do certsinly fur more for the desirable esd in view tha) can be effected by all the rul-s of the court oow in force. There is oo reason why all the courts rhould vot open at ten o’clozk; yet eome of them begin at el ven, and adjourn at three Nor is there any reason why judges shontd not tuke the bench precisely at the bour to which the cvart ad our.s, without irtiering avay time at cham ers) M-ny va’uable hours are lost by the inexcusable want of punctuality which is constantly exhibited. A great deal ot time is -lso wasted by some of the udges in delivring oral opiaions on legal argumnt-, to which there is seldom even ove listener, the bar asually occa vying themselves during this “stated preach ing” by talking politics or telling anec dotes, so that th» didactic tone of the beac: sounds amid the brzz of the lawyers Ike the hum of «.bee in the din of crickets, Ths prac tice of the judges sbould be reformed altogeth er; and in our opinion, they should alxo aban don another bs bit equally wasteful as to time, and far more injurious in its consequences that of delivering prolix comments to he jury on testimony. A judge discharges his duty most effectively at nisi prius, wheo he contents himrelt with stating ~s tersely as posaible th rules of law by which the jury are to be guided in the case before them. When, as is toe ge neral cu-tom, he recapitulates and descants ov ‘he proof, he selduw fa ls to confuse the case, and almost always does in ustice to one party or the other by intimating, or what is just a» bad, being understood to intimate, an opiaion On questions of fact. ‘the judges can also seve time by enforcing the roles of evidence, and excluding imamate rial and irrelevant testimony, tous confluing the proof to the real points in issue, Instead ot doing s0, they very frequently allow hours to be jort in taking proot «to see whether it will amount to anythiag,” and then tell the jury to disregard it—a very absurd direction wenerally, as every one kavwa it is nearly, i not quite, impossible for any one but @ diaci- plined logician to reject, in dec ding any ques- tion, impressions made by the evidence at- dressed to it, wether ¢ c me from illegitimate oF legitimate eouroes. We beg leave further to sugeert ‘bat if the judge«, at the fir-t moment of undignified altercation between counsel, would instantly arresi t, «nd apply censur: when clearly des rved by the lawy or who wan tovly impugns the motive or assails the cha racter of Lie opponent, the tim» of the court would oftea be raved, its diga ty increased né the manners of some lawyers materially improved. Spanish CRUELTIES.—It seems to be a settled fact that Spaniards cannot go to war like other civilized nations, but insist on disgracing their vanners with atrocities worthy of barbarous savages, Not many years since, the whole world was horrified at the cruelties and enormi- ties practised during the Carlist war in Spain: when the leaders of both factions openly declare} that it was their intention to give no quarter, and carried out this frightful menace to the let- tr. Now, the eame scenes are being renewed iv Veneza la, where, accorain : to our advices, Monagae, the hea o ‘he ex +t vg government, has ordered his troops to -p re non: if tie re- belek. The steady misfortunes f nand her colonics are very probably due fo sone mes sure to this horr'be feature in the national character. Men who cannot differ on a point of -olitics without butchering each other, ure as- “uredly unfit to enjoy liber y or a stable go- verrment. The next few months will show whether Spain it-elf has improved in this res vect sicce the close of the Carlist war. Ferry Company.are «t Just in @ position to complete the delivery of the number 3% giscuant tekets uecewary \or the acconm: dation of the public. The ramor that the delay arose in consequence of the dis- treserpg financial difficulties io which the com- | pany were invo ved by be advance iv the price of con's, and the other untoward circams ances delicately and vaguely biated at in the expiana- tory curd whicb prefaced the new regaiati ms, ix, we are aasured, totally w thout fundation, aa their printers ceclure that thrir coufidence in the concern bas not been for & moment shaken by the lamentable picture therela drawn of its «nbarrasrments. We believe that with the great mecbavical resources of the firm favored Ly the c:- mpany’s orders, a day would have sufficed to throw of any amount of tiok~ts that might have been required to meet the demand, and therefore we must look fer an explasation of the delay in some other quarter. Some people are ill nstured enough to insinuate that the drag compl-ined of in the operatiuns of the printing estsblishment to which we refer was applied by the express orders of the directors of the company, but we have too much confidence 1m the good faith aod disinterestedness of the liberal minded iadividwals who have thy management of its affairs, to attuen aay credit, to ro ungenerous an imputation. We sre rather inctived to attribute the inconvenience ty which the public have been put to the more rational eause which the friends of the company assign for it, namely; the t me necessarily taken up in marking asd checking the vast pumber of tickets which they bave found it necessary to issue. Is is not the funlt of the direccors, if, in sp te of their anxiety to press forward the completion of their uew wTapgements, the result of this uaforseen ob- stacle has been to force ina large amount of -revenue which they bad not cuiculated upon, and which it has gone against their consciences to pocket. We caa only set it dowo as one of those melancholy negexsities to which the best intentioned men are sometimes obliged to sub- mit, and which require no small amount of phi- losophy to endure without winciog. Equally uvfortunate is the position of the company with regard to another of their regu- lations which they bad benevolently announced asarort of palliative to the distasteful mea- sures to which their pecuniary difficulties have driven them. They had intended, we uoder- +tand, to put the commutation system into operation coincidently with the othr altera- tions in the fares ; bat, owing to a variety of circumstances to) numerous to mention, th+y were only evadled to hold out @ couditioual promise that it chould commence oa the first of September next. Amidst the namber of cou- flicting ramors which have been circa‘ated as to the causes of its postpoaement, the only one that appeors to us plausible is the difivulty which the directors have experienced in tating astatistician capable of catculatiag with the re- quisite nicety the base: on which it soould be establithed, It is es-entia) to the proper working of the plan to compate with accuracy the exact amount of add.tional pressure which «he poorer clartes of passengers are capable of beariag, aud the awount of relief that can be afforded t» the overburdened owners of real estate. We cennot sufficiently applaud the generosity and delicacy which induce the directors t» submit to this delay in the completion of their arraage- ments, in order that they may take into care ful consideration the different interests likely to be sffected by them. We are the more tivcere in the expression of our aimiratio: from the fact that in this as in the other ix stance already alluded to, every day last dos @ positive violence to their feelings, as the amount that has already flowed into their coffers from its postponement far exceeds what they hoped or desired to obtain to make up for the heavy losses which the rise in coals and in oil had inflicted on their exchequer. With that consistent liberality and regard for the interests of the public which they have always evinced, we understand that the mans- gers of this rerpectable concern do not intend to add the surplus thus unexpectedly obtained to the modest reserve fand, which they have laid by to provide for anforeseen contingencies. Derirous to make their kind and iudalgeat patrops, as the phrase goes, participate in the benefits which have already resulted from their recent judicious. alterations, they propose opening a ie ferry be- tween Atlantic street and Hamiltoa aveaue, the preparations for which we believe are al- ready commenced. As soon as the necessary arrangemente are completed, another alteration itis said will be made in the fares of ali the boats under their jurisdiction, so that the com- pany will in this way keep pace with the pro- gree of population and traffic, und open up new facilities to the inhabitants of Brooklyn The quarter which the new ferry will serve is, to be eure, at present rather scant ot inhabitants; but aa itr residents are principally from the Eme- rald Isle, there is uo doubt that they will ra- pidly multiply and render it prolific source of revenue. to the company. Whilst awaiting this result it will of course be necessary for the dirctors to lay cn an additional penny on the fures of the other ferries, for it would be ob viously against all calculations of prudence for them again to encroach upon their reserve fund, ‘There will probably be another rise in Lockawanna and blubber, and they must not be caug:t unprepared for any more disastrous fluctuations in the whale market. They cai- culate, and we think with reason, that the cre dulity and forbearance which they have jast experimented upon with so much euccesa, may be sgain drawn upon to further their «chemex for the public benefit, and rendered in futare a fruitful field for their speculative philaaturopy. it isrefreching to meet with such disinterested instances of self devotion ; and that, too, at the mall diecount of eight per cent!
