Full Report of the FOURTH DAY. The Court met at half-past 10 o’clock yesterday morn- ipg, Major General Seott presiding. Major Joha F. Lee, Judge Advocate, read the record of aed, Q What officers wore left on the wreck when the Kilby Aepanted from her? + Wyse; et Lieut. W. A, Winder; 24 Lieuts. 0, Wi Col. pet ace to the court taste art of the sestimony of the witarss of yesterday appears to me to Fermntet oe the record. He said Capt. co anxious to lie alongside the steamer for water and provi- sions. The court recollected that the witaess 60 said, and directed it to be recorded to day, Q Where were the medical officers? A Both on the Kilby. Q. You bave explained why Sargeon Satterlee was there. Why asd by whose orders was Assistant Surgeon Wirtz there? A. Ido not know Q. Was there sickness in the command? A. Not that! knew at the time; certainly not to any extent. Q. Did you, the adjutant, or Col. Gates, the comman- der, make any inquiry of him ia regard to fis being on the Kilby, or take any notice of ii? A. 1 did not officially; whesher Gol, Gates did, I de not know. Q. Did Colonel Gates know he was thre? A. Yes, be rust have known it. The witners then made the following statement:—I have seid I did not take official notice of Dr. Wirtz beu on tke Kilby, but I asked bim hew he came there; think it was om the morning following our on the Kilby when I firs him there; Iaaid, ‘ Doctor, how came you on board ? I did not know that you were here;”’ or words to that effect; his reply was, to the best of my recollecticp, that Ms jorWyre had refused to let him come for rome time, bat had finally consented, or that he hai slipped cfl, or come off, which it was I do not recollect; it wae only iv pasting that the remarks were made, a while we were expecting, in s few hours, to see the steawer again; I thought but little of it. ‘ofessional Q. Did the assistant sargeon allege any ressom, such as th previdleg of medicines for the men transferred from thi to the Kilby, as « reason for his being on board . ine latte:? ‘A. He did not to me; I beard of such reasons in our conversaticn it is due to Doctor Wirtz to aay that he was himse f something of an invalid, sutfering from neu- ralgis, aw I ucerstood from him, some time before we left the steamer. Q Youspeek of expecting to seo the steamer agaio in & few hours: was this before the conference? A. Yes; this was early in the morning—the conference was esrly in the forenoon of thai day, Q. Do you know whether Colonel Gates knew at the time that both the medical officers had left the steamer? A. I do not know that he did; Ido not remember that I raw Dr. Wirts that evening on the Kilby. Q. You have said that there was no sickness in the command before you left the steamer: was there measles Cor ates disease there or on board the Kilby? I heard of one case of varioleid from one of the mristalent think it was Dr Satterlee; I think one of the children of Col. Gates had the measles when it osme on the steamer in New York harbcr. I eould only jadge from the appearance of the obild; itwas, as I belisve, recovering from measies; another cbild of his had the measies on the Kilby, from whom my children and the others took it, Q Did the troops or other adults take it? A. Not to my knowledge while at cea. Q. Was or was not any aivice or remonstrance in the matter of tsking bis children on the steamer addressed to Col. Gates by the medics! officers ? A. Dr, Satterlee addressed an official letter to me as Adju- tapt, on the subject, which see ai offisial copy, was ket at sea, with the records of iment. The origieal letter I gave to Lieut, ‘Tarde, of of the Third Artil- lery, who is june to the Pac fix. Q. State its contente. A. The ‘etter stated that the wri’er had lesraed unoM™- olaliy that the measles were prevailing among the child- rep of some of the officers about toembark. That if such was the fact, those children ought not to go on board, nor any children whieh bad been expored to to take it; that he ceemed the meastes on shipbo: adults, quite ‘as bad, if not wore, than swell pox. That is the iyub- stence of the letter, to the best of my recollection, Q fe ou deliver it to Col Gates? A. I did. Q. What srswer did he make, and what action did he take !n,the matter? A. He read the letter and replied to it i> substance that his children mustgo; that ne did not deem the meseles of any itaportance, or a trying matt+r, or word to tbateffect. This was st Jadson’s Hotel in this city, on the forenoon of the 21st of Dec., between 8 and 10 o’clock; the cay the troops went on board, hose wuthcrity was the lower steerage, which @culd accommodate 317 men, used as @ store toom for logge ge? A I received no instreetions from any superior oficer how to load the ship, or where to place the baggage, ex. ot pt the generél inctructions from Colonel Gates, to yee the baggsge o/ companies so that those designeted to be lacded at San Diego, might be reached fi sai torestsn troops to the porition they were to cecupyon boar the thip. ‘Toe baggage wao placed in the position yoimied cut by the cflicers of theahip ani the quarters of * en were also pointed out by them. Q. Was there aay sickuess of an ope-lemic uacure then prevailing? A. There wns no other disease aprroaching to an epi- Cemic, with the Ford danaglad of one case of varioloid and one of smallpox; I sai there any oes Cinbatt premouitory to that dines calied cholera? . I knew of none; my attention was not called to any seam until the two I mentioned, the day ‘ollowing ths departure of the Kilby; any cisease previous to that did not come under my ol ‘tion; there might have been, but I did not bear of any; I presume that there was none excepting these two cases of emallpor. It ia my impression thas it was a! leven o’clook in the day when it com iera aselstod, but without any order or they were gathered in the nsighborhooa room; my {mpression is that it commenced without any directions from any of the officers of the ship; it wes a v-luoteer thing, and was not done by the order of y of the superior officers cf the troops; i. commenced arly a3 ten o'clock; after the baling had been going on for reveral houre, which ‘would bring us into the night of the 2éth, the purser and myself weat into the engine room, cverlocking the baling, and wo agreed that the eoldiers would work better if they bad on officer to super- I ee and told him; he salé:—“{ came for th: Yery pa pore;’? from that time there were sommi*sioned cere Ke euperin- tend the daling; previously there were none butmon com- mirsioned officers, and the soldiers dic mot work as wai as thoy would with coramissioned officers, Lieutenant Freeman secalled.—Q.
