Tuckerman, that for the purpose of Treventing a breach of ths peace, and at the earnest rolicitetion of the plaintifi’s wife, they did arrest the plaintiff, on they were in duty bound, and locked him up for the night, and the next morning the police magis- trate committed him to prison for eight days.
