cerpee almost atoned for the offence by which its possession was too frequently obtained. Now, it is to be hoped, we are sensible and en- lightened enough to tolerate dissection. All who can read at the present day know that a surgeon, to operate with precision and suceess, must possess a thorough knowledge of anatomy, which can only be gained by a study of the human frame-+a study not in books, plates, or wax, but in the flesh, bones. muscles, fibres, veins, teguments and elements themselves. If, therefore, we wish to be able to rely on our surgeons in case of necessity, we must throw no obstacles in the way of their acquiring the information and knowledge necessary to ope- rate. In other words, we must help instead of hindering their practice of dissection, and we trust this is what the Legislature will do. Tue Garpner Case—Mysrenious Busrvess. —It appears that the papers abstracted over a week ago from the documents of the government in the trial of Dr. Gardner, at Washington, have been given upas lost. The counsel on both sides, the jury, and the court attachés, having given in their affidavits to the extent of their ignorance of the thief, it was agreed that the missing papers were irretrievably gone. The following is the affidavit of the jailor— (ir. Bradley is one of the counsel of Dr. Gard- ner’: ~ domes M. Wright, jailor, being duly sworn, says: — On Friday evening, atter ‘the court adjourned, Mr. Fendall and Mr. Redin were in the coure-rog™} Mr. Bradley bad just gone; Dr. Gardner was a little be Jore Mr. Bradley; Mr. Feudall asked me to call Mr. Bradley back; ‘dia, and he came back; Dr. Gard- ner nad pagers in his hands—yellow pagers aud newspaper bopdle; he went on to Mr. Bradley’s of- fice; Mr. Bradley and Mr. Fendall went to examining papers on the table in the vestibule, and I came iavw the court room; the jurors had lett the court-room ; and I think Mr. Bee Mr. Fendail, Mr. Redia,aud Dr. Garduer were the last _persoos that I recollect being in the courtroom ; Dr. Gardner weat out just before Mr. Bradley, leaving Mr. Fendall and Mr. Redia behind. J. M. Waicur. Curious piece of business, and certainly indi- eating culpable negligence on the part of the prosecution. The missing papers were the mining title of Dr. Gardner to those mines of his in Mexi- co, and the five depositions sustaining it, all of which were charged by the government to be forgeries. In lieu of the mining title a copy has been admitted by the Court ; butas nothing is left but the English translations of the five depositions in Spanish 'those depositions are out of the case. Mr. Bradley regrets their loss, be- cause he says it deprives the defence “ of the opportunity” of proving the anthenticity of those papers. Mr. Bradley is a wag, and his dry humor is at times perfectly irresistible.
