Means & Clark, of Bos- ton, owners of the brig Richmond, come in and defend the claim, and they admit in their answer that the libellant bath demanded of them payment of this claim, as alleged in the libel, and that pay- ment was refused; but the respondents deny all knowledge of the services charged against their brig; and they allege thatif services were performed as master or mate, that the same were rendered on the personal credit of William McKenzie, the for- mer owner of the brig, and father of the libellant, and that no credit whatever was, by the libellant, ever given tothe brig, aud that no’ services were, by the libellant, performed for the brig, or on her account. It is further alleged in the answer, that Wm. McKenzie, of the State of Maine, while build- ing this brig, received advancements in mouey to enable himto build said brig, and said advance. aents were made ab<he request, and with the know- ledge ofthis libellant.to his father, William MeKen zie; and that on account of such advanvements to William McKenzic, he did, in the month of Septem- ber, 1847, execute and deliver to Means & Clark a bill of sale of half of the said brig; and afterwards, to wit, on the 13th of May, 1550, said William McKenzie executed and delivered to Means & Clark a bill of sale of tho other half of said brig, all of which was then well known to this libellant. The proof in this case, to sustain tho libel, comes from the father of the libeliant, William McKenzie,whose deposition has been read in evidence, and this de- position, uncontradicted and unexplained, goes far to sustain the allegations in the Tibel, and indeed supporte it at all points. But the Court cannot over- look the circumstances and proofs which coun- teract the influence of that testimony. These cir- cumstences and proofs satisfy the Court that the demand set up in the libel is an unjust demand. On its face it is astale demand; at any rate, most of it is of that character. Masters and mates of vessels do not often permit their wages to run on, voyage after voyage, without asserting their right to wages, and in this cage the freizht earned by the brig stands unaccounted for. The legal presum tion is that the wages have been paid by the freight money earved on the several voyages perfurmed by the brig. It isan equitable Pennneon also, that the wages are not due. The libeilant was agent of the father who piocured the advancements to be made to him by Means & Clark to build a brig, and thore has been satisfactory proof in the case that the earnings of the brig were to be paid over to Means & Clark, in the reduction of these advance- mente. This bas not been done. The libellant was privy to that arrangement, and being master or mate of the brig, and constantly engaged in all mat- tersin regard to the brig, with his father, it is fair to resume that this libellunt was performing his services for the father to carry out the stipulations and understandings of the parties, that the earnings of the brig should be a lied to reduce the debt of Mcans & Clark. ‘his idea is strong- ly confirmed by the fact that when each bill of sale was executed by Williffa McKenzie to Means & Clark, that no mention was made by this libellant that he held a claim on the vessel. Te isa general principle, founded in law and equity, re- o-by all courts, that when a person stands by and witnesses the trausfer of Pec persy trom one man to another, and withholds all information of a claim of his own, he looses his right to the property thus transferred. He is bound, in such a caso, to give notice of his claim, that the aero may not be deceived by his silence. In the present case the libeliant is the agent to procure the respondenta to advance their money to his fatheron the credit of the brig—he undertakes, with bis father, to aid im paying off this money, and then he stands by and sees the futher transfer the brig to Means & Clark without intimating any claim in hisown behalf, and they take the brig as sceurity for their debt. It is too late for the libellant_to set oe a ea right to that which he has himself aided, and as may be a said, hae been the principal instrument in placing on the brig, while he has permitted his own claim to lay dormant until the vessel passes into the hands of an innocent purchaser without notice. ‘The father and son have so demeaned themselves, in regard to the claimant's rights, that it would be a fraud now to seek to divest the claimants of their title to the vessel. The libel must be dismissed, with costs THR WILLIAMSBURG FERRY CASE. y Company vs. The Steamboat —The libeilants are an incor: porated company, under an act of the Gencral Assembly of the State of New York, and their steam ferryboats ply between Williamsburg and Peck slip, New York; they were the owners of the steam ferryboat Oneota, which. on the 20th June, P51, was made fast to the buikhead. on the Williamsburg side of the East river, at or near the foot of South Eighth street, in the village of Williams- burg. undergoing neoertary and necdful repairs; that di- rectly above the Oneota she was protected by the long South pier, which guards the Jackson street ferryboats as they enter their dock cn the Williamsburg side of the river; on the outer side of the Onvota lay a float. or stage, made fast to the Oneota. upon which the men were stand- ing while the repairs were being made; the pier immedi- ately above the Oveota extends more than one hundred feet into the Fast river, at right angles with the bulk- head or wharf to which the Oueota was made fast; and at the time of the collision. a plank run from the pier to the stern of the Oncota, upon which the workmen passed and re passed, while the repairs were going on. ‘There was no controversy about the facte thus far, The answer of the respondents admits that they are the owners of the steamboat Cheises, and by way of defence, the answer al- leges that at the time of the supposed collision, the tide was running strong tlocd, and from the formation of the docks vessels bound up the East river would set in to where the Oncota lay. They allege. turther, and make it « prominent part of the defence, that the Oneots was in an improper ple, aud that she had and detained along side a stage, or tloat, which could and rhould have been removed. Hut this was not dove. andthe master of the Chelsea ported his wheel to wear round to regain his intended course down the river, He assigns as a reason for this manoouvre, that he might have run foul of the end of the long pier, and injured, and perbaps sunk, his own bost. ‘This was an insvfficient reason; first, because, by any proper ekill, the Chelsea might have beon carried up the river past the pier; and if his wheel had been kept hard a-+tarboard she would have clear, with very little loss of time; and second. the reason was insufficient, because no man has a right to destroy his hbor’ perty in saving his own. It is not only immoral, to avoid an impending disaster, ‘and w it upon another, Suppose the Chelsea had, in that critical moment, yielded to this law of morality, and permitted herself to run foul of the pier, when, to the convictions of her master, Ubis was inevitable, what would have been the consequences? The Oneota would have been saved. and the Chelsea would have reccived the damage. It is believed that such 4 result might have been quite as consistent, as to have shifted the misfor- tune from the wrong doer to an innocent party. To save the Cheises from this disaster, she is rounded too, by order of the master, for that avowed object, when the consequences of a collision with the Oneoia were even to him certain, It would have been more magnanimous, and think much more just, tor the Chelsea to have token the risk of running’ foul of the pier herself; but even that might have been avoided, if the master, instead of rounding to. had kept up the river, and saved both. But there is still another error, too manifest to be passed over. ‘The moment the Chelsea found herself animanage- eble, with these difficulties in her way, she should have let go her anchor. and that of the schooner also, and remained until the tide should fuvor her escape from hazard to herseif and danger to others. This was neither done, ner attempted. This was the first great errer of the Chelsea. and as this was followed up by the subse- quent errors, which, in my judgment, were palpable er- rors. she must be deemed in fault, and the decree must be for libellants, with au order of reference. United States District Court. Before Hon, Judge Betts. Jury 18 —The Grand Jury, of which W. FB. Beard was foreman, were empannclied. The Judge, in briefly ad- dressing them, said that this was not the regular diy for calling them together; but in consequence of the state of the calendar—pineteen prisoners being in jail, and the weather rendering it necessary that they should be dis- poeed of—it was decmed necessary to summon them None of the cases, however, wore of an aggravated cha- racter. Some were for mutiny; two or three for counter- fciting «mall change; and some assaults and larcenies on the high scas. There were three cases of complaint egainst the masters of ships—two American and one Hritish—for carrying {more passengers than allowed by law, in proportion to tonnage. For this offence. in addi- tion to the penalty against the ship. the captain is pun ishable by fine and imprisonment. ‘The Grand Jury then retired, to dispose of the bills that were sent before them. From California, the accounts are more interesting and of more consequence, ‘The Ilinoia brings two millions one hundred and fifty thourand dollars in gold dust, of which $1,650,000 wason freight, and $500,000 in the bands of passengers. This is the most important item of news she brings. From the mining regions the accounts are satisfactory, and shipments of gold dust are likely to be larger than during (he corresponding season last year.
