Horse Stealing—rrest of the Thief—On Monday a man named Daniel Cogshal went to the horse market at Bull's Head. and there made a bargain to purchase a horse for $200. belonging 10 James MoUlay. Cogshall, pretending to bea real purchaser. got permission to ride the animal around a block or two, for the purpose of trying him; but. instead of returning. hoglrove the horse to the Providence boat. and lett that day Yor Providence, Rhode Island. The route of the ue was ascertained, and a telegraphic despatch forwarded. ordering hix arrest. Mr. John Anthon and Mr. Noble appeared for the defendant, to oppose uny further proceedings in thia court The former argued that the indictment should be quashed. being, in tact. a second indictment for the same offence, a guasi criminal proceeding being now pend- ing im another court; and that the writ was a valid and eflectual writ, until quashed or revoked by the court above. Mr. A. Oukey Hall replied—The civil rewedy was a distinct proce: ding altogether; it was under the common Jaw in the nature of anindictment en the part of Uie peo- ple on the relation of the plaintiff. But now, uader the revired statutes, it was not so, and the only indictment they knew of here was that for a misdemeaaor in taking cia poeta with « multitude of people. It was not found on the part of the plaintiff but on that of the people of the State, for an offence committed in detiance of that people, and in violation of law. The curt inti- mated that the District Attorney need only arsue as to the point. whether they could have a certiorari; and Mr. Hall referred them to the statute by which it wis ex- prestly taken away in allcases.
