Belknap & Co.. $100, being the amount of a judgment recorded against them for a violution of the Corporation ordinances, Jin precedent of this character is to be established now, it will prove mort injuricus in its tendency, and every party guilty ot ating the ordinances, and who have been fined therefor, way. with great propriety, claim to have tho amounta puid by them refunded. Apart from the pernicions principle which this act. if consummated, would confirm. it is illegal in its operation, All fines and penalties collected by the city are pledged to the Sinking Fund, and cannot be drawn thence, and, in consequence, thisamount must be drawn from the city treasury. The charter exprestly declares that no money shall be drawn from the city treasury, except upon a specific appropria- tion, and there has been no appropriation to meet this case, and tho revolution submitted could not legally bo carried into effect. But if the plaintiff was bound by these notices, then another quettion arise, whether the knowledge of these notices was brought home to the plaintiff; and thea, even if he had knowledge of the order. was it not waived by the act of the conductor? If the plaintiff was in the Post Office part of the bagyage car, with the knowledge and as- sent of the conductor, then. in my judgment, the plain- tiff was not guilty of negligence in being there. The case is not one for vindictive damages—not one for pun- ishing the defendants; but, if your verdict is for the plaintiff, it should be such as wiil afford to the plaintiff » Teasonable compensation for the injury which ho has sus- tained, having reference to his condition in society. Many boarding house keepers labor under tho erroncous impresssion that they have the legal right to detain tke trunks and clothing of porscas who aro indebted tothem for board, but tho casa below will settle the question. The boarders, man and wife, had paid # part of the board due, but could not make up the balance.
