M., and arrived at Monterey, at 8 P. M, same day. She left that port at 11 P. M., April 6, and saw a steamer bound up, supposed to be the Oregon, from Panama, At 11 P.M., the G. G, came toanchor off the Island of Catalena, and remained till 834 A. M. next day, On account of a dens» fog she could not make the port of San Diego; and while endeavoring to do ¢o a portion of the machinery got out of order, which Mr. Bills, the chief engineer, by the most arduous exertions, succeeded in repairing, with a doten- tion of eighteen hours only. The Golden Gate saw the clipper ship Northern Light on the 10th ult, 480 miles from Acapulco, She was bound to that port for the remaining passengers of tho wrecked steamer North America. The New Granadian bark Isabel, from Panama, with one hundred destitute passengers, waa at Acapulco on the 13th ult, ‘The master had no provisions or money. She had been there six weeks, The Golden Gate passen- gers subscribed $640 for the destitute passengers, ‘The mails from California had a narrow escape in com- ing down the Chagres river; and nothing but the exer- tions of Major Ferris, the mail agent. and his assiatants, ‘aved them. San Francisco, April 5, 1 Summary Trial and Execution of a Merican—The California Signora Biscaccianti—The Yield of Gold—Increase of the Populatton—The very latest News, &c. ‘The mail which will leave here to-day will convey to your readers intelligence of the arrest, trial, conviction, condemnation, and execution of a Mexican, named Carlos Falava, for the crimo of theft, at Mokelumne Hill. on the Ist inst. This is tho first execution that has taken place in that region since the settlement of California. ‘The criminal, in this instance, was a most hardened wrotch, and, by his own confession, he was guilty not only of the crime for which ho suffered death, but of many others, ‘The circumstances under which hoe was arrested, tried, and convicted, are as follows :—For a long time, robberies were of frequent and alarming occurrence in tho vicinity of Mokelumne Hill. Tents wore cut open and robbed when least expected, and when their owners wero but 9 short distance from them. Measures were taken to ferret out the robbers, both by the Vigilance Committee and other citizens, but for some time without success, At length, a few days ago, circumstances tended to attract attention to Carlos Exlava, who was several times seen in rather suspicious proximity to tents or houses which had been robbed or ent open, and uponall of which occasions he managed to get off, by pretonding to bedrunk, He ‘was tried before the Vigilance Committee, and found guilty. In fact, the testimony against him was so con- clusive that he admitted his guilt, and at once abandoned the pretence of being intoxicated, which he maintained when his trial commenced. The re- sult was that he was convicted and sentenced to be executed. Accordingly, at fifteem minutes to 3 o'clock in the afternoon, the prisoner was brought down for oxe- cution, accompanied by a large guard of the Vigilance Committee, who marched six abreast, Eslava betrayed the most dogged indifference to every preparation of death him. rything having beon arranged, one of tho Excoutive Committee stated to the people that the prisoncr before them was the only ono ever in the hands of tho Vigilance Committee against whom such positive proof of guilt had been adduced as in the present instance; and deeming an example neccesary to warn other evildoers from similar crimes, Eslava had been condemned to dic. The State is infested by vil- lains from the four quarters of the world, whom nothing but the certainty of terrible punishment will prevent from robbing and murdering. Blackstone points out at length the law of succeesioh to the throno of England; but says that, if certain emergencies should occur, the times inust provide the remedy. We have laws enough here, but there are cases in which it would be folly to wait for the law to take its course, We will suppove a case, Bristol Bill, if here, could effect an entrance ito any building in California, After plundering it, he might, if so dispored, set fire to it, and perhaps destroy the whole city. If canght in the act. he would be ar- rested. But what would be the use of putting him in confinement? ‘There is not a prison in the State that he or an ordinarily expert burglar could not escape from, In fact, it is a perfect mockery of justice to confine a cri- minal in them.
