Th pertormencee for this evening consist of four excellent piecer, namely, “Irish Conjurer.” “Kate Kearney,” “ Alive and Kicking,” and the “Golden Axe.” Amexican Mus The excellent farce entitled “Portune’s Frolic,” and the fine comedy of “A Day Well Epent,” are to be represented at this popular eet@lishment this afcernoon, forming & very attractive entertainment. The moral drama styled ‘The Bottle,” and the lavghab'e farce of the “wo Bonnycastles,” will pe given in the evening. “The Bottle” continues fo attract very large assemblages. It is decidedly the most alluring novelty that Barnum bas offered this season. Bowrny Cincvs—This spacious and elegant establisa- ment continues to be filled every night. The Freach troupe are greeted im their performances in the most enthusiastic manver; and Mr. Sands and his talented pupil, Maurice, are the delight and admiration of all Crmusty’s Mixstrris —It is really astonishing to wit- nesa the crowds which rightly congregate to greet this unrivalled band of negro performers. Proresson Anpenson.--We would remind our readers, that the talented Protessor will close his soirées on the 6th of February; and also, to look out for his last night, when the great conundrum prizes of six hundred and fifty dollars areto be awarded. He is to give an after- noon performance on Saturday next. Mr Quacve takes his benefit at the Chinese Maseum, Philadelphia. Osiax E. Done, the vocalist, and his troupe of sing- ers, intend visiting Portland. Loa Montes, we understand, has gratuitously tender- ed her services to the Association for the Retief of Disa died Firemen of this city, for a benefit in aid of the fund of the association, to come off at the Walnut street thea- tre, on Friday er Saturday evening of this week. This meritorious association, we understand, is much in want ‘of means, the calls upon it for the relief of the disabled and destitute being unusually numerous. At New York she gave her services in aid of the funds of rimilar as- sociation in that city,and realized for it about $1200. ‘This truly generous conduct won forher many friends there, and goes far to establish what we learn from those who know her best, is her real character, namely, that of a lady of rensibility and great goodness of heart. But the law required, strictiy, no notice at all ‘The Corporation. by the very terms of the law, were made the judges .of the necessity or expediency of ori nnd directing the pitching and paving of the streets of the city, and divers other matters relating to the health | and comfort of its inhabitants; and io ail cases where they deemed it neeessary for the more speedy execution of their determinations, they were authorized to cause all such works as might be necessary for any of the puc poses aforesaid, to be executed, and done at their own expense, on account of the persons respectively, upon whom the same might be assessed, &c. However repre- bensible, therefore, may bave been the carelessness of the Street Commissiouer, it cannot invalidate the erdi- nance which directed the work to be done. Next, as to the fraudulent conduct of the contractor and inspector, there is no dispute on this point as to the mere fart. ‘There is a fair presumption, also, that these two persons conspired together to light the work and divide 5 a 8 £ 5 the profits between them. The verlict of the jury is substantially to this effect. But the iteTats te knew all this before the assessment was confirmed. They so admit in their complaint. They go further. They allege that they put in a remonstrance, and were heard before a committee of the Common Veun- cil, that they madeout «clear case of fraud, and that one or more of the members even personally examined the premises and saw and knew the fraudulent man: in which the contract had been executed. The commit- tee, notwithstanding, decided against mterfering with the assessment, and the Common Vouneil confirmed their decision. Thus, it will be seen that th’ parties have al- ready once been heard before a Gaba Jurisdiction, They brovgnt forward, or should have brought forward, all their ob objections. After a full hearing, the case, most unjustly es they ailege, was decided against them. Still they did not appeal. veal, They sued out no writ of ‘certiorara”’ to reviee the chyectionable determination. Canthey now collatert call that determination in question? The Court think not. To apportion the expense justly and equitably is the end to be accomplished, aad for this purpose the Corpo- ration, it is further provided, “ shail appoint such ekilful and romienen disinterested persons as they shall or may think proper.”’ No particular number is required, ‘That, as well as the selection, is left entirely to the cis- cretion of the Common Council. Before entering upon their trust, they are to take an oath “to make the esti- mate and assesment fairly and impartially, according to the best of their skill and judgment.” There is no com- plaint in this case that they did not doo.
