RE-BUILDING WASHINGTON MARKET. On motion, the reperts, majority and minority ones, and all other papers connected with this subject, were taken up. Several remonstrances against the proposed erection were read, containing, in all, signatures to the numberof six hundred. The grounds of opposition, and of the minority report, were, that the required acoom- modation might be gained by changing the site, as sug- geeted, the great outlay required, $370.000, and that the Pernice. and the receding up town, the mar- ‘will not long be required there ‘The adoption of the majority report in favor of rebulld- ing on the present site, was moved by the Assistan Alderman from the Fourth. The banger Alderman from the Third moved th adoption of the minority report ar an amendment. Acsistant Alderman Ely boped the subject would be re- fi rred back to the committee, who had ‘a very short time, and would, he thought, on reconsideration, present a better report ; and he thought the gentlemen of the committee, h they could not get up and move it themselves, would have no objection to this courss. [From the New York Journal of Commerce } ‘The Hudson River and Harlem Kuilroad tracks wore laid in streets of the city, under special au- bows» derived from the Le, itiature. ‘ne power was fettered with the condition that the Common Counoi! should assent, and that assent was given. The sovereign power of the State acted through its chief instrumentality, the Legislature, and its sub- ordinate instramentality, the local city government. The right, therefore, was complete, according to repeated decisions, long acquicsced in. An ao; tion is now pending before the Common Council, to authorize private persons to lay down rails on the Second avenue, and elsewhere, and use them for their own vehicles, to exclusion x all Card 3 nh. it . The recent exercise of this power in the oases of the Sixth and Eighth a , shows that the Common Counci rtain no doubt on the sub; and a repetition of its expected whenever sufficient motiv. tothem. The question is of the highest conse- quence, for it involves the subjection of every public street in the city to use by private individ aa special and impo: tant manner, the public. Cities are part of tho political maohi- nery of the State, for carrying into effect the politi- cal power ; and their authority is expressed either in charters, or in laws passed by the Legislature. No powers are possersed but such as are tha granted. They are the mere creatures of ive authority. The charter of New York, ast came origivally from the British crown, was kept alive by an express provision of the constitation of this State, and consequently the powers of this city are to be looked for in its original charter. It will be conceded by all, that if authority to the Com mon Council to devote the streets to this purpose is not found in the original charter, or in its amendments, or in some —an act of the Le- islature, it doos not exist at all. We are satistied frat the power does not exist, and that the ordin- ance in relation to the Sixth and Eights avenues railroads is wholly void. Tho charters and laws assed by the Legislature, go into detail in re- jation to the streets, so far as to declare the width of areas, the proportion which sidewalks sball bear in width to the whole street, and to authorize steps leading to bouses Po gey into the street. The original charter of 1636, so far as applicable to streets, confined the power of the city to ‘establishing, laying out, ordering, amending and repairing of al streets,” &o. The General Railroad act guards the public against abuso, in case the right were acquired under it; but there would bo no propriety in conferrin it even under that act. The only possible Jeni cation for authorizing the Hudson River and Har. jem roads to use the streets ae they do, is the urgent — soo ane great importance of holdiog out an- usual ilities to the great lines that have been established, to promote and enodurage the travel and trade of the city—objects on which our prosperity in great part dopends It is m deviation, under the express power of the statute, from what is usual and per in the use of public streets, and is justified only by great necessity. The Common Council have granted the right to rails in the Sixth and Eigh' for an in the public streets ; 5 eons in each case, and they are to break up the Sooo, lay down rails, and ute them with their own cars, and exclude all others from the same use. We make pe objection, for we know of none, to the par- ticular persons who have received this power, nor to those who ask for it to be applied to the Second avenue; the objection is to confering this power on ody of private citizens. The mode of the question be- fore the courts, is either by indictment against any temporary or permanent structure put in the streets under a void and illegal ordinance, or by injunction opeied for by owners in front; but the Corporation sbould resume the authority, and arrange some mode of establishing such roads, that retains wholly the public character of the streets in every part and 1 of them. It would require some legislation during the ensuing winter to do this ade- quately; and it would be proper to amend the Gie- neral Railroad act, and strip the Common Council of authority to grant the right t> any body incor- porated rit.
