T learn, from a reliable source, that the Spanish Minie- ter has been instructed by his government to propose to the government of the United States, that the Spanish Consul fermerly at New Orleans, shall be invited by our government to return to New Orleans, in a United States war veerel; that the Spanish flag shall be hoisted over him on said vessel, and be saluted at New Orleans; that the aforesaid Spanish Consul and the Spanish residents at New Orleans shall be amply indemnified for the in- juries tbey received in their property by the New Orleans populace, at the time the news arrived at that city of the shooting of Colonel Crittenden and bis comrades by “the order of the Captain Genaral of Cuba; and that, if these demands are not complied with the Minister Calderon de la Barca, is instrueted to ask for his pars wep and return home to Spain. I learn, further, that ir. Secretary Webster has declined acceding to these demande, and that the Spanish Minister is laboring under great distress of mind on the subject. Our government has in its possession the proof that crittenden and his associates never had « trial. and, iso, that some of their bodies were mutilated after death ‘Nothing, of course, bas been done in the negotiations between the Spanish Minister and our Secretary of State, relative to the release of the American citizens who were the Captain-General of Cuba. That part of the ne; tion is looked upon by the Spanish government as a secondary consideration. One thing is certain—our government decides that Spain asks too much. Her Sade bane taen rejected by Mr. Webster, What step will next be taken remains to be ascertained. It will probably be the demand of the Sparish Minister for his passports, and his return to Spain. Nous verrons. Wastixcron, Nov. 10, 1851. The Demands of Spain. Extraordinary rumors are afloat respecting Cuba nego- tiations, That Spain has demanded # national ship to bring her Consul back to New Orleans is something more than mere conjecture. Nothing positive is known, ex- cept that Mr. Webster is negotiating for the American prisoners, while Senor Calderon de la Barca is insisting upon some eatisfactory apology for the scenes at New Or- leans and Key West. The cabinet, we learn, disavow those proceedings—they regret them, and propo.e to in- demnify all losses of Spanish citizens, but Reattere to go further, although the Intelligencer has been preparing the public mind for an ample apo! ‘The near approach of Congress, and sppeehensicoa ‘@ warlike attitude by the democratic majority, hold the administration back. ‘The worst has yet to come, Our Spectal Telegraphic Correspondence, Wastuxctox, November 11, 1851. ‘There is no truth in the belligerent rumors which have been started from this city, asto a hestile attitude having been arsumed by the Spanish Minister, and # threat that if his demands were not complied with he would ask for bis passports. It is understood he has demanded that the Spanish Consul at New Orleans should be publicly re- instated in bis office, and his flag saluted; and further. that the government should make goo4 any losses which he bas sustuined. In addition to this, it is demanded that the losses sustained by the Spanish residents in New Orleans, from the violence of the mob, should also bo made gocd. The demand, as far as the Consul is concerned, will doubtless be complied with. It is mothing more than justice. But the second part of the demand, for losses suataived by Spanish residents, will unquestionably be refused. All that our treaty stipu’ations require is, that Bpanish citizens residing here shall have the same protec- tion and legal redress as our own citizens; and no one needs be told that whatever measure of damages they may have incurred from the violence of a New Orleans mob, must be recovered from the municipal or State au thorities by regular process of law, precisely as our own citizens would seek their remedy. ‘There is not the slightest doubt but what the Spanish government will accept the preposition which is offered them, as Don Calderon de la Barca has too much good sense to insist upon a messure of redress which neither our treaty stipulation or the honor of the country calls for. As to the statement that the government is {nm posses- sion of information that Col. Crittendem had jno trial, it is unfounded. On the contrary, there is satisfactory evidence that he was tried by a military court, andergo- ing the same forms which are extended to Spanish mili- tary prisoners. Stocks may remain quiet, so far as the probability of a war with Spain is concerned. FROM ANOTHER CORRESPONDENT. Wasnixatox, November 11—P.M. ‘There is nothing definite respecting Cuba. This busi- ness will be laid before Congress in the President's Mos- rage, as far as circumstances may require Mr. Webeter will soon go out of the cabinet. NEW YORK. ‘The few official returns we have recelved, are, in the aggregate, favorable to the election of Patterson, whig, for Comptroller; but no decisive opinion can be formed from the first reported majorities, as they vary much from the official canvass. McAlpine and Storms run best on the democratic ticket. A day or two will probably settle the question of the majority in the Canal Board, by official returns. ‘The latest intelligence, by telegraph and the malls, intel a elects EI W. The returns of one election district are wanting to make the canvas complete, but the average vote, as far an known, is stated at 713 for the whig Btate ticket. ‘The supervisors of this and Monroe county are yet im ression, and will not finish the canvas, to-night. Frome Pertial examination of the returns from Monroe, it is safe to catimate thie whig State ticket majority at 1000 MASSACHUSETTS. ‘The vote polled at the annual Btate election, on Mon. ay, was the largest, by more than 8,000, ever put into the ballot boxes in Massachusetts. Returns are received from the entire Btate, except the three emall tewns of Hull, Dighton, and Holland, which will not make one hundred votes difference in the result. The election was for Governor, Lieutenant Governor, and members of the Legislature. The sense of the people was also taken upon calling ® convention to revise or alter the constitution. The total Governor vote is 137,253—three thousand more than ever before. ‘The whigs throw near 05,000; the democrats, 45,000; and the free soilers 28,513 increasing, respectively, from the last year's vote, as follows: —Whir, 7,765; democratic, 7,929; free soil, 844. Net whig loss, 1, 128. Mr. Winthrop has a splendid plurality of 20,000 votes, but is in & minority of 7,681 in the whole vote. The whole vote in the State for Governor, in 1850, was 121.472; of which Briggs, whig, had 56.873; Boutwell, dem., 36,023; Phillips, free soil, 27,636; scattering, 935— Brigge in a minority of 7.516. The year before, 1849, the total vote was 109,013; of which 58.718 were whig, 30,730 dem., 24,364 free soil, and 201 scattering—majority of all against the whigs, 1677. The largest vote ever cast in the State was that of 1844, when Gov. Briggs had 69,570; George Bancroft, 64.714; all others, 9,938 —total, 184222, Previous to that the vote of 1540 was the largest, being 919, The Presidential vote of 1848 was, Taylor, 61,070; Cass, 05 281; Van Buren, 38,058, There being no choice of Presidential Electors by the people in 1548, a majority being required, they were chosen by the Legislature, and voted for Taylor. Escape of Witnesses in the Treason Cases and Si) Circumstances connected therewith==Consequent of the District Attorney—Names of Surymen—The Hom cide Case. On Bunday morning. three prisoners escaped from the debtor's apartment, in the Moyamensing prison. One of them was a white men, committed for some trivial mat- ter; the others were black, and were two of the most im portant witnesses in the Christiana treason cases. They souled the wall by the aid of the shutters to their wim dows, fastened tegether by strips of blankets. In the District Vourt. this morning, Mr Ashmead, the United States District Attorney, appeared, and the Court of the escape which taken place. stated that the witnerces had been in prisom about two months drewing « dollar and s juarter each, # dey; and that the government was now owing them about eighty dcliars apiece; ard he mentioned, also, the extraordinary fact, that no notice was given by the jailor to any offleer of the government, of the escape of these men, until twenty-one hours after it had taken place. In view of these facta, he considered it his duty To'move the Court thet the remaining witnesses be removed from the debtor's apartment to the — prison; which motion was granted by the Court, ‘an order was issued accordingly. One of fhe witnestes who esaaped, Josephus Wood, had a family and some property near Christians.
