Tgwas in error yesterday im stating that the four prisoners were under examination at the same time. ‘The prisoners’ counsel, D. D. Hillis, had applied for a separate examipation, which the Court granted The examination of Moses Summers was proceeded in first end lasted all day. ‘This morning the Court was called to order by Judge Coneblin. at 10 o'clock. General Lawrence, the District Attorney, infermed the Judge that his witnesses were not then present, but that they would errive in the haif- past ten o'clock train from Syracuse; end the further proceeding was postponed until that hour. maga’ Cobb, who had been arrested. but was too unwell to travel the first day, made his appearance this morning, ond his examination was also proceeded in. ‘The District Attorney then called the names of his witnesses. but very few answered to the call. Mr Law- rence then requested that a warrant be issued for Peter May, of Syracuse, who had been subpornaed, but did not ar. ‘The Judge decided to wait uatil the arrival of ‘ae want iat, and i Mr May then fails to anpear, he will grant the warrant and, furthermore, will deal with Bim as the law directs insuch cases. John W. Jones was then called on the stand. and an effidavit read to him, which he acknowledged to be his, He was cross-examined by Joho G. Forbes, associate counsel with Mr. Hillis, the latter being unwell, though able to be in ecurt. Peter Way, Deputy Sheriff, was examined. His affi- davit, which is quite lengthy, was read, aud affirmed by him. He does uot positively identify any of the prison- ers, but thinks @obb put out the lights. Furniss assigned this insutance to the plaintiff. Of thet sum $2808 was demanded and received by the sheriff, out of the company’s hands, but paid by them under protest. The assignee contends that he gave notice of his rights previous to the attachment, aad brings bis action against the company on the origiaal policy, contending that they had no right to pay the theriff. Browne —-This was an action to recover $120, together with interest, borrowed in 1849 from George T Green. and assigaed by him to other parties, who sold their interest in the debt to the present plaintiff The defence was that the moaoey was Obtained for gambling purposes, and that it was an illegal debt. Verdict for plaintiff, $158 32 Superior Court, Before Hon. Judge Campbell. Ocr. 17.—In the case of Clark vs. Sylvester, Mr. Brady, on part of of the defendant. moved to dismiss the com- plaint. Mr. Jordan opposed the motion, and the Court tefused to take the case from the jury. Counsel then summed up the case, which, it appears, grew out of a stock jobbing transaction in which Clark alleged that Sylvester had cheated him Mr. Jordan, in his address to the jury, said that he would not go out of the case to speak of Wall street brokers, but he would , that the Wall street Mock jobber does not feel it m yat all times to consalt the nice distinctions of conscience in his transactions.
