He alse wrote to him on the subject, and the answer sent to the Court, he cannot attend now, bu: would be able to do so at the October term, Itis an important trial, snd the Court would see that it was of importance that the highest legal officer in the State should attend person- ally to the prorecution, Mr. David Grabam said that he had been only en- gaged in this case a6 @ au»stitute for the late Attorney He (Mr. G@) bad seen the present Attorney General, and also expressed to him a wish that he would attend to this case personally; and as there were peculiar features in it, he deemed it necessary ral should be present. He, therefore, united with Mr. McKeon in asking for a Postponement of the cause. ‘The Court said that, inasmuch as the Attorney ‘al had appointed a substitute, they could not grant the application. The District Attorney said, that point being decided, I move for 4 postponement, on the ground of the ab- sence of Mr. Thomas Warner. Every effort has been made to seourn his attendance without effect, and I do not think the court will deem it prudent to go to trial without the presence of Mr. Warner, who is the prose- cutor in this case. Mr. Hi. F. Clark, on behalf of Mr. Drury, remarked thet these applications seemed most extraordinary to them, though they were quite prepared forsuch efforts on the part of the prosecation to postpone the case; but the application on the ground of Mr. Warner absence was indeed extraordinary, for Mr. Warner had been seen ip the District Attorney's office since the commencement of this term. Avother counsel for the accused said that Warner bad been seon in the District Attorne; the last torty. eight hours, The District Atterney denied this assertion most empbatically. as far as his knowledge of the fact wont.
