Mr. Underwood, im medias res, way about pitching into the title of Texas, but was called to order, and Joba Bell satisfied hinsself with decloaring that Old Zaek was right, and would be fouad mighty obsti- nate in maintaining m statu quo the status quo and the lex loci of New Mexico. It does not sigaify a tiddle-stick whether Old Zeck understands these terms or not. He is no great linguist, but he has planted bis batteries on the status quo, and there he tatends to stand. It isa habit in the old man, and “*fire can’t melt it out of him.” Y hatis this status quo, this existing state of things am New Mexico? It is aperplexing question. The Homan questicn is easy, compared to it; the Cuba question is a Mathur; the Hayti question is @ mere tem per centum; the Portugnese question is @ humbug ; the Nicaragui question is a victory ¢t diplomacy, knotty as it will get to be after a wale ; the Cal fornia question is a stale dish; even the great dumfunghing sixpenny Greek question does not invelve the sequences of this New Mexican or Santa Fe question. It is an ugly question, a complex question, the question which, of all others, is likely to tua:ble the soup into the pie, where the ingredients are all in process of amalgamation hot fis this status quo which oid Zack is jledged to maintain? It is a power of Congress to ceolare war, aud to repelinvasion. What has the Lxeeutive to do with it? Simply this. By the <onsent of Congress, he is vested with the govern- rient of New Mexico, pro tempore. Congress fail- i) @ to provide a government, has left the country pretty much as General Kearny left it, under the hearny code, epplied under the instructioas of President Poik, us a temporary government. It was transferred to old Zack. Mr Crawford, taking another view vf the sfotvs (vo, ‘netruets the said governor not to inter- jere with the question, not to interfere with the ‘Texans if they came to mike good their juris- dictcn, but atthe same time he is to encourage the pecple of New Mexico to get up a State for them- selves, ix the face of the status quo. Well, he does encourege them to get up a State. 1. The first question is, was that right?) Was it right in the administration to organize a State ina termtory, the title to which was cla yy an- other State, and which has not been settled? Was. itexpedient? Svppose the new State is organized, and the question of title goes to the Supreme Court, and the court decides in favor of Texas? What thea? The remaining territory of New Mexico will not have one-half the population necessary for a State; and of course the whole thing will be a terce, and a most ridiculous farce. 2. The next question is, what right the President 4iad to instruct his governor not to interfere if Tex- as sshould attempt to establish her jurisdiction, when he believed the jurisdiction belonged to the Vnited States?) Was it not his duty to maiatain thai jurisdiction, he being vested with the disere- Uonary pow Was not that the way to maintain the status quo, in statu quo ante bellum? But what does he do? He invites the jurisdiction of Texas, and when “a certain Mr Neighbour’s, styling him- self a Commissioner of Texas,” gets up as far as Santa Fe, old Zack's military governor, holding the status quo, calls a State Convention for New exuco, and sends Mr. Neighbours packing home to ‘Texas, across the tearful desert of El Llanos Esta- cedo, or through the wild Apaches, dowa the Rio Grande. ‘That operation settled the lex loci as far as “Mr. Neighbours” was concerned. Doyou call this non- action, or non-intervention, or the leaving the ques tion of jurisdiction to be sett th d by Congress? Or is it forestallin, ion of Congress? What is Texas todo? She claims the territory.
