Some fow weeks singe, the District Judge, in the absence of Judge Grier, granted an injunction agaiast the use of # planing machine, because, as he held, it int:rfered with the Woodworth patent. The defendant, Barn has brought up the case before « full Court, and Teaeas that his machine is new and differs from Woodworth’s, and that he has patent for it, issued from the proper office, To maintain his case, he relies upon the opinions and judgment of the scientific officers of the gover ‘who have issued the patent to him; and he also relies upon the testimony of twenty-five or thirty mechani- cians, many of high standing, who prove that his in- vention is uew and different from Woodworth’s, Om the other band, Mr. Wilson relies upon tho testimony bout au equal number of persons, who testify, ad to the mechanical likeness of the two machines, ‘m that the patented machine of Mr. Barnum infringement. ‘T'o this testimony Mr, Barnum ine sists that it is not of weight, because the witnesses are, enerally, either persons now ef heretofore interested in tl ‘oodworth pat » 48 part owners, or in the em- ployment ot Mr. Wilson. On the other hand, Mr, Wil- son maintains that it is immaterial what is the testimo- ny upon the subject, as ke relies upon mechanical de- monstration that the two machines are, in principle, identical. ‘The above is a general view of the contest, and it is “a mighty nice dispute as it stands.” Upon the deeision of is will depend whether the Woodworth patent shall monopolize the planing of boards for the next feven years, or share the monopoly with Barnum, Although it is a great and valuable stake at issue, to the two patentees, the public have no further jaterest in it than the advantage of the competition betweon the two parties, if both patents shall stand good, ‘The argument com: don Lhursday, npon the motion to dissolve the ction snd order a jury trial, Judge Grier declared, ¥ in the discussion, that he was inclined to grant the latter, and to put the parties upon « fair equality in the meantime, by ordering such seeurity as should mutually protect both, intimating very decidedly that the hearing of the merits of the case should be adjourned to the trial. Mr. Seward, im opposition to these views, addressed the court at great length, and broaght all his experience aad leataing, in relation to the Woodworth patent, to bear upon the ints at issue, Mr, Staughton, of your city, opened in reply, but had not proceeded fac When the court re- peated the suggestions already noticed, and adjourned the cause until the next morning. to enable counsel to agree, if they could, upon the details, consistent with the views of the court. Yesterday morning, Mr. Staughton announced that the interview of counsel had been fruitless, and proceeded with his argumeat. Before he concluded bis address, Judge Grier remar that, in regard to one point, the court had no diff- culty; that they had determined to order a jury trial, to take place on the first day of the next term. Mr. Hust, for Barnum, then suggested that, in that case, the defendant would propose to let the injunction stand, to abide the result of the trial, provided that Mr. Wilson would give bonds in $10,000, with surety, to Mr. Barnum, to indemnify him from all loss and da- mage, to relate back from the date of the injunction. Mr. Seward assented to this, thus the two main points involved were disposed of. But the terms and details of the issue to be tried yet remained to be settled, and upon these points an animated igbtly discussion among the counsel took place. * part of the argament Mr. Stanghton won opinions, He is certainly a very ol speaker. The argawent being 0} both sides submitted their writer to the court, who w'll consider them, fair between the the cause are Wa. H. Sewar w. id do what ia parties.
