At half past 12 o'clock, the generals and officers proceeded to the New York Hotel to partake of refreshments, and at the same hour two large bodies of police proceeded from the theatre down Broadway in marching order. THE FUNERAL. It isannounced that the funeral of those who were Killed on ‘Thursday night, will take place to-day. The Coroner has not yet got through with the inquisition, and it is doubtful if the funerals taxe place. It depends, however, upon the time the Coroner shall have finished dis businces. Every night the house has been filled to its utmost capacity by most fash- fonable audiences, and the entertainments have been of the most elevated and refined character, consisting every evening, save one. of Shakspearian plays. The “Stranger” was played one night. Mr. Hamblin pro- mised last Monday evening that, if supported by the ic, he would give the Shakspearian dramas in astyle bars has never before been attempted in New York, and thus far he has done so; and what is more, has been Bal supported in his attempt. Broapway Treatee.—Mx. Forrest appeared at the Brondway Theatre last evening, in the character of Metamora, the last of the Wampanoags. This piece 4s one well calculated to display Mr. Forrest's peculiar style of acting. The play was written for him, and he has evidently studied well the part which he plays in it. The house was not crowded last night, but there was a very respectable attendance. Cincimnats, May 12, 1849, The Cincinnati national jubilee of the Sons of Tem- perance, which was advertised to take place on the 15th, is indefinitely postponed, in consequence of the alarm caused by the cholera, The remains of Judgo Brough were followed to the grave by judges of courts, members of the bar, odd fellows, typographical society, editorial fraternity, mili- tary, and a large number of respectable citizens. The board of health met to-day, at noon, and re- ported fifty new cases of cholera and five deaths, within the past twenty-four honrs. There is considerable dif- fence of opinion among the members of the board, as to whether it is the real cholera or not. The most cur- rent opinion, however, is, that nearly one-half of the cases are nothing more {han common diarrhcea, It has rained most of the day. The river has risen three feet during tho last twenty-four hours. Cholera Among the California Emigrants on the Missouri Frontier. Lovrsvinur, May 12, 1849. It is said that charges exist against a high officer in the War Department, whieh are being examined into, relative to frauds upon the government in the way of forged land warrants and other claims of dead soldiers, that had no existence, The Late Defalcation of Major Scott. Wasuixatox, May 12, 1849. ‘The defalcation of Major Scott, late Navy Agent at the Washington Navy Yard, is set down at about fifty thousand dollars. He had held the office for about fourteen years. Speculation is assigned as the proxi- mate cause. Illness of an Ex-Member of Congress. Wasnixctox, May 12, 1849. The Hon. Daniel Duncan, of Ohio, a member of the last Congress, from the Columbus District. is now lying dangerously ill at his lodgings in this city, where he has been confied since the adjournment. Ex-Governor Seward, of New York, has arrived from Charleston. The Catholic Council in Baltimore: Bautimorr, May 12, 1849 The Catholic National Council of Bishops adjourns to-morrow. They have been holding two sessions a day on busi- ness, at the Archbishop's mansion. In the morzing, none but the Bishops are present : in the afternoon, the theologians, one attending each Bishop, are admitted. It was intended to hold the next National Council ten years hence, but we leain that the unfinished busi- ness bas shortened the interval to three years, Bishop Hughes will preach in the Cathedral to-mor- row, when the ceremonies will be of the most imposing character. Affairs in Pittsburgh: Pirrsuvncn, May 12—P. M. The health of the city continues good, and not a single case of cholera has occurred amongst our citi- gens, although a number were brought here by the steamers. Businers continues very dull, and large quantities of steamboats are laying up for want of business, The Steamer Cherokee. Savannant, May 12, 1849. The steamship Cherokee, Capt. Present, the Chief Justice and Mr, Justice Sandford, av 12.—Drcistons.—James T. Brady vs, The Board of, Supervisors. This cause comes before us under the following ciroumstances. Plaiutiff was counsel for the Corporation of New York one or two years; during that period he was applied to by the Board of Supervisors In regard to thelr duty; he drew up various reports, nt. tended the Board whenever called upon, and in short, acted as the general adviser of the Board. For these services he commenced an action against them, and the ease was referred to referces, who reported « considera- ble sum in his favor; it is now brought before us to set aside the report. ‘The defendants set up a two-fold de- fence—first, they say that Mr. Brady was, bound to attend the Board of Supervixors in his character of counsel to the Corporat: nd that any services ren- dered to the defendants are covered by his salary as Corporation countel. We have not considered ‘this part of the case, because it is not necessary, We as- sume the position taken by plaintiff's counsel to be correet—-that thore is a right of action, and that he is not precluded by the consideration that he rendered those services as counsel to the Corporation; but the main ground of defence is, that no action can be main- tained against the Board of Supervisors, We think, under the present state of the law, this description of action cannot be brought, The report, therefore, must be sut aside. Leoni Sauzes ve The 8, Insurance Compan} this case, an insurance of $13, effected by the plaintiff. on one of his vessels, ona voyage to the Pacific Ocean, from thence to the West Indies, and from the latter ‘place home to this port. On her return home. the bark was wrecked, or so seriously damaged, that sho had to put into a port'of the West Indies. ‘The eaptain immediately informed the owners hereof what bad hap- pened, but in the mean time, he proeeeded to p some temporary repairs, amounting to about Bto00. On the 11th November, 1846, the day they revived the letter, they wrote back to abandon the vessel. The cuptain, however, tailed for this port on the 10th No- vember, the day before the abandonment was made,and the vessel arrived here without any further accident and was afterwards fully repaired here, at further expense of $5,000. Under these circumstances, the sole question was whether it was a total or partial loss. The defendant insisted that before the abandonment was made the vessel had railed, was then on her way to this port, and there was, therefore, no reason for considering her total loss. ‘The condition of the vessel, however, at the time of the abandonment constitutes the right to abandon, and it is clear enough they had a right to abandon her, unless they were bound to bring her to New York; but of this there was no evidence. It ap- pears that the captain, in putting on the partial re- pairs, acted for the best interests of all Hoe parties 5 and it would be unreasonable and contrary to the gene- ral rule, that no act of a maste ive @ mariner of his right of abandonment; that because he procured those partial repairs, to. be made for the benefit of all the parties, the owner should be deprived of his re- cognized right, if the vessel could be brought to New York without those partial repairs, the ease would be different. We think the repairs were made in good faith, and therefore do not impair the owners’ right to abandon, Judgment as tor a total loss, Perrin vs. Joknson.—In this case, an action was brought in a Justice Court, to recover @ um of money from defendant, which was deposited in his hands, on a bet made that a horse owned by plaintiff was brother to a horse named Jack Cade, Judgment was given for the Pisintiff, which was asked to be set aside, on the grounds —first. that the Court had no jurisdiction, the bet nof being within the statute ; and, secondly, that not being within the statute, it was not unlawful We think the bet was within tho statute which gives juris- diction of this action. On the other questien, the lan- guage of the statute is, if any bet is made upon an un- nown or contingent event, it is unlawful. Here the event was unknown ; and although it might be known to the plaintiff himrelf, he could not prove it; and, fur- ther, he was bound to prove it within a week, which it a double contingency. Judgment affirmed. John R, Peters, AAppellent, ro, Abrahem Frazee of ol. Re- syondents--This ease came up on appeal from ono of Justice’ Courts. The action was brought by the respondents against the appellant, for work and la- bor in building # cistern to 9 house in Pearl-street, owned by appellant. There were two defences set up; ono was, that defendant was not personally liable, he hav- ing only acted as agent; and, secondly, that thecistern, frum the manner in which it was constructed, was good for nothing. A verdict was given for, respondents in the court below; and we aro now asked to set it aside, on the ground’ of misdirection on the part of the .—In = Judge. ve think the Judge erred, aud that a new trial ought to he granted. New trial ordered without costs. Before Justice Sandford. At ‘Prius —Brooks vs. Judson—This enuse, which has oceupied the Court since Wednesdag, was given to the jury this morning. His Honor said, in charging the jury, that plaintiff brings this action, as exclusive owner, on the 20th August, 1847, of the store in Brow way. which is the foundation of his clan, Defendant, on‘the other hand, claims that he was a dormant part- ner in the concern, and that he furnished the capital, &o., to the concern, and, of course, if he was a dormant partner, be was equally with ‘plaintiff entitled to share in the profits and loss, and, as such, nei- ther he nor the other defendants ‘would be liable to the plaintiff in this action; but if he were not a ge- neral partner, then the plaintitt would be entitled to recover both ‘against him and the other defendants, if they were acting for him. ‘That arises from the fact that the acts of ne partner good aro against another partuer, One has a right to confess a judgment with- Dut conculting the other for a partnership debt, and it will bind the partnership properly.
