(0 coatirm the eormumissioners? report ia this matter. when Mr. Justice Harlsut stopped the counsel. and said that in consequence of the refusal of three of the Judges of the outside distriets to hold aterm bere, the businers of this district was lgoguish- ing. and he for one would not (aud he would urge it hy bie brethren to do bkewire) ‘ot the business of their own district. for the street buviness of Brooklyn, it wes tine that the public should know the delinguen- clet of the judges of the other districts, and how the thirty-two sinecures in this State are to be filed by the per +b who now hold them; he would give the business of the first district a preference over all 0 her; a long asa motion remained to be made or cause re- aained on the calendar, no other kusinees would be token up. He would even give the chamber business of the first distriet a preference. He did not mean to be undersiood as refusing absolutely to tak» this re- potup, All be meant to say was, that while there was such a frightful arrear of business on the caten bir of the courte of the first district, it suould be attended to before all other business. His Honor then prueceeded with the regular business. kn Barry vs Maria Remsen, Ex'z, §c.—This waa an application to be discharged trom a purchase. Cer- twin premires in Orange street were set up for sale by auction, pursvant toa decree of the Court of Chancery; Wiliam Lynch becawe the purchaser of lot No. 69, and sought to be discharged from the purchase oa the ground that there wes a discrepancy butween the description of the premises in the handbill or terms of fale, under which he purchased, and the Master's der d; or in other words. that the purchaser of the ud- joining lot was to have three feet of the alley way, which, by the terms of sale, belonged te him, Lynch. On the other side it was alleged, that map of the premises was exhibited at the sale. on which the boun- daries of the two lots were accurately described, aad that Lynch raw it, and was fully apprised of the boundaries. and that the Master’s deed contained an accurate deseripsion according to the map The Court held that the purchaser mast be dis- ebarged A question then aro-e as to costs. it was eontended, on the part of those interested in the fund, that. under the new code, the purchaser was not en- Utled te costs. The Court held that in all suits com- menced before the new code came into operation, (and this was one) the purchaser was entitled to costs. Coste ordered to be paid cut of the fand MON PLEss, July 20,—Before Judge Ingraham ph Hovie vs. Joseph Bishop, et al. This waa an action on a memorandum eheck for $500. Tae chock wos dated in October last. and drawn by defendants in favor of Riblett, who took it, together with one of bis own for the ame amount, and deposited them with the plaintiff, ax security for $500, advanced by him as a joan for a few da, The time for which the loan was made expired, and the plaintiff resorted to the checkr. but payment was refused both by} the bank and the drawers. For the defence it was insisted that the draft should have been presented in due time; that instead of holding it over until the time for pay- ment of the loan expired, it should have been pre- sented on the day it bore date. Want of conside- ration was also ket up asa defence. Judgment for plaintiff for the full amount, Joseph Hoxie vs George Riblett.—This was anaction for the tame amount, brought against Riblett as the princizal.
