a a Taorrine at tHe Centaevinis Covass, L. —The announcement of a trotting contest between the two eclebrated nags, Lady Suffolk and Lady Sutton, drew above track, on Monday afternoon, s goodly num- of gentlemen to witness the sport. The day was “suspicious, the weather clear, calm, and delightful, and n early hour in the afternoon the turnpikes ited a lively.and gay appearance with the number ing fellows, splendid vehicles, and fast horses, all as rapidly as possible, making the whole route a course, from the ferries to the track. At 3 k, the bulk of the erowd arrived, and businessin the financial circles commenced, Lady Suffolk being offered at one hundred to seventy against the other, This state of odds did not take well, however, and further advances were demanded by the backers of the brown mare, when one hundred to fifty became the standard at a brisk rate. The track, on inspection, ‘being found in superb condition for quick time, sever wagers were made on 2:30 being done. At the sm- mons for the nags, they appeared on the track in fine order forthe work before them, Lady Suffolk looking more like a six year old, than a veteran of summers. Lady Sutton also looked remarkably well, Dearing a gloss on her coat that radiated in the sun in @ manner reflecting credit to the skill and attention of her trainer. ; The race was mile heats, best three in five in harness, for a purse of $260; and the report of the respective heats, given below, will convince all judges of such matters that this contest, both in point of speed and contention, was one of the very best that has ever taken place; probably the very best. First Heat.—The choice of track was won by Lady Suffolk. The start was a good one, and the naga dashed off at a tremendous rate; too fast, indeed, for Lady Suffolk broke up before she had gone one han- dred and fifty yards, thereby losing half-a-dozen lengths. The other mare, before #h reached the quar- ter-pole, met with similar accident, and came almost wa ill, She, however, passed that point in forty-one seconds, two lengths Down the back stretch, both nags went very rapidly, Suffolk closing aduaily, and at the half-mile pole lapped Lady Sut- ion, Time 1:16. The lash was now put in requisition, and a struggle commenced for the heat. Round the lower turn, Sutton maintained the lead, increasing her epeed as the other approached her head, all the way round to the home stretch; and from there to the stand, the contest was most brilliant. Bryant gave the mare her head, laid the reins loosely on her baek, with- out any apparent fear of @ break, plied his whip with might and main, and she, crouching under the lash, appearing conscious of the necessity of straining every nerve, faithfully responded to the demands of her owner; yet, 80 vigorously did the noble little Sutton contest the ground with her, that to within twenty ards of the scere Suffolk was unable to take the lead Sas her; but in that short space, the whip being used too freely, she seemed to relax her speed, and Suffolk beat her in by a head.—Time 2:31. Had not the acci- dent occurred to the nags in the first quarter of this heat—both losing at least four seconds—it would have been the fastest on record. Second Heat—This was anothar tremendous heat, although it did not cause as much excitement as the previous one. start was very equal, and the naga left the score with A ee velocity ; but in making the upper turn, Lady Sutton broke up, pring @ lead of about eighty yards to the gray mare. iryant secing the advantage he had thus gained, evi- dently thought of a distance, and hurried his mare forward to secure that result. It was supposed gene- rally tl Mr. Whelpley would merely endeavor to save himself, without making an effort for the heat; but after his charge recovered her trot, she played out so vigorously and gained so rapidly on Suffolk—having nearly overtaken her at the half mile pole—that he yashed her onward. The quarter pole was passed by ffolk in 39 seconds; and the half in 1:16. Round the lower turn Lady Sutton’s head was at the wheel of the other, and the strugglo commenced as they swung on the home stretch. Bryantand Whelpley again put their whips actively at work, and the contest tothe stand was truly severe. The brown mare had exerted herself too much in closing up the wide gap made by her break in the early part, to be successful at the termination of the heat, and she was in consequence beaten to the stand by half length. Taking into consideration that eighty yards had been gained on Suffolk by Sutton in three-quarters of a mile, aud that, too, under the circumstances mentioned above, we think the speed of Sutton, in this heat, the very best ever before made by horse, mare, or gelding. Time of the heat, 2:32. Third Heat.—There was a good start for this heat, ‘but going round the turn, Lady Suffolk broke up, and the brown mare led past the quarter pole thirty yards im advance of her, in 40 seconds. Down the back stretch, Lady Suffolk closed up so rapidly, that she was Jess than a length behind at the half mile. Time, 1:15, Round the lower turn, they were locked together, and in that way they came on the home stretch, From the three-quarter pole to the stand, the same persuasive means were used for the lea y the dri- vers, asin the previous heats; but not an inch was visibly gained by either, until they had passed the drawgate, when Lady Suffolk again made one of her usual coming in bursts, and led home by half a length. Time of the heat, 2:32, It has always been evident to the reporter, that Sutton would not stand the lash; in- stead of jumping from under it, she invariably has re- laxed her speed when called on in that way; and he would suggest, that if she cannot win without the whip in future, it is useless to apply it. She is nota Ripton, a Dutchman, nor a Suffolk; although the best nag ofher inches that the world ever saw. She is what the bucks of Boston would pronounce a “pod.” ‘The following is the summary:— D. The affirmance of the judgment of the court, below was hailed by all good citizens as a triumph of justice, and the hope was cherished that the tence of the law would be strictly and faithfully euted. On Saturday last, the Penitentiary was by the Grand Jury, th the District Attorney dignation were exhibited when it was discovered that there was a marked difference in the treatment of this infamous convict from that ef the other prisoners. Her delicate hands, although stained with the blood of numberless innocents, were covered with silk mits; her diamond and other jewels still glistened on her fingers ; although she wore the convict’s frock, yet’a silk dpron partially concealed it ; while, lest the sun’s rays might pefadventure be too severe for her neck, a dsome barege cape was thrown over her shoulders, Nor is this all: notwithstanding the statute expressly directs that prisoners under sentence should be fed upon inferior but wholesome food, Madame Restell has the attendance of a black and white servant, who con- vey to her. from the keeper's private table, more dainty and luxurious fare. We doubt not that a thorough in- vestigation will be made of this monstrous violation of Jaw and perversion of tice. If these distinctions between “gilded crime. nd the offences to which necessity may drive the wretched and obscure, are to be tolerated, the laws are a mere mockery, and trial and conviction a solemn farce. It is no palliation of the offence to say that it has heretofore been a custom to allow such differerces in the treatment of prisoners to be made—if they ever did exist, thejlaw was no less vio- Jated then than now, and it is time that the evil should be checked, the supremacy ,of the laws vindicated; and those who have been guilty of such abominable par- tiality, should not only be held to answer for the vio- Jation § duty, but be at once removed from the situa- tions which they so disgracefully fill —Star, July 18, A New Way or Enrorcine Payment.—The following advertisement 1s from the Edenton (N. Stocks are steadily declining, and we ree no immediate prospect of any change for the better. At the first board, to- day, there was enough businers done to give employ- ment to one active broker, and the street generally was unusually quiet. Treasury notes fell off }y per cent; Harlem, 4; Reading Railroad advanced \ per cont; Reading bonds, 4; Reading mortgage bonds, 2. There has been an active demand for sterling ex- change to-day; the rates have been firm at 9% a 10 per cent premium. It is reported in the street that the steamer will take out a large amount of specie. The market is well supplied with sterling exchange of second and third rate quality,’ which is offered at 8% 89 per cent premium, The Auditor of the State of Ohio has levied the follow- ing tax for the current year:—For general revenue purposes, 3-10 mill; for common school fund, £-i0 do; for payment of interest on State and sinking fund, 26-10 do. The taxable property in the State, of all kinds, both real and personal, is estimated at $21,000,000. But the assessed value, as returned from the several counties, the present year, is put down at $13,189,285 30, An increase of the rate of taxation of four and a half mills on the dollar, on this last sum, is recommended, in preference to a re-assessment of property, the cost of which would amount to one-fifth of the entire State revenue proposed to be levied. Such an fincrease would yield the sum of $59,351 78. We bave not had, for several months, such an ez- posé of the operations of our banking systems, as pre- sented in the affairs of the Canal Bank of Albany. ‘The statements which have, from time to time, been made public, since the suspension of that institution, are nothing compared with that which we annex, made by the examiners appoiuted by the Comptroller, ‘We give this affidavit at length, that the public gene- rally, and those interested particularly, may see what the condition of the bank was at the time of its sus- pension:— Canat Bank or ALBANY—EXAMINERS? AFFiDaviT. State of New York, City and County of Albany, ss.— ‘Andrew White and Thomas McMullen being duly sworn, say, that on the 11th day of July, inst., they were appointed by the Hon. Millard Fillmore, Comp- troller of the State of New York, special agents to ex- amine the affairs of the president, directors and com- pany of the Canal Bank of Albany. That im pursu- ance of that appointment, they proceeded to the said examination, and have been diligently engaged therein on the said llth, 12th, 13th and 14th days of said month of July. That they have been as yet un- able to make out a statement from the complicated, confused and extended nature of said affairs, and, in some considerable degree, from the want of diligence in one of the former clerks of said who proffered and undertook to balance the book: as to show the amounts due to and from the bank, and entered upon said undertaking; but he proceeded in the same ina very tardy and unsatisfactory manner. That al- though deponents have been unable to make out a full statement of the affairs of said bank, they have pro- ceeded sufficiently far to [ere eer to say—and they do depose and say—that fromjthe books, papers and af- fairs and vouchers of the bank, and from testimo- ny given before them by the late teller of said bank, it appears that the bills of said bank in cir- culation, unredeemed and unpaid, amount to about one hundred and eighty-nine thousand dollars; and Theodore Olcott, late cashier of said bank, has in- formed deponents—and theyjbelieve it to be tri that said bank if indebted to individuals for deposites above fifty thousand dolla! id to the State of New York about sixty-three thousand dollars. That they found in the said bank the sum of eleven hundred and two dollars, or thereabouts, in coin, and in good current bank bills not exceeding ten or fifteen dollars, besides some worthless, or almost worthless, United States Bank Dills of the nominal amount of two hundred and ten dollars. The above constitute all the asaets of said bank, except their real estate and stocks, and debts due them—the amount of which deponents, for the reasons above mentioned,are not able to state.) Deponents further say that from the testimony of the late teller of the said bank. taken before them, and from the declarations of the late cashier, and from their general observations, and thefaspecct of things appertaining to said bank, they are fully satisfi- ed that the assets of said bank will not be sufficient to their debts and liabilities, independent of the origi- . And deponents, further say, that it appears satisfactory to them, from ‘the books and pa- pers of said bank, that more than one half of the amount of the capital stock of said bank has been loaned to, and is now due and owing from, the direc- tora of said bank And further, that the late teller of said bank, according to his own testimony before de- ponents taken, has been in the habit of making large Jeans to many individuals, upon his own responsibility and without the knowledge or authority, or consent, of the directors; but, as he testifies. with the knowledge and sanction of the cashier. That such loans now due and unpaid, amount, according to deponents’ understanding, and their best knowledge as de- rived from the said teller’s testimony, together with the books and youchers, to at least twenty-five thousand dollars. That said amounts have been loaned principally, and almost or quite entirely, with- out any notes, endorsers or sureties, but ' upon simple memorandum checks, post dated, and other memoranda, most of which have yet many months torun. That the said amounts, and other large amounte, have been uniformly counted as cash, in making the statements of the affairs of said bank, and in calcula- tions for and making their semi-annual dividends. ler, with the know- ledge and , as he testifies, loaned eight thousand dollars to one Marlett, a contractor on the Erie Railroad, within a very few days before the raid 11th of July, without any note, bond or security, orany endorser or surety, except the said Martlett’s memorandum check, and his naked promise that he would send a draft on the Erie Railroad Company for the amount, but which amount, or any part thereof, has not yet been found. That apackage of eight thou- sand dollars was sent to Pepoon, Hoffman and Ten Broeck, in June last, with the knowledge and by the direction of the cashier, and never charged upon the books of said bank, until the 10th day of Jaly instant; and it further appears that Edwin Croswell, one of the directors of said bank, is indebted to said bank about seventy-five thousand dollars; and that John Keyes Paige, one of the said directors, is indebted to said bank for about fifty thousand dollars, for money loan- ed him by aid said bank, as president of a glass com- pany, in the city of Albany, about the solvency of which glass company deponents have no satisfactory knowledge. ‘ Deponents further say, that they are still engaged in said examination, and believe that they will be able to complete the same and report the result to the Comp- troller. in the course of two or three days to come. ANDREW WHITE. THOMAS McMULLEN. Sworn before me, this 14th day of July, 1848. IRA HARRIS. It is stated that there isa possibility of the bill- holders receiving the full amount of their claims, All the assets left in the bank afterthe general sweep mado on Monday night, the 10th instant, have been secured by the receiver appointed by the court, and will be ap- prepriated so far as they will go, for the be- nefit of the bill holders first, then for the depo- sitors and other creditors. On the 4th of March last, the officers of this bank made a statement on oath that its assets, or resources, were adequate to meet all its liabilities, including its capital stock of three hun- dred thousand dollars. On the Ist of March—four days before this report was made—the board of direc- tors paida dividend on the capital stock, which could not have been done without violating the law, unless its capital was unimpaired. Up to Monday, the 10th of July, at 2 o’clock, P. M., the bank continued in ac- tive operations, and on the very day previous to its failure, loaned to an individual connected with the contractors of the Erie Railroad Company, ten thou- gand dollars of its bills, for payment to the la. borers on the works of that road,and offered to loan fifty thousand dollars more in its own bills for the same purpose. We cannot find lan- guage strong enough to express our opinion of individuals who would palm off upom men who labor from morning till night on our public works, for six to eight shillings a day, money which they knew to be worthless, and which they knew would be in the possession of those so little able to lose it whenits worthlessness became known. The officers and direc- tors of the Canal Bank have much to answer for; and we hope public opinion will mete out to them their re- ward, Such men are out of the reach of all law; they escape the penitentiary, while crimes of less magnitude would consign the perpetrators to the cells of Sing Sing.gThe only course left is to hunt these men from the high places some of them hold in public affairs, and consign them so deep into the depths of damnation that + $4,111 62 5,0 » they will never be heard of again. The infamy of sueh men deserves the exeeration of all; but we have no doubt they will continue to enjoy the riches they have plundered from those who placed confidence in them, and be considered in the community “ highly repecta- ble’? members of society. It is very seldom, even in our long experience in the financial affairs of this country, that we have had to record such barefaced swindling as is exhibited in the affairs of the Canal Bank of Albany. The affidavit of the examiners is sufficient to satisfy any and every one that the most deliberate and systematic arrange- ments have beem made to drain the stockholders and other creditors out of every dollar, and leave the con- cern a mere shell. More than one million of dollars have been fraudulently extracted from this bank since last March, and yet the swindlera are known, and still at large! Within the past ten years there has been more legislating in this State relative to banks and banking systems, than in any other in the Union; ond afterall the changes—all the improvements—we see an institution at the seat of government, under the very nose of the Comptroller and the Attorney Gene- ral, swept of nearly the whole of its assets, for all we know to the contrary, in one night; and those respon- sible—so far asthe responsibility of such scoundrels can go—apparently indifferent to the ruin they bring upon hundreds, ¢nd the losses incurred by the labor- ing man, who depends upon his daily earnings for his daily bread, Talk about banking, banking laws, re- strictions and benking systems—they are a humbug, a farce, and such financiers as are concerned in half the banks in this State only laugh at them. te, The solvency of any bank—we'do not care how high its credit, ne matter what its reported condition, no matter how “ respectable” its board of directors—is a matter at all times of much doubt ; and the suspension of any bank, in this or any other state in the Union, would not surprise usin ast. It is fortunate for these institutions that the public are not intimately acquainted with their management—with the real “yrespeetability” of their boards of directors. The re- ports which are made from time to time of their affairs, deceive their creditors and create that confidence which enables them to live on until their substance is completely gone, and a collapse can no longer be pre- vented. New Yor, Tuesday, July 18—2 P. M, Asnes.—The market is firm, though not active. Pots are held at $5, and Pearls at $5 873¢. ere is but little inquiry this morning, ceeding 200 bales, at firm prices. The 83 yesterday reached 1500 bales, which were taken mostly by one house. Frour, &c—Western Canal flour is without particu- lar change to notice, though if anything the market is little more firm. The transactions add up 1500 bbls at $5 a $5 06%{ for common State and mixed Western, $5 18% a $5 25 for good brands Ohio; and $5 44a $5 6234 for pure Genesee; $6 25 for new Rochester, and $6 75 a $7 123¢ forextra. Of Southern we note sales 200 bbls Georgetown, at $6. Rye Flour remains about the same, with light sales. Meal is $250 and firm. Wheat continues very heavy; and no transactions of moment are taking place. Rye rules steady at 68140; sales of 1000 bushels, Co: shade firmer than it was, especially prime parcels, which are not very plenty. The operations ch 8,000 bushels at 56c for round heias, 49c for New Or- Jeans, and 49c a 52c for common to high mixed. Oats are without change, moderate sales Northern at 44c a 45e. Provisions—Our market for pork continues firm, and for prime holders are enabled to realize an advance. The sales sum up 400 barrels, at $11 to $11 12%, for mess, and $8 62% to $8 75 for prime. Beef rules steady at previous prices, with ales of 150 barrels. Mess and prime, cut Meats are held above the views of buyers, and there is but little movement in them. Lard is also firm, but the transactions are light. We quote sales 200 barrels and kegs at 7% a7%c, and 83zc. Butter and Cheese are dull and without change. Tvrspay, July 18—6 P. M. Flour exhibited very little change, and sales of this State and Western brands were made at about yester- day’s prices. Pure brands of Genesee were in steady demand for the Eastern trade, at full prices. Smail sales new were again made at yesterday’srates. Wheat was quiet, and no sales of moment reported. Yellow corn continued in steady demand, while supplies were light ; sales were made to a fair extent at yesterday's rates, There was no change in meal, ryo, or oats. Provisions were firmer, and considerable sales were reported, ineluding prime and mess, at an advance. Lard remained about the same, Sugars were active, with a fair amount of sales, on terms stated below. ‘Asnrs—Sales of about 130 bbis both sorts were made at $6, and'pearls at $5 873. apsturFs—Flour—The sales footed up 4 to “5,000 barrels, in various separate lots, among which were about 1,500. 2,000 barrels this State common, Oswego, &o., at $5 a $5 1234, with some inferior at $404; 500 a. 600 do pure to extra Genesee, &c., at $5 50 a $7; 500 do fine or scratched do sold at $4 6234; alot of Gene- see, extra, sold at $675; small sales of Ohio, flat hoop, were made at about $5 1239 $5 25, There was no change in Southern ; sales of 2 a 300 barrels were made at $6. Wheat—The market was quiet, and no sales transpired. Corn—Sales of about 16,000 20,000 bushels were made, in separate lots, including 2.000 bushels flat yellow, at 52c ; 12,00 do do at 680; 8'000 a 10,000 do round yellow sold at 55c ; 1,100 mixed do, for distilling, at 47c. Meal—The sales amounted to about 800 barrels Jersey at $2 50. Rye—Salesof 1,000 bushels were made at 68%c. Rye Flour—Sales of 150 barrels were made at $3 56a $3 62%. Oats—Canal were worth 43c a 44c, and by retail 45c. Corrne.—We noticed sales by auction of 500 bags damaged Rio at bc 8 5c. cash.
