The defendant entered into a contract in the month of June, 1847, with plaintiff, for the purchase of 3000 barrels flour, of particular brands, to be delivered in the months of July and August fol- lowing. The plaintiff, in pursuance of the contract, made atender of the first 1500 barrels on the 28th July, and the 24th Augast made a tender of the other 1500 barrels, both which tenders the defendant refused touccept. The defence is, that the tender was not ac- cording to contract. Adjourned. Geena Sessions, June 20.—Before the Recorder and Aldermen Crolius and Hatfield. Trial for Embezzlement.—Th» trial of Frederick Goodwin, who was charged with embezzling money from J. B. Ray was resumed. ‘The defence put in was that several dealings between the parties were in course of litigation in the civil courts, aud that certain books were ordered for inspection by the Court of Common Pleas, which were in the possession of, and belonged to, the prosecutor, the said suits being brought before said court, and that these books con- tained the accounts between Ray and Goodwin; and Ray alleged that it was necessary for him to have opportunity to inspect these books to defend himself against these charges. He further showed that he had requested to inspect. them, and had been refused but upon certain conditions. The jury rendered a ver- dict of guilty upon the first count in the indictment, and acquitted him on the four remaining counts. Charge of False Pretences —Officer Prince John Da- vis of the lower police, arrested yesterday a lawyer by the name of Daniel W. Clark, on a warrant issued by Justice Lothrop, wherein he is charged'with obtaining $325 by false representations. It appears from the aff davits taken before the magistrate that Samuel Harris and Frederick Renouile, carpenters and house jobbers, had some misunderstanding together, in business, on the 20th of April last, and Harris employed Clark as his attorney, to manage his business, and in doing so Clark obtained all the books and papers of the concern for the purpose of settling up the same. An assignment was then made by Harris to Clark for the benefit of the creditors, authorising him to collect all outstanding debts due the concern, and also to pay the debts against the firm, and the balance to be divi- ded between the copartners. This assignment was made by Harrisin the name of the firm, without the consent or authority of Renouile; Harris signing the names of both to the assignment. Amongst other debts due the concern was a claim of $325 against Mr. James Gordon Bennett, proprietor of the New York Herald, for carpenter work. This claim Clark commenced suit for in,the name of the firm, with- out the consent or approbation of Renouile. This matter Mr. Bennett referred for adjustment to his counsel, Mr, Benjamin Galbraith, who refused to pay the bill to Mr. Clark, without he showed the authority to receive the same from Renouile. Mr. Clark, in or- der te do that, made an affidavit, setting forth that he was authorised by Mr. Harris, in the name of the firm, to receive and collect all moneys due the concern. This Mr. Galbraith did not consider sufficient, as it only showed the consent of one party. Finding Mr. Galbraith still unwilling to pay he money, in addition to the above affidavit, Mr. ch continued on the bot- tom, “ That the said deponent (Clark) further says that he has authority from Renouile, of said firm, to colleqt andeettle the affairs of said partnership. Signed, D. W. Clark.” In addition to the above ‘statements, Mr. Galbraith sets ferth in his affidavit before the magie- trate, on the case being heard yesterday, that Clark had represented to him that Mr. Renouile had given, the said Daniel W. Clark authority to commence the’ afore-mentioned suit, as well as to settle the same, and receive the said sum of money from the said Mr. Ben- nett; and further, that Mr. Renouile was not in the eity of New York, but had left for France. Consequent- ly, it was under all these representations, which are alleged to be false, that induced Mr. Galbraith to pay the money to Mr. Clark. Mr. Renouile has not been out of the city, nor has he ever authorised Mr, Clark to collect, or receive any money. or moneys on his account, or on account of the firm. The hearing of the witnesses was closed last evening, and some law points will be submitted to the magistrate on both sides to-day, when, in all probabi- lity, the justice will give his decision. 4 Dishonest Servant.—Officer Jeffrey and ex-consta- ble Joseph. arrested yesterday an Irishwoman, called Mary Fitzpatrick. on'a charge of stealing seven sove- reigns and an English half crown piece, valued in all at $34 25, from Dr. James Wright, residing at No. 11 Oliver street. It apeared from the facts, that Mary was inthe employ of Dr. Wright; and. as the doctor was much affected with rheumatism, she was requested to assist him on and off with his clothes, being quite an old man; and-in doing so she extracted the sovereigns rom the wateh pocket of his pantaloons; and transfer- red the same to her own pocket. The doctor, on miss- ing the money, immediately suspected the accused; the officrs were sent for, who, on taking her into custody, found the money 1m her pocket. After her arrest she acknowledged paving the money; but said she picked it up from off the floor, and took charge of the same until un owner was found. This story the magistrate considered to be rather improbable; and, in default of bail; committed her to the Tombs for trial. Arrest of an Emigrant Boarding-house Keeper.—A man by the name of John Ruttner, keeper of an emi- grant boarding-house, at No. 5 Albany street, was arrested yesterday. on a charge of detaining the Ing- gage of Frederick Semiller, a German emigrant, which luggage was detained by Ruttner, or his agents. in the house, under a demand for a board bill; which is a violation of the emigrant law. This being a clear case, Justice Lothrop convicted Ruttner on the testimony, and fined him $50 ; andin default of payment thereof, committed him to prison, until the fine is paid. | Charge of Stealing a Diamond Breast Pin.—A man | by the name of Elias Lawets, was arrested yesterday. | on a charge of stealing a diamond breast pin, valued at $85, the property of Herman E. The Hermann carried out $275,000 in specie; the Aca- dia will take about $200,000, Another loan has been taken at over three per cent above par—the canal loan of New York. Preparations for taking portions of the government loan, have, undoubtedly, caused the stringency which has existed in the Boston and New York money markets during the past week After the result of the bids is announced at Washing- ton, a favorable change is anticipated by many, _ ‘Transactions in stocks have been quite limited dur- ing the week, and prices have again receded. ‘The fol- lowing railroad dividends have been declared for the current half year, viz.:—Concord and Nashua, 5; Worcester, Fitehburg and Maine, 415; Western, Low- elLand Eastern, 4; Old Colony and Providence, 334; Fall River, Northern, Portland, Portsmouth and Saco, 3; making in the aggregate a very large amount to be received by the stockholders of the safe and lucrative investments. The receipts of the Western road since December 1st, to which time the annual accounts were made up, show a decrease of $11,000 in eight weeks, and an in- crease of $51,000 in twenty weeks, making the net gain over last year, up to the present time, $40,000. In the past ten weeks there has been a gain for every week, except one. ‘The gain thus far has been princi- pally in the receipts from passengers, which are more profitable than any other. As the interest received from that souree will pay an equal amount. of interest on | the public debt, it has been thought advisable to re- tain the United States stock, to be used for the pay- ment of a large amount of the State debt, which falls due in 1851, The revenue from the sale of lands the oneuing year, is estimated at seventy-five thousand dollars, ‘The State Auditor suggests then, an annua! assessed tax, amounting to two hundred thousand dollars; as the ti (‘( ‘“(é#™C‘CO((# expenditures of the government, with the interest o: the public debt, amount to full that sum. The finances of Virginia appear to be ina very fa- vorable position. The ordinary receipts into the trea- sury for the past fiscal year, will pay all ordinary de- mands upon it, including $274.43, the interest on ‘the public debt; $95,381, on account of public works; and leave an estimated surplus of about $145,000—a sum which, itis presumed, will enable the Board of Pub- jc Works to meet all demands upon them, without re- sorting to loans. The Legislature, at the last session, passed acts which may increase the liabilities of the State in the sum of $2, tone fifth has been, and @ very large portion of the residue will have to be, incurred. The Governor suggests an enlargement of the public revenues, assuming it as the fixed determination of Virginiato carry on those works of internal improvement which are necessary to deve- lope her resources, and secure those advantages she ix so justly entitled to from her position. He recommends to establish the sum of $600,000 as the maximum an- nual expenditure for these objects; and that appro- priations shall, under no circumstances, exceed that amount, He intimates that the treasury may be relied upon for a part of this sum, the balance to be raised by loans.
